Indigenous Peoples and the Future of Federalism【

As a settler state, Canada’s claims to sovereign control over territory are contested by Indigenous claims to land and to self-determination. Indigenous Peoples and the Future of Federalism presents legal analyses that explore forms of federalism and their potential to include multiple and divided sovereignties.

This collection aims to advance reconciliation with Indigenous peoples in Canada and elsewhere by developing jurisprudence on the possibilities for a nation-to-nation relationship between Indigenous nations and Crown sovereignty. Contributors use legal creativity to explore how federalism can be structured to include the constitutional jurisdiction of Indigenous nations. Several chapters are grounded in the Canadian context while others connect the issues to international law and other settler colonial jurisdictions, recognizing how Indigenous resistance to settler laws and government decisions can at the same time be the enactment of Indigenous legalities and constitutional cultures. Ultimately, Indigenous Peoples and the Future of Federalism offers innovative ways for Canada to move forward from this challenge using existing constitutional mechanisms to give life to a plurinational Canadian federalism inclusive of the jurisdiction of Indigenous peoples.

Featuring insights from some of the top specialists in the country, Fiscal Federalism in Canada unpacks numerous complexities of fiscal federalism in Canada. The book features key regional and provincial perspectives, while taking into account Indigenous realities, the three territories, and municipal affairs. The contributing authors go beyond the major federal transfers to examine the financing of education, cities, infrastructure, and housing.

This volume shows that fiscal federalism is much more than simply an aggregate of individual programs and transfers. It highlights the role of actors other than the federal and provincial governments and recalls the importance of territoriality. The book pays close attention to the political dimension of fiscal federalism in Canada, which is at the heart of how the federation functions and is essential to its governance. Fiscal federalism is central to the funding of critical programs through intergovernmental transfers, but it is also the focus of political debates on territorial redistribution. In tackling essential questions, Fiscal Federalism in Canada contributes to the so-called second-generation fiscal federalism literature, taking stock of the critical sociological and political issues at its core.

The Colonial Construction of Indian Country Native American Literatures and Federal Indian Law【電子書籍】[ Eric Cheyfitz ]

A guide to the colonization and projected decolonization of Native America

In The Colonial Construction of Indian Country, Eric Cheyfitz mounts a pointed historical critique of colonialism through careful analysis of the dialogue between Native American literatures and federal Indian law. Illuminating how these literatures indict colonial practices, he argues that if the decolonization of Indian country is to be achieved, then federal Indian law must be erased and replaced with independent Native nation sovereigntyーbecause subordinate sovereignty, the historical regime, is not sovereignty at all.

At the same time, Cheyfitz argues that Native American literatures, specifically U.S. American Indian literatures, cannot be fully understood without a knowledge of U.S. federal Indian law: the matrix of colonialism in Indian country. Providing intersectional readings of a range of literary and legal texts, he discusses such authors as Louise Erdrich, Frances Washburn, James Welch, Gerald Vizenor, Simon Ortiz, Leslie Marmon Silko, and others. Cheyfitz examines how American Indian writers and critics have responded to the impact of law on Native life, revealing recent trends in Native writing that build upon traditional modes of storytelling and governance.

With a focus on resistance to the colonial regime of federal Indian law, The Colonial Construction of Indian Country not only elucidates how Native American literatures and federal Indian law are each crucial to any reading of the other, it also guides readers to better understand the genocidal assault on Indigenous peoples by Western structures of literacy, politics, and law.

Managing Federalism through Pandemic【

Managing Federalism through Pandemic summarizes and analyses multiple policy dimensions of Canada’s response to the COVID-19 pandemic and related policy issues from the perspective of Canadian federalism. Contributors address the relative effectiveness of intergovernmental cooperation at the summit level and in policy fields including emergency management, public health, national security, Indigenous Peoples and governments, border governance, crisis communications, fiscal federalism, income security policies (CERB), supply chain resilience, and interacting energy and climate policies.

Despite serious policy failures of individual governments, repeated fluctuations in the overall effectiveness of pandemic management, and growing public frustration across provinces and regions, contributors show how processes for intergovernmental cooperation adapted reasonably well to the pandemic’s unprecedented stresses, particularly at the outset. The book concludes that, despite individual policy failures, Canada’s decentralized approach to policy management often enabled regional adaptation to varied conditions, helped to contain serious policy failures, and contributed to various degrees of policy learning across governments. Managing Federalism through Pandemic reveals how the pandemic exposed structural policy weaknesses which transcend federalism but have significant implications for how governments work together (or don’t) to promote the well-being of citizens.

Crossroads for Liberty Recovering the Anti-Federalist Values of America's First Constitution【電子書籍】[ William J. Watkins, Jr. ]

What did the American Founders actually intend for the country, and does it even matter today? If America began as an idea, then what kind of idea? In a time of increasing turmoil over American history, politics, and society, Crossroads for Liberty: Recovering the Anti-Federalist Values of America's First Constitution takes a surprising and thought-provoking look at the American Revolution, the Articles of Confederation, and the Constitution, and asks what we can learn from them.

Author William Watkins casts a critical eye on conventional wisdom about the Articles of Confederation, as he outlines the differences between that original U.S. governing document and the Constitution, which replaced it. He finds that the Articles protected individual liberty and community-centered government in ways that the looser language of the U.S. Constitution did not. Watkins draws from contemporary examples of bureaucratic overreach and expansion to support his argumentーexamples that were startlingly predicted by proponents of small government at the time of the Constitution's adoption. Along the way, he points back to the Articles and the values of the American Revolution as a framework for reimagining American politics to foster liberty and truly representative governance.

Crossroads for Liberty arrives at an important time in American political life, and its reexamination of the American Founding presents a significant contribution to the story about America. Readers will come away with a greater understanding of current political and constitutional issues, as well as a new perspective on American history.

EU Fiscal Federalism Past, Present, Future【

Fiscal federalism refers to the division of fiscal powers ー powers to tax and spend ー between different levels of government. The European Union (EU) is often seen as a legislative giant on clay feet, and one of the principal reasons for this feebleness is the lack of a significant fiscal capacity at the Union level. EU Fiscal Federalism: Past, Present, Future explores ten aspects of the EU's fiscal constitution relating both to the fiscal limits it imposes on Member States and the evolution of its own fiscal policy. Bringing together an international and distinguished group of scholars, this volume analyses the different legal dimensions of fiscal federalism within the EU, from the various aspects of the single market (free movement, banking union, state aid, tax harmonization) to the EU's budget and Economic and Monetary Union. The essays provide a fascinating overview of the topic as well as a detailed analysis of where EU fiscal federalism stands today and how it might develop in the future. Sweeping and thorough, EU Fiscal Federalism will appeal to academics and students of European Union law as well as to European policymakers.

From New Federalism to Devolution Twenty-Five Years of Intergovernmental Reform【電子書籍】[ Timothy J. Conlan ]

In the period from 1970 to the early 1990s, Republican leaders launched three major reforms of the federal system. Although all three initiatives advanced decentralization as a goal, they were remarkably different in their policy objectives, philosophical assumptions, patterns of politics, and policy outcomes. Expanding and updating his acclaimed book, New Federalism: Intergovernmental Reform from Nixon to Reagan (1988), Timothy Conlan provides a comprehensive look at intergovernmental reform from Nixon to the 104th Congress. The stated objectives of Republican reformers evolved from rationalizing and decentralizing an activist government, to rolling back the welfare state, to replacing it altogether. Conlan first explains why conservatives have placed so much emphasis on federal reform in their domestic agendas. He then examines Nixon's New Federalism, including management reforms and revenue sharing; analyzes the policies and politics of the "Reagan revolution"; and reviews the legislative limitations and achievements of the 104th Congress. Finally, he traces the remarkable evolution of federalism reform politics and ideology during the past 30 years and provides alternative scenarios for the future of American federalism.

Power Back to the People. The Relevance of Ethnic Federalism in Uganda The Relevance of Ethnic Federalism in Uganda【電子書籍】[ Lukwago Ssali ]

The infamous ?Scramble for Africa? resulted in random and unlikely borders that remain today. The West partitioned territory for the sake of its short-term goal of influence or mastery. They gave little thought to the long-running consequences for the Africans themselves. This arbitrary carving up of Africa, the colonial policy of divide and rule, and the resultant segmental cleavages in most post-colonial African states may be blamed for the horizontal inequalities, conflicts, and insecurity rampant since independence. In Uganda, as in many other African countries, the most evident of such cleavages have been tribal and ethnic. Recently there have been calls for constitutional reform that would devolve power to the tribal regions and revive the idea of federalism which was the organizing principle in the immediate aftermath of independence. This book highlights the dynamics of ethnic politics in the post-independence sub-Saharan setting in general and the background, meaning, and relevance of the debate on ethnic federalism in Uganda, in particular. Part of the book covers Vick Lukwago Ssali?s own experiences growing up in an independent but troubled Uganda. However, its central thesis is based on the voices of selected samples of ordinary people in ten different tribal areas of Uganda and what they comparatively think about the issue of federalism. Is their loyalty growing towards the centre or fading outwards from the troubled state to their integral traditional and cultural units?

Sleeping Dogs Quebec and the Stabilization of Canadian Federalism after 1995【電子書籍】[ Andrew McDougall ]

What happened to the Quebec sovereignty movement after 1995? In Sleeping Dogs, Andrew McDougall reveals how a change in federalist strategy, combined with an improving political context, helped Canada stabilize its federal system and bury the "Quebec question" for the foreseeable future.

The book identifies five potential reasons the Quebec sovereignty movement lost momentum and argues that all contributed to a political environment that benefited federalists. McDougall explores topics of elite accommodation, generational change, changing identity politics, economic globalization, and constitutional fatigue. He argues that Canada’s federalist political elites have capitalized on these developments to stabilize the country by dropping the national question ? even when they might still hold very different visions of the Constitution. Building on "constitutional abeyance" theory, the author conceives of this strategic change as the restoration of a constitutional abeyance among federalist actors. Considering recent history in light of subsequent developments, Sleeping Dogs is a timely and important attempt to understand the evolving situation in Quebec and Canadian federalism.

Herbert J. Storing's Complete Anti-Federalist, hailed as "a civic event of enduring importance" (Leonard W. Levy, New York Times Book Review), indisputably established the importance of the Anti-Federalists' writings for our understanding of the Constitution. As Storing wrote in his introduction, "If the foundation of the American polity was laid by the Federalists, the Anti-Federalist reservations echo through American history; and it is in the dialogue, not merely in the Federalist victory, that the country's principles are to be discovered."

This one-volume edition presents the essence of the other side of that crucial dialogue. It can be read as a genuine counterpart to the Federalist Papers; as an original source companion to Storing's brilliant essay What the Anti-Federalists Were For (volume I of The Complete Anti-Federalist, available as a separate paperback); or as a guide to exploring the full range of Anti-Federalist writing. The Anti-Federalist makes a fundamental source of our political heritage accessible to everyone.

Keeping the Compound Republic Essays on American Federalism【電子書籍】[ Martha Derthick ]

The framers of the U. S. Constitution focused intently on the difficulties of achieving a workable middle ground between national and local authority. They located that middle ground in a new form of federalism that James Madison called the "compound republic." The term conveys the complicated and ambiguous intent of the framing generation and helps to make comprehensible what otherwise is bewildering to the modern citizenry: a form of government that divides and disperses official power between majorities of two different kinds-one composed of individual voters, and the other, of the distinct political societies we call states. America's federalism is the subject of this collection of essays by Martha Derthick, a leading scholar of American government. She explores the nature of the compound republic, with attention both to its enduring features and to the changes wrought in the twentieth century by Progressivism, the New Deal, and the civil rights revolution. Interest in federalism is likely to increase in the wake of the 2000 presidential election. There are demands for reform of the electoral college, given heightened awareness that it does not strictly reflect the popular vote. The U. S. Supreme Court, under Chief Justice William H. Rehnquist, has mounted an explicit and controversial defense of federalism, and new nominees to the Court are likely to be questioned on that subject and appraised in part by their responses. Derthick's essays invite readers to join the Court in weighing the contemporary importance of federalism as an institution of government.
