Despite this, their texts contain dozens of references to intersex.</p> <p><em>And the Sages Did Not Know</em> examines the rabbis’ legal texts and concludes that they had multiple approaches to intersex people. Sarra Lev analyzes seven different rabbinic responses to this conflict of their own making. Through their rulings on how intersex people should conduct themselves in multiple circumstances, the early rabbis treat intersex people as unidentifiable males or females, as indeterminate, as male, as non-gendered, as sui generis, as part-male/part-female, as a sustainable paradox, and, finally, as a way for them to think about gender, having nothing to do with intersex people themselves.</p> <p>This is the first such work that concentrates primarily on the potential effects of these rabbinic texts on intersex persons themselves rather than focusing on what the texts offer readers whose interest is rabbinic approaches to sex and gender or gender diversity. <p>Most studies of the history of interpretation of Song of Songs focus on its interpretation from late antiquity to modernity. In My Perfect One, Jonathan Kaplan examines earlier rabbinic interpretation of this work by investigating an underappreciated collection of works of rabbinic literature from the first few centuries of the Common Era, known as the tannaitic midrashim. In a departure from earlier scholarship that too quickly classified rabbinic interpretation of Song of Songs as allegorical, Kaplan advocates a more nuanced reading of the approach of the early sages, who read Song of Songs through a mode of typological interpretation concerned with the correspondence between Scripture and ideal events in Israel's history. Throughout the book Kaplan explores ways in which this portrayal helped shape a model vision of rabbinic piety as well as of an idealized vision of their beloved, God, in the wake of the destruction, dislocation, and loss the Jewish community experienced in the first two centuries of the Common Era. The archetypal and idealized language of Song of Songs provided, as Kaplan argues, a textual landscape in which to imagine an idyllic construction of Israel's relationship to her beloved, marked by mutual devotion and fidelity. <p><em>Circumventing the Law</em> probes the rabbinic logic behind the use of loopholes, the legal phenomenon of finding and using gaps within law to achieve otherwise illegal outcomes. The logic of <em>ha’aramah</em>, a subset of rabbinic legal circumventions mostly defined as a tool for private life, underpins both well-known circumventions, such as selling leaven before Passover, and lesser-known mechanisms, such as designating an animal intended for sacrifice “blemished” before birth to allow it to be slaughtered for food instead. Elana Stein Hain traces the development of these loopholes over time, revealing that rabbinic literature does not consistently accept or reject loopholes. Instead, rabbinic Judaism applies categories of evasion (prohibited), avoidance (permitted), and avoision (contested) to loopholes on a case-by-case basis. The intended outcome of a given loophole determines its classification, as does the legal integrity of the circumventive process in question.</p> <p>Yet these understandings of loopholes are not staticーinstead, rabbinic attitudes toward loopholing change over time. Early works display an objective, performative understanding of the self and of intention, but evolve over time to reflect more subjective and intimate understanding of the self and intention. This evolution redefines what legal integrity means in Jewish legal philosophy.</p> <p><em>Circumventing the Law</em> brings readers through the Second Temple period to the modern era to see how loopholing has evolved over millennia. With the destruction of the Second Temple in Jerusalem, along with the skeleton of what was once a Jewish state, Judaism entered a period of crisis far more severe than experienced with the destruction of the First Temple, along with the First Hebrew Commonwealth. Pharisaic Judaism, integral to the now nonexistent Jewish state, of necessity gave way to Rabbinic Judaism, which, as a minority religious culture, took root primarily in the enclaves of Jews strewn throughout the diaspora with little or mostly no control over their very existence. And in the absence of a centralized religious authority such as the Sanhedrin in the Temple complex, Jewish communities throughout the Diaspora developed different religious customs, traditions, and in some instances, belief systems, all nominally based on the core teachings of Scripture. <p>The shifting image of the Hasmoneans in the eyes of their contemporaries and later generations is a compelling issue in the history of the Maccabean revolt and the Hasmonean commonwealth. Based on a series of six Jewish folktales from the Second Temple period that describe the Hasmonean dynasty and its history from its legendary founders, through achievement of full sovereignty, to downfall, this volume examines the Hasmoneans through the lens of reception history. On the one hand, these brief, colorful legends are embedded in the narrative of the historian of the age, Flavius Josephus; on the other hand, they are scattered throughout the extensive halakhic-exegetical compositions known as rabbinic literature, redacted and compiled centuries later. Each set of parallel stories is examined for the motivation underlying its creation, its original message, language, and the historical context. This analysis is followed by exploration of the nature of the relationship between the Josephan and the rabbinic versions, in an attempt to reconstruct the adaptation of the putative original traditions in the two corpora, and to decipher the disparities, different emphases, reworking, and unique orientations typical of each. These adaptations reflect the reception of the pristine tales and thus disclose the shifting images of the Hasmoneans in later generations and within distinct contexts.
