Von Oktober 1787 bis Mai 1788 erschienen ihre Artikel unter dem Pseudonym Publius2. Sie erkl?rten den Entwurf der Bundesverfassung, der beim Verfassungskonvent von Philadelphia entworfen worden war, und forderten seine Ratifizierung. Interessanterweise gibt es viele Parallelen zwischen dem Denken von Siey?s, das in seinen theoretischen Werken niedergeschrieben ist, und den Federalist Papers, die so etwas wie einen authentischen Verfassungskommentar darstellen. Dies wird schon im einf?hrenden Aufsatz zu den Federalists von J?rgen Gebhardt deutlich, der schreibt: 'Aber es scheint, dass nach Publius das Volk die F?lle seiner Souver?nit?t nur im feierlichen Akt der Verfassungsgebung aus?bt - eine Handlung, die nicht zu oft wiederholt werden soll und an die das Volk selbst, respektive die Volksvertretung gebunden bleibt.'3 In dieser Arbeit m?chte ich in einem ersten Schritt das Denken Siey?s` beleuchten. Dabei werde ich den Dritten Stand und die Rolle der Privilegien bei Siey?s behandeln. Danach wird es n?tig sein, auf die Lehre vom pouvoir constituant und dem pouvoir constitu? einzugehen, bevor man die Rolle von Verfassung, Gesetz und Naturrechten bei Siey?s er?rtern kann. Der n?chste Schritt wird der Vergleich mit den Federalist Papers sein. Dementsprechend ist die Rolle der Privilegien in Amerika ein zu behandelnder Punkt, genauso wie die Verfassungsgebung und die geschaffene Gewalt. Am Ende meiner Betrachtungen zu den Federalists kann dann ein Vergleich der Rolle der Verfassung wie der Gesetze und Amendments zur Verfassung gezogen werden. Ein Fazit wird zeigen, inwiefern Siey?s und die Federalists ?hnlich dachten, als sie die Rolle der Verfassung kl?ren wollten. Dabei sollte man nie vergessen, dass Siey?s theoretische Schriften die Grundlage f?r das neue Verfassungsdenken und die neue Einstellung in Bezug auf Volkssouver?nit?t in Europa begr?ndeten, w?hrend die Federalists in Amerika die erl?uterten Punkte nicht allein als theoretisches Manifest ansahen.
