Lawyers in Early Modern Europe and America【

First published in 1981, Lawyers in Early Modern Europe and America aims to present a convenient conspectus on the legal professions in early modern Europe, Scotland, France Spain and Colonial America, and to provide a comparative perspective on the place of the legal profession in Western societies before the Industrial Revolution. The main themes covered by each contributor are: the status, number and vocational functions of the different classes or groups or lawyers; their social origins; education and career patterns; relations between lawyers and clients, other occupations and status-groups and the state; the extent of legal ‘professionalisation’ and the role of lawyers as ‘modernisers’ in cultural, economic, political and social terms. This book will be of interest to students of history, law and political science.

Victims Perceptions of Harm in Modern European War and Violence【電子書籍】[ Svenja Goltermann ]

Classifying people as 'victims' is a historical phenomenon with remarkable growth since the second half of the 20th century. The term victim is widely used to refer both to those who have died in wars and to people who have experienced some form of physical or psychological violence. Moreover, victimhood has become a shorthand for any injustice suffered. This can be seen in many contexts: in debates on social justice, when claims for compensation are made, human rights are defended, past crimes are publicly commemorated, or humanitarian intervention is called for. By adopting a history of knowledge approach, Victims takes a fresh look at the phenomenon of classifying people as victims. It goes beyond existing narratives to provide a new and comprehensive explanation of the complex genealogy of modern concepts of victimhood. In order to reveal the fundamental shifts in perceptions and interpretations of harm, this book reconstructs the emergence of the figure of the victim from the late 18th century to the present. Focusing on Western Europe, it shows that neither the World Wars nor the Holocaust were the only reasons for this shift. Instead, changing power relations and new knowledge, especially in medicine and law, fundamentally altered perceptions and interpretations of death and suffering, of legitimate and illegitimate violence. Today, the debate takes another turn with the widespread criticism of victim attribution and the increasing delegitimisation of the term. Svenja Goltermann tells this story with brilliant clarity - without subscribing to the new denigration of the victim.

A Marvelous Solitude The Art of Reading in Early Modern Europe【電子書籍】[ Lina Bolzoni ]

A preeminent Renaissance scholar illuminates early modern encounters with books, in which literature became a portal to self-awareness and miraculous communion between author and reader.

The experience of reading is often presented as personal and transformativeーa journey of self-discovery and, perhaps, renewal. In A Marvelous Solitude, Lina Bolzoni examines the early modern roots of this attitude toward the readerly act. Between the fourteenth and sixteenth centuries, European men of letters increasingly came to see books as something more than compendia of knowledge: they could also help readers understand the human condition. As Bolzoni shows, Petrarch, Boccaccio, Machiavelli, Montaigne, and Tasso all presented reading as a private encounter and a dialogue with the author.

For many Renaissance intellectuals, reading was instrumental to the construction of the self, which was enriched by contact with other learned men. These readers imagined the book as a mirror image of its author, with whom they held a secret affinity. In their letters to one another, humanists described the book as a body, reflecting the notion that reading literature placed its author in the room with oneself. Reading the work of a deceased author became akin to a necromantic rite, as the writers of bygone times were resurrected and placed in contemporary conversation. The vogue for hanging portraits of authors in libraries and studios ensured that the image of the creator was never far from his words, cementing bonds of friendship across barriers of time.

These mythsーcharming, fragile, and powerfulーinvested the readerly encounter with miraculous properties that lingered in the hearts of the Romantics. And something of those wonders persists today, in the intimate feeling that reading yet provokes.

Sexuality in Premodern Europe A Social and Cultural History from Antiquity to the Early Modern Age【電子書籍】[ Univ. Prof. Dr. Franz X. Eder ]

How did sexual relationships work before, in and outside of marriage in the pre-modern era? What problems did contraception and sexually transmitted diseases pose? How did people deal with prostitution and pornography back then? What were the possibilities for same-sex and queer desire and practice? Using numerous examples and sources from across the continent, Sexuality in Premodern Europeshows that even in earlier centuries, sexual life had an elementary significance for the coexistence of couples and communities. It was just as decisive for how individuals saw themselves and others as it was for maintaining the social, economic and political order.

Franz X. Eder interestingly emphasises the socio-historical view of sexuality, offering an apt foil for the cultural perspective which is so prevalent in the field. In this book, sexual behaviour is understood and thought about as social practice. From this vantage point, Eder deals with the function of the sexual in upbringing and socialization, its significance for the image of men and women, its role in marriage initiation, and the importance of sexual life for marital relationships and concubinage.

Deviant and discriminated sexual forms such as prostitution, pornography and same-sex acts are also addressed throughout. The book explores the ways in which many people gained sexual experiences before, besides or beyond marriage, even if these experiences were forbidden in former societies. While research into the history of sexuality has so far dealt with such forms of the sexual primarily from the point of view of regulation and sanctioning, here they are understood as 'positive' practices that allowed people to understand and take ownership of their sexual desire.

Personality and Power Builders and Destroyers of Modern Europe【電子書籍】[ Ian Kershaw ]

One of the great historians of our age asks: how far can a single leader alter the course of history?

The modern era saw the emergence of individuals who had command over a terrifying array of instruments of control, persuasion and death. Whole societies were re-shaped and wars fought, often with a merciless contempt for the most basic norms. At the summit of these societies were leaders whose personalities had somehow given them the ability to do whatever they wished.

Ian Kershaw's new book is a compelling, lucid and challenging attempt to understand these rulers, whether operating on the widest stage (Lenin, Stalin, Hitler, Mussolini) or with a more national impact (Tito, Franco). What was it about these leaders and the times they lived in that allowed them such untrammelled and murderous power? And what brought that era to an end? In a contrasting group of profiles, from Churchill to de Gaulle, Adenauer to Gorbachev, and Thatcher to Kohl, Kershaw uses his exceptional skills to think through how other, strikingly different figures wielded power.

Bread of Dreams Food and Fantasy in Early Modern Europe【電子書籍】[ Piero Camporesi ]

Piero Camporesi is one of the most original and exciting cultural historians in Europe today. In this remarkable book he examines the imaginative world of poor and ordinary people in pre-industrial Europe, exploring their everyday preoccupations, fears and fantasies.

Camporesi develops the startling claim that many people in early modern Europe lived in a state of almost permanent hallucination, drugged by their hunger or by bread adulterated with hallucinogenic herbs. The use of opiate products, administered even to children and infants, was widespread and was linked to a popular mythology in which herbalists and exorcists were important cultural figures. Through a careful reconstruction of the everyday imaginative life of peasants, beggars and the poor, Camporesi presents a vivid and disconcerting image of early modern Europe as a vast laboratory of dreams.

Bread of Dreams is a rich and engaging book which provides a fresh insight into the everyday life and attitudes of people in pre-industrial Europe. Camporesi's vision is breathtaking and his work will be much discussed among social and cultural historians. This edition includes a Preface by Roy Porter, Professor of the History of Medicine at the Wellcome Institute for the History of Medicine.

Silver, Trade, and War Spain and America in the Making of Early Modern Europe【電子書籍】[ Stanley J. Stein ]

A look at the interaction of America, Spain, and Europe between 1500 and 1750, focusing on Spain’s role in Europe’s expansion across the Atlantic.

The 250 years covered by this book marked the era of commercial capitalism, bridging late medieval and modern times. In 1500, Spain brought American silver back home across the Atlantic in exchange for European goods. Spanish colonialism, the authors suggest, was the cutting edge of the early global economy. America’s silver enabled Spain to bring elements of capitalism into its late medieval society. However, the authors argue, silver gave Spain illusions of wealth, security, and dominance, while its system of “managed” transatlantic trade failed to monitor silver flows that were beyond government control. While Spain’s intervention reinforced Hapsburg efforts at hegemony in Europe, it also led to proto-nationalist state formations, notably in England and France. 1714’s Treaty of Utrecht emphasized the lag between developing England and France, and stagnating Spain, and the persistence of Spain’s late medieval structures. These were basic elements of what the authors term Spain’s Hapsburg “legacy.”

Over the first half of the eighteenth century, Spain under the Bourbons tried to contain expansionist France and England in the Caribbean and to create policies competitors seemed to apply successfully to their overseas possessions, namely, a colonial compact. Spain’s policy planners (proyectistas) scanned abroad for models of modernization adaptable to Spain and its American colonies without risking institutional change. The second part of the book analyzes the projectors’ works and their minimal impact on the changing Atlantic scene until 1759. By then, despite its efforts, Spain could no longer compete with England and France in the international economy.

Silver, Trade, and War is about markets, national rivalries, diplomacy, conflict, and the advancement or stagnation of states.

Literary Forgery in Early Modern Europe, 1450?1800【電子書籍】[ Walter Stephens ]

“The essays gathered in this volume demonstrate that studying early modern European literary forgeries is a fascinating cultural adventure” (Lina Bolzoni author of The Gallery of Memory).

This comprehensive study of literary and historiographical forgery goes well beyond questions of authorship. It spotlights the imaginative vitality of forgery and its sinister impact on genuine scholarship. This volume demonstrates that early modern forgery was a literary tradition in its own right, with distinctive connections to politics, Greek and Roman classics, religion, philosophy, and modern literature.

The early modern explosion in forgery of all kindsーparticularly in the fields of literary and archaeological falsificationーdemonstrates a dramatic shift in attitudes toward historical evidence and in the relation of texts to contemporary society. The authors capture the impact of this evolution within many cultural transformations, including the rise of print, changing tastes and fortunes of the literary marketplace, and the Protestant and Catholic Reformations.

The thirteen essays draw on Johns Hopkins University’s Bibliotheca Fictiva, the world’s premier research collection dedicated exclusively to the subject of literary forgery. It consists of several thousand rare books and unique manuscript materials from the early modern period and beyond.

Contributors: Frederic Clark, James Coleman, Richard Cooper, Arthur Freeman, Anthony Grafton, A. The Materiality of Terracotta Sculpture in Early Modern Europe【

Through meticulously researched case studies, this book explores the materiality of terracotta sculpture in early modern Europe.

Chapters present a broad geographical perspective showcasing examples of modelling, firing, painting, and gilding of clay in Portugal, Spain, Italy, Germany, and the Netherlands. The volume considers known artworks by celebrated artists, such as Luca della Robbia, Andrea del Verrocchio, Filipe Hodart, or Hans Reichle, in parallel with several lesser-studied terracotta sculptures and tin-glazed earthenware made by anonymous artisans. This book challenges arbitrary distinctions into the fine art and the applied arts, that obscured the image of artistic production in the early modern world. The centrality of clay in the creative processes of artists working with two- and three-dimensional artefacts comes to the fore. The role of terracotta figures in religious practices, as well as processes of material substitutions or mimesis, confirm the medium’s significance for European visual and material culture in general.

This book will be of interest to scholars working in art history, Renaissance studies, and material culture.

Witch Politics in Early Modern Europe (1400?1800)【電子書籍】[ Stephan Quensel ]

Why does an entire society believe that there are witches who must be burned? What roles did the emerging 'state', the professions of clerics and jurists, and the public involved play in each case? And how could this project be completed?

From a sociological point of view, the findings of recent international research on witches provide a model of a more general, highly ambivalent, 'pastoral' attitude, according to which a shepherd has to care for the welfare of his flock as well as for its erring sheep.

The first main part describes the clerical initial situation, which developed the 'Dominican' demonological model of witchcraft on the basis of the still dominant magico-religious mentality in the 15th century.

A model, according to the second part of the book, which then in the course of the 16th century in Western Europe increasingly fell into the hands of the not so innocent jurists. From there it developed into a legal witch persecution that realized the early European witch model from the village witch to the mass persecutions to the late child witches.

The third part describes how witch persecutions slowly became less important towards the end of the 17th century as a general witchcraft 'politics' game in the transition from a confessional state to a (court) 'civil service' state.

Dynasty in Motion: Wedding Journeys in Late Medieval and Early Modern Europe【電子書籍】[ Patrik Pastrnak ]

Bringing together a variety of evidence, such as princely correspondence, travelogues, financial accounts, chronicles, chivalric or Renaissance poems, this book examines marital travels of princely brides and grooms on a comparative trans-European scale.

This book argues that these journeys were extraordinary events and were instrumental for dynastical and monarchical self-representation, and channelled aspirations and anxieties of princely houses when facing each other. Each such journey was a little earthquake that resonated across all layers of society. Hundreds of diplomats, envoys, aristocrats, city officials, low-status personnel, soldiers, artists, musicians, poets, and humanists were involved in preparing, executing, and commemorating them. Stretching far beyond the mere physical movements of the future royal spouse, the journeys snowballed into a myriad of other meanings that epitomised the very character of a society based on prestige, magnificence, honour, and glory. The story of nuptial travelling is fascinating and rich; it is a perfect condensation of monarchical order, dynastic agenda, value system, personal motives, female agency, and social networks in this period. It is dynasty in motion, prestige on wheels, queenly time, place, and time like no other.

This volume is the perfect resource for upper-level students and scholars of court studies, the history of monarchy, and for those interested in premodern Europe.

The Whole Economy Work and Gender in Early Modern Europe【

Advocating a gender-inclusive approach to the history of work, this book both counts and accounts for women's as well as men's economic activity. Showcasing novel conceptual, methodological and empirical perspectives, it highlights the transformative potential of including women's work in wider assessments of continuity and change in economic performance. Focusing on the period of European history (1500-1800) that generated unprecedented growth in the northwest ? which, in turn, was linked to the global redistribution of resources and upon which industrialisation depended ? the book spans key arenas in which women produced change: households, care, agriculture, rural manufacture, urban markets, migration, and war. The analysis refutes the stubborn contention of mainstream economic history that we can generalise about economic performance by focusing solely on the work of adult men and demonstrates that women were active agents in the early modern economy rather than passively affected by changes wrought upon them.

The Palatine Family and the Thirty Years' War Experiences of Exile in Early Modern Europe, 1632-1648【電子書籍】[ Dr Thomas Pert ]

The Palatine Family and the Thirty Years' War examines the experience of exiled royal and noble dynasties during the early modern period through a study of the rulers of the Electorate of the Palatinate during the Thirty Years' War (1618-1648). By drawing on a wide range of archival source materials, ranging from financial records, printed manifestos, and considerable quantities of diplomatic and personal correspondence, it investigates the resources available to the exiled 'Palatine Family' as well as their attempts to recover the lands and titles lost by Elector Frederick V?the son-in-law of King James VI and I of England and Scotland?in the opening stages of the Thirty Years' War. This work focuses on the years between Frederick's death in 1632 and the partial restoration of his son Charles Louis under the Peace of Westphalia in 1648. Although the 'Palatine Question' remained one of the most divisive and important issues throughout the entire Thirty Years' War, the years 1632-1648 have been greatly overlooked in previous examinations of the Palatine Family's exile. By considering the experiences of exiled elites in early modern Europe?such as the relationship between the Palatine Family and the Stuart Dynasty?this work will reveal the influence of dynastic and familial obligations on the high politics of the period, as well as the importance of conspicuous display and diplomatic recognition for exiled regimes in seventeenth-century Europe. It will demonstrate that that dispossessed rulers and houses were not automatically rendered politically insignificant after losing their lands and titles, and could actually remain an important player on the geo-political stage of early modern Europe.

Comparative Studies in Modern European History Nation, Nationalism, Social Change【電子書籍】[ Miroslav Hroch ]

The two main themes of this selection of articles by Professor Hroch are the process of nation formation during the 19th century, especially in the case of 'smaller' European nations, i.e. those without statehood, and the social and political aspects of the transition from a pre-modern, feudal and traditional society to a modern capitalist one and the uneven pace of this change in the West and East of Europe. The author argues that we cannot study the process of nation-formation as a mere product of some nebulous 'nationalism'; we have to understand it as a part of social and cultural transformation, as a component of modernization of European societies, even though this modernization did not occur synchronically and had its regional specificities. Many of the papers focus specifically on the Czech case, but throughout there is an emphasis on comparative history.

In the seventeenth century, riots, rebellions, and revolts flared around Europe. Concerned about their internal stability, many states responded by closely observing the violent upheavals that plagued their neighbors. Rebellion and Diplomacy in Early Modern Europe investigates how in this struggle for intelligence about internal discord, diplomats emerged as key information brokers and interpreters of Europe’s tumultuous political landscape.

The contributions in this volume uncover how diplomatic actors interacted with rulers, opposition leaders, informers, media entrepreneurs, and different audiences in their efforts to understand, communicate, and draw lessons from the insurrections in their time. Rebellion and Diplomacy also examines how diplomats actively tried to shape the course of internal conflicts by managing the dissemination of news, supporting political factions at their court of residence, and even instigating violence.

Covering different European regions from the Iberian Peninsula to Scandinavia and from the British Isles to the Carpathian Basin, the book will appeal to all students and researchers interested in early modern diplomacy, politics, and news cultures.

Modern European cinema and love examines nine European directors whose films contain stories about romantic love and marriage. The directors are Jean Renoir, Ingmar Bergman, Alain Resnais, Michelangelo Antonioni, Agn?s Varda, Fran?ois Truffaut, Federico Fellini, Jean-Luc Godard and ?ric Rohmer. The book approaches questions of love and marriage from a philosophical perspective, applying the ideas of authors such as Stanley Cavell, Leo Bersani, Luce Irigaray and Alain Badiou, while also tracing key concepts from Freudian psychoanalysis. Each of the filmmakers engages deeply with notions of modern love and marriage, often in positive ways, but also in ways that question the institutions of love, marriage and the ‘couple’.

The Virgilian Tradition Book History and the History of Reading in Early Modern Europe【電子書籍】[ Craig Kallendorf ]

The essays in this collection approach the reception of the Roman poet Virgil in early modern Europe from the perspective of two areas at the center of current scholarly work in the humanities: book history and the history of reading. The first group of essays uses Virgil's place in post-classical culture to raise questions of broad scholarly interest: How, exactly, does modern reception theory challenge traditional notions of literary practice and value? How do the marginal comments of early readers provide insight into their character and mind? How does rhetoric help shape literary criticism? The second group of essays begins from the premise that the material form in which early modern readers encountered this most important of Latin poets played a key role in how they understood what they read. Thus title pages and illustrations help shape interpretation, with the results of that interpretation in turn becoming the comments that early modern readers regularly entered into the margins of their books. The volume concludes with four more specialized studies that show how these larger issues play out in specific neo-Latin works of the early modern period.

Prophecy, Madness, and Holy War in Early Modern Europe A Life of Ludwig Friedrich Gifftheil【電子書籍】[ Leigh T.I. Penman ]

The political and religious turmoil of seventeenth century Europe appears in a strange new light in this volume, which explores the life and doctrines of the infamous German barber surgeon and prophet, Ludwig Friedrich Gifftheil (1595-1661). Inspired by an unstable alchemy of family tragedy and a corpus of dissenting religious writings, Gifftheil stalked Europe's battlefields, petitioning kings, princes, and emperors to end the warfare endemic on the continent. Convinced that all war was prompted by 'false prophets'--by which Gifftheil meant the clergy of Europe's Christian confessions--he pleaded with rulers to abjure the counsel of their advisors and institute instead a godly peace. Then, in 1635, Gifftheil reinvented himself by taking up his sword as ?God's warrior,? embarking on a quest to recruit an army of the righteous and wage a holy war in Europe and to institute a divine peace. Prophecy, Madness, and Holy War in Early Modern Europe uses new manuscript and print sources from across Europe, the United Kingdom, and North America to craft the definitive account of Gifftheil's life and exploits. Against a background of family loss, and restless travels across the continent, Gifftheil's story reveals an alternative history of religious and political dissent in the seventeenth century. His adventures cast a dramatic new light on the culture and society of early modernity, the place of prophecy and madness in the negotiation of religious authority, the origins of the theosophical current, and the stranger apocalyptic impulses at the roots of Pietism and missionary Christianity.

The Rich and the Poor in Modern Europe, 1890-2020 A Historian’s Response to Recent Debates among Economists【電子書籍】[ Hartmut Kaelble ]

As social inequality grows, historical analysis on wealth and income distribution across the 20th century often does not take into account inequality of education, health, housing and chances of social mobility, nor does it differentiate statistical inequality from the realities of peoples’ actual experience. With this broad understanding in mind, in a long look back on the history of social inequality in Europe, The Rich and the Poor in Modern Europe addresses these neglected subjects. It also tackles the commonplace notion that modern capitalism inevitably produces wealth gaps and asks whether the facts and figures we possess also lead to alternate interpretations of examples of mitigated inequality. Covering the 20th century and the beginnings of the 21st century in Europe through wars, and economic crises, through periods of unprecedented economic prosperity and staggering economies, both exacerbating and dampening the problem, acclaimed historian Hartmut Kaelble offers a rigorous response to understanding our present-day challenge of social inequality.

Reframing Aristotle's natural philosophy, this wide-ranging collection of essays reveals the centrality of magic to his thinking. From late medieval and Renaissance discussions on the attribution of magical works to Aristotle to the philosophical and social justifications of magic, international contributors chart magic as the mother science of natural philosophy.

Tracing the nascent presence of Aristotelianism in early modern Europe, this volume shows the adaptability and openness of Aristotelianism to magic. Weaving the paranormal and the scientific together, it pairs the supposed superstition of the pre-modern era with modern scientific sensibilities. Essays focus on the work of early modern scholars and magicians such as Giambattista Della Porta, Wolferd Senguerd, and Johann Nikolaus Martius. The attribution of the Secretum secretorum to Aristotle, the role of illusionism, and the relationship between the technical and magical all provide further insight into the complex picture of magic, Aristotle and early modern Europe.

Aristotelianism and Magic in Early Modern Europe proposes an innovative way of approaching the development of pre-modern science whilst also acknowledging the crucial role that concepts like magic and illusion played in Aristotle's time.
