The missing of this resistance was one of the most puzzling experiences of the last ten years. Supplementing Rob Jenkins' popular thesis that India is going through a 'reform by stealth' (Jenkins 1999) led by witty politicians, perfectly able to play the tunes of these various institutions, this article will provide a neo-institutionalist position with emphasize on the impact of the IMF's structural adjustments programme on the federal and local level, which led to a change in the formal as well as in the informal institutions themselves. There are four points in Jenkins' approach open to criticism and able to undermine the achievements of his research: a) the reductionist and static understanding of institutions b) the neglect of international entrepreneurs and structure influencing institutional policy c) the neglect of specific Indian 'realities', forcing institutions to adapt in the face of liberalization d) the overemphasizing on the relevance of informal institutions and corruption as a means to achieve desired political outcomes. The thesis provided in this essay will be that the observed shift towards an increased directive ability of the central government is only a short-term phenomenon masking a steadily accelerating devolution of power that capacitates state- and local authorities to autonomously negotiate their self-interest in a globalized world over the long run. It has tended either to be subsumed within one default account of modern constitutionalism, or it has been treated as an exotic outlier - a sui generis model of the state, rather than a form of constitutional ordering for the state. This neglect is both unsatisfactory in conceptual terms and problematic for constitutional practitioners, obscuring as it does the core meaning, purpose and applicability of federalism as a specific model of constitutionalism with which to organise territorially pluralised and demotically complex states. In fact, the federal contract represents a highly distinctive order of rule which in turn requires a particular, 'territorialised' approach to many of the fundamental concepts with which constitutionalists and political actors operate: constituent power, the nature of sovereignty, subjecthood and citizenship, the relationship between institutions and constitutional authority, patterns of constitutional change and, ultimately, the legitimacy link between constitutionalism and democracy. In rethinking the idea and practice of federalism, this book adopts a root and branch recalibration of the federal contract. It does so by analysing federalism through the conceptual categories that characterise the nature of modern constitutionalism: foundations, authority, subjecthood, purpose, design and dynamics. Von Oktober 1787 bis Mai 1788 erschienen ihre Artikel unter dem Pseudonym Publius2. Sie erkl?rten den Entwurf der Bundesverfassung, der beim Verfassungskonvent von Philadelphia entworfen worden war, und forderten seine Ratifizierung. Interessanterweise gibt es viele Parallelen zwischen dem Denken von Siey?s, das in seinen theoretischen Werken niedergeschrieben ist, und den Federalist Papers, die so etwas wie einen authentischen Verfassungskommentar darstellen. Dies wird schon im einf?hrenden Aufsatz zu den Federalists von J?rgen Gebhardt deutlich, der schreibt: 'Aber es scheint, dass nach Publius das Volk die F?lle seiner Souver?nit?t nur im feierlichen Akt der Verfassungsgebung aus?bt - eine Handlung, die nicht zu oft wiederholt werden soll und an die das Volk selbst, respektive die Volksvertretung gebunden bleibt.'3 In dieser Arbeit m?chte ich in einem ersten Schritt das Denken Siey?s` beleuchten. Dabei werde ich den Dritten Stand und die Rolle der Privilegien bei Siey?s behandeln. Danach wird es n?tig sein, auf die Lehre vom pouvoir constituant und dem pouvoir constitu? einzugehen, bevor man die Rolle von Verfassung, Gesetz und Naturrechten bei Siey?s er?rtern kann. Der n?chste Schritt wird der Vergleich mit den Federalist Papers sein. Dementsprechend ist die Rolle der Privilegien in Amerika ein zu behandelnder Punkt, genauso wie die Verfassungsgebung und die geschaffene Gewalt. Am Ende meiner Betrachtungen zu den Federalists kann dann ein Vergleich der Rolle der Verfassung wie der Gesetze und Amendments zur Verfassung gezogen werden. Ein Fazit wird zeigen, inwiefern Siey?s und die Federalists ?hnlich dachten, als sie die Rolle der Verfassung kl?ren wollten. Dabei sollte man nie vergessen, dass Siey?s theoretische Schriften die Grundlage f?r das neue Verfassungsdenken und die neue Einstellung in Bezug auf Volkssouver?nit?t in Europa begr?ndeten, w?hrend die Federalists in Amerika die erl?uterten Punkte nicht allein als theoretisches Manifest ansahen.
