Dessen Erscheinen entfachte in der feministischen Theoriebildung heftigste Diskussionen und Kritiken der Thesen Gilligans, deren breitfl?chige Kontroverse, ob und wenn ja, warum Frauen moralisch anders Denken, bis heute andauert. Gilligan wies darauf hin, dass empirische Untersuchungen, auf denen bisherige Theorien moralischer Entwicklung basierten, zum einen ohne Einbeziehung weiblicher Probandinnen durchgef?hrt wurden und zum anderen die Einstufung von Frauen anhand dieser Modelle der moralischen Entwicklung, auffallend niedrig blieb. Dies motivierte sie zur Ausarbeitung alternativer Moralentwicklungen und Perspektiven moralischer Auffassung die ich im folgenden darlegen m?chte. Da sich Carol Gilligan in kritischer Weise auf die Theorien moralischer Entwicklung von Lawrence Kohlberg und damit implizit auch auf jene, Jean Piagets bezieht. Erscheint es mir wichtig, der Schilderung von Gilligans Thesen, eine verk?rzte Wiedergabe der moralischen Entwicklung nach Lawrence Kohlbergs voranzustellen. Lawrence Kohlberg formulierte, aufbauend auf Jean Piagets dreistufiges Modell der moralischen Entwicklung, ein nuancierteres Stufenmodell, bestehend aus drei vertikalen Stufen (Niveaus), als auch sechs horizontalen Stufen (Stadien). Dabei kommt der Verbriefung eine besondere Rolle zu. Obwohl die Verbriefung solche Vorteile wie einen direkten Zugang f?r Unternehmen bzw. Banken zum Kapitalmarkt, d.h. ohne Einbeziehung von Finanzintermedi?ren, bietet und auch eine breite Risikostreuung erm?glicht, k?nnen Principal-Agent-Probleme auftreten. Die vorliegende Arbeit setzt sich zum Ziel zu untersuchen, inwiefern die Subprime-Krise auf Moral Hazard zur?ckzuf?hren ist. Der folgende Beitrag beschreibt m?gliche Principal-Agent-Probleme, die bei asymmetrischer Informationsverteilung auftreten k?nnen, und auch die Problematik von Moral Hazard. Aus volkswirtschaftlicher Sicht kommt dabei sofort die Frage nach einer paretooptimalen Verteilung des Risikos auf. Einer der einschl?gigen Artikel dazu 'Unvertaintyand the Welfare Economics of Medical Care'wurde 1963 von J.K. Arrow verfasst. Die L?sung von Arrow soll kurz dargelegt werden, da sie auch aus betriebswirtschaftlicher Sicht f?r konkrete Vertragsausgestaltungen von Interesse sind. Aus Sicht der Agency Theory kann ein Versicherungsvertragsverh?ltnis als Agency Problem betrachtet werden. Dabei kommt dem Versicherer die Rolle der Prinzipalin und dem Versicherten die Rolle des Agenten zu. Grunds?tzlich lassen sich auf den Versicherungsvertrag die meisten klassischen Probleme der Agency Theory ?bertragen. Beispielsweise hat der Agent bessere Informationen ?ber das Risiko als die Prinzipalin, wodurch ein Adverse Selection Problem entsteht. Andererseits kann der Agent nach Vertragsabschluss Ma?nahmen setzen, die die Wahrscheinlichkeit des Eintretens eines Schadens, bzw. die Schadenh?he beeinflussen. Diese Ma?nahmen sind vom Versicherer im Normalfall nicht beobachtbar und k?nnen daher auch nicht vertraglich vereinbart werden. Dieses Problemstellung wir als Moral Hazard Problem bezeichnet. Wir wollen uns in dieser Arbeit mit dem letzteren Problem besch?ftigen. Im Blickpunkt unserer Untersuchung soll dabei liegen, welchen Effekt die dargelegte Informationsasymmetrie bez?glich der vom Versicherten gesetzten Schadenminderungsannahmen auf die optimale Verteilung von Risiko hat. Additionally, Fischer argues that we do not need genuine access to alternative possibilities in order for there to be a legitimate point to practical reasoning. Fischer's overall framework contains an argument for the contention that guidance control, and not regulative control, is associated with moral responsibility, a sketch of a comprehensive theory of moral responsibility (that ties together responsibility for actions, omissions, consequences, and character), and an account of the value of moral responsibility. For these reasons their theories constantly confront and challenge the cardinal tenet of our modern secular faith: the notion of progress. As justice is, for me, the prime example of a "confused notion", of a notion which, like many philosophical concepts, cannot be reduced to clarity without being distorted, one cannot treat it without recourse to the methods of reasoning analyzed by the new rhetoric. In actuality, these methods have long been put into practice by jurists. Legal reasoning is fertile ground for the study of argumentation: it is to the new rhetoric what mathematics is to formal logic and to the theory of demonstrative proof. It is important, then, that philosophers should not limit their methodologi cal studies to mathematics and the natural sciences. They must not neglect law in the search for practical reason. <p><strong>One of the great polemics and the key founding anarchist text, Godwin's <em>Enquiry</em> is his major work of political philosophy.</strong></p> <p><em>Enquiry Concerning Political Justice</em> established William Godwin as the chief exponent of British radicalism, in the tradition of the French Revolution. In it, he criticizes the 'brute engine' of government for systematizing oppression of individual liberty in the name of law and order, and calls for the abolition of all forms of rule and for the institution of an anarchist society based on the principles of simplicity, sincerity and equality. His book influenced everyone from Shelley and Coleridge (who revered him) to Thomas Malthus (who wrote his <em>Essay on the Principle of Population</em> in outraged response to him). The book's ideas would later echo through the writings of thinkers as diverse as Proudhon, Kropotkin, Marx and Thoreau, and it remains one of the great polemics of political literature.</p> <p>William Godwin, the famous philosopher and novelist, was born in East Anglia in 1756. The son of a Presbyterian minister, he was educated to follow in his father's footsteps, but subsequently lost his faith in God. He then devoted himself to writing, expounding his enlightenment and anarchist ideals in novels and essays. In 1797 he married Mary Wollstonecraft, the famous feminist; their daughter would grow up to be Mary Shelley, the author of <em>Frankenstein</em>. Godwin died in 1836.</p> <p>Isaac Kramnick is the Richard J. Schwartz Professor of Government at Cornell where he has taught since 1972.
