Metaethics, Egoism, and Virtue Studies in Ayn Rand's Normative Theory【

Philosopher-novelist Ayn Rand (1905?1982) is a cultural phenomenon. Her books have sold more than 25 million copies, and countless individuals speak of her writings as having significantly influenced their lives. In spite of the popular interest in her ideas, or perhaps because of it, Rand’s work has until recently received little serious attention from academics. Though best known among philosophers for her strong support of egoism in ethics and capitalism in politics, there is an increasingly widespread awareness of both the range and the systematic character of Rand’s philosophic thought. This new series, developed in conjunction with the Ayn Rand Society, an affiliated group of the American Philosophical Association, Eastern Division, seeks a fuller scholarly understanding of this highly original and influential thinker.

The first volume starts not with the metaphysical and epistemological fundamentals of Rand’s thought, but with central aspects of her ethical theory. Though her endorsement of ethical egoism is well-knownーone of her most familiar essay collections is *The Virtue of Selfishnessー*the character of her egoism is not. The chapters in this volume address the basis of her egoism in a virtue-centered normative ethics; her account of how moral norms in general are themselves based on a fundamental choice by an agent to value his own life; and how her own approach to the foundations of ethics is to be compared and contrasted with familiar approaches in the analytic ethical tradition. Philosophers interested in the objectivity of value, in the way ethical theory is (and is not) virtue-based, and in acquiring a serious understanding of an egoistic moral theory worthy of attention will find much to consider in this volume, which includes critical responses to several of its main essays.

The End of Progress Decolonizing the Normative Foundations of Critical Theory【電子書籍】[ Amy Allen ]

While post- and decolonial theorists have thoroughly debunked the idea of historical progress as a Eurocentric, imperialist, and neocolonialist fallacy, many of the most prominent contemporary thinkers associated with the Frankfurt SchoolーJ?rgen Habermas, Axel Honneth, and Rainer Forstーhave defended ideas of progress, development, and modernity and have even made such ideas central to their normative claims. Can the Frankfurt School's goal of radical social change survive this critique? And what would a decolonized critical theory look like?

Amy Allen fractures critical theory from within by dispensing with its progressive reading of history while retaining its notion of progress as a political imperative, so eloquently defended by Adorno. Critical theory, according to Allen, is the best resource we have for achieving emancipatory social goals. In reimagining a decolonized critical theory after the end of progress, she rescues it from oblivion and gives it a future.

Shelly Kagan offers a division between moral factors and theoretical foundations that reflects the actual working practices of contemporary moral philosophers. The first half of the book presents a systematic survey of the basic normative factors, focusing on controversial questions concerning the precise content of each factor, its scope and significance, and its relationship to other factors. The second half of the book then examines the competing theories about the foundations of normative ethics, theories that attempt to explain why the basic normative factors have the moral significance that they do.Intended for upper-level or graduate students of philosophy, this book should also appeal to the general reader looking for a clearly written overview of the basic principles of moral philosophy.

Die normative Kraft des Decorum Angemessenheit bei Cicero, Ambrosius und Augustinus【電子書籍】[ Sophia Vallbracht ]

A Feminist Post-transsexual Autoethnography Challenging Normative Gender Coercion【電子書籍】[ Julie Peters ]

Gender as a social class along with its concomitant heteronormative gender coercion seem to be intransigent across time and cultures. But across these cultures we also see a degree of nonconforming behaviour which very often carries significant multi-dimensions of stigma and risk; because the exception proves the rule, an understanding of gender nonconformity sheds light on the normative operation of gender in society.

A Feminist Post-transsexual Autoethnography attempts to demythologise trans and gender diversity by conducting an in-depth critical analysis of the life choices of the autoethnographic subject (the author), who was so uncomfortable with their culturally allocated masculinity that they chose to live an apparently normal female life. The research is post-transsexual in that the subject forgoes passing in their affirmed gender to ensure the integrity of the data.

A Feminist Post-transsexual Autoethnography may primarily appeal to students and researchers interested in the Sociology of Gender and Sociology of Trans and Gender Diversity, as well as the broader areas of embodiment and power differentials based on gender, class, nationality, location, temporality, sexuality and gender (non)conformity. Is Political Philosophy Impossible? Thoughts and Behaviour in Normative Political Theory【電子書籍】[ Jonathan Floyd ]

Political philosophy seems both impossible to do and impossible to avoid. Impossible to do, because we cannot agree on a single set of political principles. Impossible to avoid, because we're always living with some kind of political system, and thus some set of principles. So, if we can't do the philosophy, but can't escape the politics, what are we to do? Jonathan Floyd argues that the answer lies in political philosophy's deepest methodological commitments. First, he shows how political philosophy is practiced as a kind of 'thinking about thinking'. Second, he unpicks the different types of thought we think about, such as considered judgements, or intuitive responses to moral dilemmas, and assesses whether any are fit for purpose. Third, he offers an alternative approach - 'normative behaviourism' - which holds that rather than studying our thinking, we should study our behaviour. Perhaps, just sometimes, actions speak louder than thoughts.

Normative Species How Naturalized Inferentialism Explains Us【電子書籍】[ Jaroslav Peregrin ]

This book is about rules, and especially about human capability to create, maintain and follow rules, as a root of what makes us humans different from other animals. The leading idea is that scrutinizing this capability is able to tell us who we humans are and what kinds of lives we live. It elaborates Wilfrid Sellars’ visionary observation that “to say that man is a rational animal, is to say that man is a creature not of habits, but of rules”; and it builds on the ideas of Sellars’ and Brandom’s inferentialism, in a novel naturalistic way.

The main tenet of inferentialism is that our language games are essentially rule-governed and that meanings are inferential roles. Jaroslav Peregrin sees the task of reconciliation of inferentialism and naturalism as centered around the problem of naturalization of rules. He argues that the most primitive form of a rule is a cluster of normative attitudes. We humans are specific by our tendency to assume peculiar attitudes to what we do, and to do so in a specific way, which turns the attitudes into “normative” ones. This self-reflective structure characterizes our ability to build systems of interconnected rules, which have come to constitute our natural niche. Furthermore, Peregrin shows how our most important system of rules ? that constitutive of our language ? helped to lead us to our current position of rule-following, ultra-social, rational, and discursive creatures.

Normative Species will be of interest to scholars and advanced students working in philosophy of language, philosophy of mind, social ontology, cultural evolution and cognitive science.

Robust Realism in Ethics Normative Arbitrariness, Interpersonal Dialogue, and Moral Objectivity【電子書籍】[ Dr Stephen Ingram ]

Stephen Ingram defends a robustly realistic metaethical theory, based on the concept of normative arbitrariness, of which he provides the first in-depth analysis. He argues that, in order to capture the normative non-arbitrariness of moral choice, we must commit to the existence of robustly stance-independent, categorical, irreducibly normative, non-natural moral facts. Specifically, he identifies five ways in which a metaethical theory might fail to capture the non-arbitrariness of moral choice. The first involves claims about the bruteness of moral attitudes or facts. The second involves claims about the privileging of some attitudes over others. The third involves the claim that some metaethical theories leave a normative deficit. The fourth involves a claim about our ownership over moral reality. And the fifth involves the claim that certain metaethical theories introduce a destabilising contingency into the moral domain. Ingram argues that robust realism is the theory that is best placed to avoid all five of these arbitrariness charges. He then goes on to show that, by exploring the nature of interpersonal moral dialogue, robust realists can defend epistemological and meta-semantic theories that are friendly to their view. Specifically, he defends a dualistic form of moral intuitionism on which some moral beliefs are justified on the basis of a priori intuitions, whilst others are justified on the basis of a posteriori moral experiences, and provides a theory of 'moral mental files' to explain how moral terms and concepts are able to refer to robust moral facts.

Bad Things The Nature and Normative Role of Harm【電子書籍】[ Neil Feit ]

Bad Things addresses various philosophical questions about the nature and moral relevance of harm. The most basic question is this: under what conditions does an event (or do some events) harm a given individual? Neil Feit focuses primarily on the metaphysics of harm, and he both defends and extends the counterfactual comparative account of harm. On this account, in its most basic form, an act or event harms an individual provided that she would have been better off if it had not occurred. The counterfactual comparative account is widely accepted but also widely criticized. Feit provides detailed and thorough responses to the most challenging objections. He argues that an adequate theory of harm should entail the counterfactual comparative account but also make room for a certain kind plural harm, where two or more events together harm an individual although neither one by itself is harmful. These harmful events are bad things, collectively, even if no single event is itself a bad thing. Feit sets out and defends a detailed account of plural harm, addressing issues about the magnitude and the time of the harm suffered by the victim. The primary focus of the book is on the metaphysics of harm, but issues concerning its normative or moral relevance are addressed. In particular, Feit questions the received view that there are strong reasons, which can be overridden only in unusual circumstances, against harming per se.

Evolution and the Foundations of Ethics Evolutionary Perspectives on Contemporary Normative and Metaethical Theories【電子書籍】[ John Mizzoni ]

If human biological evolution is part of our worldview, then how do commonplace notions of ethics fit in? To ask the question, “what does evolution imply about ethics?” we must first be clear about what we mean by evolution. Evolution and the Foundations of Ethics discusses four models of evolution, represented by Darwin, Dawkins, Gould, and Haught. We must also be clear about what we mean by ethics. Do we mean metaethics? If so, which variety? With metaethical theories (such as Error Theory, Expressivism, Moral Relativism, and Moral Realism), theorists are attempting to explain the general nature, status, and origins of ethics.

In the first four chapters of this book (Part I), John Mizzoni examines how metaethical theories fit with evolution. Next, in asking about the implications of evolution for ethics,do we mean normative ethics? Theorists who work with normative ethical theoriesーsuch as Virtue Ethics, Natural Law Ethics, Social Contract Ethics, Utilitarian Ethics, Deontological Ethics, and Ethics of Care)ーarticulate and defend a normative ethics that people can and do use in a practical way when deliberating about specific actions, rules, and policies. The next six chapters (Part II) look at how normative ethical theories fit with evolution. A full reckoning of ethics and evolution demands that we consider the range of ethical elements, both metaethical and normative. Thus, this book looks at what several different models of evolution imply about four metaethical theories and six normative ethical theories.

This book will be of interest to scholars interested in the intersection of evolutionary theory and ethical theory.

Democracy Promotion and the Normative Power Europe Framework The European Union in South Eastern Europe, Eastern Europe, and Central Asia【

This book presents a topical, holistic assessment of the European Union’s democracy promotion in South-East Europe, Eastern Europe, and Central Asia, analyzed through the prism of the Normative Power Europe (NPE) framework of transnational policy formation. To do so, it brings together three scholarly domains that traditionally stand apart and are discussed separately. The first addresses the notion of the European Union conducting a normatively-driven foreign policy both near and far abroad. The second is concerned with the legitimacy, operationality, and effectiveness of promoting democracy in third-world countries. The third addresses the quality of the relationship the European Union has been able to establish with some vital ? yet often troubled ? countries in South-East Europe, Eastern Europe, and Central Asia. Finally, based on the empirical findings presented in each chapter, this volume concludes by rethinking the concept and relevance of NPE to the field’s understanding of the EU’s foreign policy making. This edited volume offers the reader both a theoretically and empirically rich analysis of the European Union’s efforts to promote democracy abroad. As such is scholars and students of EU studies, particularly EU foreign policy, as well as policy makers at EU and national level and civil society representatives responsible for designing/implementing democracy promoting projects on the ground.

International Criminal Tribunals A Normative Defense【電子書籍】[ Larry May ]

In the last two decades there has been a meteoric rise of international criminal tribunals and courts, and also a strengthening chorus of critics against them. Today it is hard to find strong defenders of international criminal tribunals and courts. This book attempts such a defense against an array of critics. It offers a nuanced defense, accepting many criticisms but arguing that the idea of international criminal tribunals can be defended as providing the fairest way to deal with mass atrocity crimes in a global arena. Fairness and moral legitimacy will be at the heart of this defense. The authors take up the economic and political arguments that have been powerfully expressed, as well as arguments about sovereignty, punishment, responsibility, and evidence; but in the end they show that these arguments do not defeat the idea of international criminal courts and tribunals.

Normative Intermittency A Sociology of Failing Social Structuration【電子書籍】[ Gregor Fitzi ]

This book addresses the manifold crisis of current societies and understands it as a failure of normative social structuration. As an exemplar for this development, it analyses the decline of welfare state models and the corresponding societal compromise. Yet, it evaluates them as a symptom of a wider malaise of normative orders in complex societies. The question thus arises as to how social science can study the ongoing societal transformation. The book frames the phenomenon as ‘normative intermittency’ to capture its fluid alternation of social structuration and destructuration and develops its analysis in three steps: first, it draws a theoretically reflected symptomatic of its occurrences; it then establishes the sociological diagnosis necessary to understand its unfolding and finally evaluates its political outcomes. Methodologically, the book advocates a complete overhaul of the analytical frames of sociology to gauge the intermittent rhythm of the ongoing societal transformation. Thus, it develops an innovative reading of classical sociological theory beyond a number of unreflected axiomatic assumptions of the current sociological mainstream. Thanks to the assessment of the political outcomes of failing social structuration the book turns to a discussion of the development of possible emancipation paths in the form of ‘transformative social action’; reflexively, this accounts for the results of the sociological diagnosis of the crisis of normative social orders. The main analyses within the book scrutinise a number of empirical phenomena that establish normative intermittency in current societies and refer to the major debates that are taking place on the related topics in the state of art of sociological and political theory.

Explaining the Normative【電子書籍】[ Stephen P. Turner ]

Normativity is what gives reasons their force, makes words meaningful, and makes rules and laws binding. It is present whenever we use such terms as ‘correct,' ‘ought,' ‘must,' and the language of obligation, responsibility, and logical compulsion. Yet normativists, the philosophers committed to this idea, admit that the idea of a non-causal normative realm and a body of normative objects is spooky. Explaining the Normative is the first systematic, historically grounded critique of normativism. It identifies the standard normativist pattern of argument, and shows how this pattern depends on circularities, assumptions about the unique correctness of preferred descriptions, problematic transcendental arguments, and regress arguments that end in mysteries.

The book considers in detail a paradigm case: legal normativity as constructed by Hans Kelsen. This case exemplifies the problems with normativist arguments. But it also shows how normativism was constructed as an alternative to ordinary social science explanation. The normativist argument is that social science explanations themselves are forced to rely on normative concepts?minimally, on normative rationality and on a normative view of ‘concepts' themselves.

Empathic understanding of the reasoning and meanings of others, however, can solve the regress problems about meaning and rationality that are central to the appeal of normativism. This account has no need for a parallel normative world, and has a surprising and revealing lineage in the history of philosophy, as well as a basis in neuroscience.

Imposing Risk A Normative Framework【電子書籍】[ John Oberdiek ]

We subject others and are ourselves subjected to risk all the time - risk permeates life. Despite the ubiquity of risk and its imposition, philosophers and legal scholars have devoted little of their attention to the difficult questions stimulated by the pervasiveness of risk. When we impose risk upon others, what is it that we are doing? What is risking's moral significance? What moral standards govern the imposition of risk? And how should the law respond to it? This book highlights these important but neglected questions and offers novel answers to them in a systematic way, constructing a normative framework of risk imposition that draws upon a wide range of insights from diverse sources within philosophy and legal theory. Oxford Legal Philosophy publishes the best new work in philosophically-oriented legal theory. It commissions and solicits monographs in all branches of the subject, including works on philosophical issues in all areas of public and private law, and in the national, transnational, and international realms; studies of the nature of law, legal institutions, and legal reasoning; treatments of problems in political morality as they bear on law; and explorations in the nature and development of legal philosophy itself. The series represents diverse traditions of thought but always with an emphasis on rigour and originality. It sets the standard in contemporary jurisprudence.

The Competence of the European Union in Copyright Lawmaking A Normative Perspective of EU Powers for Copyright Harmonization【電子書籍】[ Ana Ramalho ]

This book inquires into the competence of the EU to legislate in the field of copyright, and uses content analysis techniques to demonstrate the existence of a normative gap in copyright lawmaking. To address that gap, it proposes the creation of benchmarks of legislative activity, reasoning that EU secondary legislation, such as directives and regulations, should be based on higher sources of law. It investigates two such possible sources: the activity of the EU Court of Justice in the pre-legislative era and the EU treaties. From these sources, the author establishes concrete benchmarks of legislative activity, which she then tests by applying them to current EU copyright legislation. This provides examples of good and bad practices in copyright lawmaking and also shows how the benchmarks could be implemented in copyright legislation. Finally, the author offers some recommendations in this regard.

Democratic Intergovernmental Organizations? Normative Pressures and Decision-Making Rules【電子書籍】[ Alexandru Grigorescu ]

This work posits that, over the past two centuries, democratic norms have spread from domestic politics to intergovernmental organizations (IGOs). Grigorescu explores how norms shaped IGO decision-making rules such as those driving state participation, voting, access to information, and the role of NGOs and transnational parliaments. The study emphasizes the role of 'normative pressures' (the interaction between norm strength and the degree to which the status quo strays from norm prescriptions). Using primary and secondary sources to assess the plausibility of its arguments across two centuries and two dozen IGOs, the study focuses on developments in the League of Nations, the International Labor Organization, the United Nations, the World Bank, the European Union, and the World Trade Organization.

How Interpretation Makes International Law On Semantic Change and Normative Twists【電子書籍】[ Ingo Venzke ]

Challenging the classic narrative that sovereign states make the law that constrains them, this book argues that treaties and other sources of international law form only the starting point of legal authority. Interpretation can shift the meaning of texts and, in its own way, make law. In the practice of interpretation actors debate the meaning of the written and customary laws, and so contribute to the making of new law. In such cases it is the actor's semantic authority that is key - the capacity for their interpretation to be accepted and become established as new reference points for legal discourse. The book identifies the practice of interpretation as a significant space for international lawmaking, using the key examples of the UN High Commissioner for Refugees and the Appellate Body of the WTO to show how international institutions are able to shape and develop their constituent instruments by adding layers of interpretation, and moving the terms of discourse. The book applies developments in linguistics to the practice of international legal interpretation, building on semantic pragmatism to overcome traditional explanations of lawmaking and to offer a fresh account of how the practice of interpretation makes international law. It discusses the normative implications that arise from viewing interpretation in this light, and the implications that the importance of semantic changes has for understanding the development of international law. The book tests the potential of international law and its doctrine to respond to semantic change, and ultimately ponders how semantic authority can be justified democratically in a normative pluriverse.

Normative and Pragmatic Dimensions of Genetic Counseling Negotiating Genetics and Ethics【電子書籍】[ Joseph B. Fanning ]

This book provides an elaboration and evaluation of the dominant conceptions of genetic counseling as they are accounted for in three different models: the teaching model; the psychotherapeutic model; and the responsibility model. The elaboration of these models involves an identification of the larger traditions, visions and theories of communication that underwrite them; the evaluation entails an assessment of each model’s theses and ultimately a comparison of their adequacy in response to two important concerns in genetic counseling: the contested values of non-directiveness and the recognition of differences across perspectives, with special focus on how religious and spiritual beliefs of patients are coordinated with the networks of meaning in genetics. Several insights are made explicit in this project through the work of Robert Brandom. Brandom’s deontic scorekeeping model demonstrates how dialogue is at the root of grasping a conceptual content. Against this backdrop, professional communications such as genetic counseling can be seen as late developments in linguistic practices that have structural challenges. Brandom’s model reminds us that the professional needs the client’s understanding to grasp conceptual content in a particular context.

This book focuses on how Indonesian civil society organisations interact with ASEAN to shape human rights institutionalisation in the region. Using Bourdieu-inspired constructivist IR as an analytical lens, the book argues that there are pre-reflexive norms that dominate the field of interaction in the region that shape the way civil society organisations operate. This has resulted in the diverging advocacy practices, thus complicating human rights institutionalisation process in ASEAN.

Pre-Insolvency Proceedings A Normative Foundation and Framework【電子書籍】[ Nicolaes Tollenaar ]

This timely new work evaluates the law regarding pre-insolvency proceedings. Setting the law in context, the book provides a conceptual framework for ideal practice, illustrating the implications of the new regime with specific practical examples. The book features a comprehensive discussion of the key principles underlying restructuring proceedings and explains the purpose of, and justification for, pre-insolvency proceedings. It provides answers to a number of important issues that are still undecided and the subject of debate. In particular, the book provides detailed analysis of the system of voting in classes, and it offers an in-depth discussion of the appropriate criteria for confirmation and cram-down together with consideration of the little-understood underlying economic issues. It also includes analysis of the key aspects of valuation and the applicable valuation standards in the context of restructuring, much needed as the incidence of judicial valuation arises in the context of cram-down. A comparative analysis and critique of UK schemes of arrangement and US Chapter 11 procedure is also included, giving readers a good understanding of the key features of both systems and enabling them to identify and learn from the differences. The author also proposes an outline of ideal pre-insolvency proceedings, setting out general and specific requirements for ensuring flexibility, efficiency, and effectiveness.

Normative Foundations of the Welfare State The Nordic Experience【電子書籍】[ Nanna Kildal ]

This is a sharp analysis of the unique Nordic welfare system with urgent lessons for governments and societies across the globe.
Welfare programs and institutions tend to be analyzed as instrumental arrangements, overlooking the fact that welfare programs are essentially expressions of moral conceptions and values. This book recognises this distinction and offers analyses, perspectives and interpretations of the normative foundation of the 'Nordic welfare state model'.
These authors examine the main normative principles in this model, exploring their origins and the relationship between them. Paying particular attention to the principles of 'universalism', 'public responsibility for welfare', and 'work for all', they consider their significance for current welfare policy and question whether external economic and ideological pressures are threatening these principles. The book is divided into three clear parts:
*Part I considers the historical trajectories behind the Nordic welfare model
*Part II looks more specifically on normative tensions and dilemmas in current welfare policies with a focus on women friendly welfare, attitudes to basic income and alcohol and drug misuse
*Part III focuses on the possible change in the normative foundation of the Nordic welfare states
This book will be essential reading for researchers and students of the welfare state and also to those in the fields of social policy, comparative politics and political economy.

Normative Economics in the History of Economic Thought Marx, Mises, Friedman and Popper【電子書籍】[ Sina Badiei ]

This book examines the role of normative economics in the writings of Karl Marx, Ludwig von Mises, Milton Friedman and Karl Popper.

The book shows that while distinguishing positive from normative economics can be helpful, this distinction should not minimize the importance of normative economics or reject the possibility of offering objective evaluations of social phenomena and policies in normative economics. The book offers a critical assessment of the attempts by Marx, Mises and Friedman to reduce scientific economics to the positive analysis of social phenomena alone. Through a meticulous analysis of their work, the book shows that their positive theories fail to justify their evaluations of economic phenomena and policies. The book then draws on the writings of Popper to maintain that we should place normative economics at the center of economics. The book argues that normative economics can choose the norms underlying its evaluations of social situations and policies objectively and relies on some of Popper’s ideas to offer some criteria that can facilitate the selection of these norms.

The book will be of interest to economists, historians of economic thought, philosophers of economics and political theorists and philosophers.

The Form of the Firm A Normative Political Theory of the Corporation【電子書籍】[ Abraham A. Singer ]

What are we to make of the power that corporations wield over people in modern society? Is such power legitimate? Many think so. To many businessmen and economists, as well as the general public, firms are purely private and economic entities, justified in using all legal means to maximize profit. In The Form of the Firm, Abraham Singer contends that such a view rests on a theoretical foundation that, while quite subtle, is deeply flawed. Contrary to the conventional wisdom, corporations are not natural outgrowths of the free market. Instead, Singer invites us to see corporations as political institutions that correct market inefficiencies through mechanisms normally associated with government -hierarchy, power, and state-sanctioned authority. Corporations exist primarily to increase economic efficiency, but they do this in ways that distinguish them from the markets in which they operate. Corporations serve economic ends, but through political means. Because of this, Singer argues that they also must be structured and obliged to uphold the social and political values that enable their existence and smooth-running in the first place: individual autonomy, moral and social equality, and democratic norms and institutions. A profound and timely rethinking of what a corporation actually is and how power within it ought to be structured and exercised, The Form of the Firm will reshape our understanding of political theory, corporate governance, corporate law, and business ethics.
