In <em>The Cultural Life of Intellectual Properties</em>, professor of law and cultural anthropologist Rosemary J. Coombe brings an illuminating ethnographic approach to an analysis of authorship and the role law plays in shaping the various meanings that animate these protected properties in the public sphere.<br /> Although such artifacts are ubiquitous in contemporary culture, little attention has been paid to the impact of intellectual property law in everyday life or to how ownership of specific intellectual properties is determined and exercised. Drawing on a wide range of cases, disputes, and local struggles, Coombe examines these issues and dismantles the legal assumption that the meaning and value of a text or image is produced exclusively by an individual author or that authorship has a single point of origin. In the process, she examines controversies that include the service of turbanned Sikhs in the Royal Canadian Mounted Police and the use of the term <em>Olympic</em> in reference to the proposed gay Olympic Games. Other chapters discuss the appropriation of such celebrity images as the Marx brothers, Judy Garland, Dolly Parton, James Dean, and Luke Skywalker; the conflict over team names such as the Washington Redskins; and the opposition of indigenous peoples to stereotypical Native American insignia proffered by the entertainment industry. How have the works of multiethnic authors challenged the notion that writing and authorship are neutral or universal?</p> <p>In <em>Novel Subjects</em>, Leah Milne offers a new way to look at multicultural literature by focusing on scenes of writing in contemporary works by authors with marginalized identities. These scenes, she argues, establish authorship as a form of radical self-careーa term we owe to Audre Lorde, who defines self-care as self-preservation and “an act of political warfare.”</p> <p>In engaging in this battle, the works discussed in this study confront limitations on ethnicity and nationality wrought by the institutionalization of multiculturalism. They also focus on identities whose mere presence on the cultural landscape is often perceived as vindictive or willful. Analyzing recent texts by Carmen Maria Machado, Louise Erdrich, Ruth Ozeki, Toni Morrison, and more, Milne connects works across cultures and nationalities in search of reasons for this recent trend of depicting writers as characters in multicultural texts. <p>As information flows become increasingly ubiquitous in our post digital environment, the challenges to traditional concepts of intellectual property and the practices deriving from them are immense. The romantic understanding of the lone author as an endless source of new creations has to face these challenges. In order to do so, this work presents a collectivist model of intellectual property rights. The core argument is that since copyright works enjoy profit from significant public contribution, they should not be privately owned, but considered to be a joint enterprise, made real by both the public and author. It is argued that every copyright work depends on and is reflective of the author's exposure to externalities such as language, culture and the various social events and processes that occur in the public domain, therefore copyright works should not be regarded as exclusive private property. The study takes its organizing principle from John Locke, defining and proving the fatal flaw inherent in debates on copyright: on the one hand the copyright community is eager to arm authors with a robust property right over their creation, while on the other this community totally ignores the fact that the exposure of the individual to externalities is what makes him or her capable of creating material that is copyrightable.
