Territorial Change and Conflict in Indonesia Confronting the Fear of Secession【電子書籍】[ Ratri Istania ]

This book focuses on Indonesia and investigates why competition between various identity-affiliated groups to claim a new province increases conflict severity. It includes a quantitative study, along with complementary case studies of provinces in Indonesia, which provide evidence that group fragmentation plays a role in determining conflict during a new province’s struggle.

Against the background of the Indonesian government’s territorial autonomy (TA) strategy, regional proliferation, or pemekaran, the author examines the long-term decentralization project in Indonesia, which has an ethnically and religiously divided population. The book provides answers to the questions of how the new province claim increases conflict in the supporting districts and how competition among diverse elites in districts pursuing a new province precipitate conflict within the region. Based on extensive field research, the four case studies of districts with varying degrees of conflict reveal that the campaign for a new province proliferation increases the probability of conflict at the district level and conflict can escalate during the initiation of a new province stage. The author argues that more provinces may be necessary to ensure the fair distribution of wealth that would enable the whole population to enjoy a similar quality of life and that the Indonesian government needs to wisely and strategically uphold its unity if a federal arrangement is not an option.

Offering a novel contribution to the study of the relationship between territorial change and conflict in Indonesia, this book will be of interest to academics studying Indonesian politics, Southeast Asian politics, as well as identity and ethnic politics.

Territorial Politics and Secession Constitutional and International Law Dimensions【

This book offers a broad perspective of revolutionary territorial politics by putting secession in the context of other forms of revolutionary territorial politics. This allows for a more complex and profound account of secession and offers the reader a conceptual approach to politics of revolutionary discontent with territorial status quo. Second, the book provides a multidiscoursive approach which combines the efforts of constitutional and comparative constitutional law scholars with international lawyers, EU lawyers and specialists in international relations. This allows for multifaceted and, in that regard, more adequate, balanced and rich analysis of secession and the other forms of revolutionary territorial politics.

Secession and the Sovereignty Game Strategy and Tactics for Aspiring Nations【電子書籍】[ Ryan D. Griffiths ]

Secession and the Sovereignty Gameoffers a comprehensive strategic theory for how secessionist movements attempt to win independence. Combining original data analysis, fieldwork, interviews with secessionist leaders, and case studies on Catalonia, the Murrawarri Republic, West Papua, Bougainville, New Caledonia, and Northern Cyprus, Ryan D. Griffiths shows how the rules and informal practices of sovereign recognition create a strategic playing field between existing states and aspiring nations that he terms "the sovereignty game."

To win sovereign statehood, all secessionist movements have to maneuver on the same strategic playing field while varying their tactics according to local conditions. To obtain recognition, secessionist movements use tactics of electoral capture, nonviolent civil resistance, and violence. To persuade the home state and the international community, they appeal to normative arguments regarding earned sovereignty, decolonization, the right to choose, inherent sovereignty, and human rights.

The pursuit of independence can be enormously disruptive and is quite often violent. By advancing a theory that explains how sovereign recognition has succeeded in the past and is working in the present, and by anticipating the practices of future secessionist movements, Secession and the Sovereignty Game also prescribes solutions that could make the sovereignty game less conflictual.

Self-Determination and Secession In Between the Law, Theory and Practice【電子書籍】[ Natalija Shikova ]

This book offers a comprehensive summary of extant international law scholarship on the topics of self-determination and secession and positions the concepts among present-day theory and relevant practice, illustrated through various ongoing cases and historical examples. The right to self-determination is among the least understood rights within international law. Theoretical dilemmas ? as to whether there is a link between self-determination and secession ? are nothing new. In essence, self-determination is a much broader concept than secession and obtaining independent statehood. Unilateral secession is not prohibited by international law, but neither is it per se welcomed or accepted in practice. Beyond the context of decolonization, secession claims have long been viewed with disapproval in international law, and lawyers have been extremely skeptical about the issue. Although this is still the case, there are also new trends and opportunities to explore situations in which secession can be accepted, legitimized, or even legally permissible. The yardstick for this is the diplomatic response to secessionism and the growing involvement of the international community in mediation and conflict resolution. Though finding solutions can be difficult, within the existing frame, the ongoing tension between the duty of every society to recognize pluralism and diversity on the one hand, and the inherent desire of every culture ? whether majority, minority or indigenous ? to protect its values and ensure conformity on the other, must be resolved. The practices and modalities that envisage the internal dimension of the right to self-determination as a right that is exercised within the state borders can offer such opportunities. The appropriate role of the state and the international community is to serve as mediators between competing forces and to set parameters that can transform destructive conflicts into productive political models.

Between Democracy and Law The Amorality of Secession【

This volume purports to explore the legal and political issues triggered by the new wave of secessionism. More specifically, those issues concern the interplay between notions of democracy (and democratic ends and means) and law (and the rule of law and constitutionalism). Against this background, the editors use amorality in order to escape the terrain of the justification of secession by making a distinction between the democratic theory of secession and the theory of democratic secession. In the first section, the theoretical nexus democracy-secession has been approached both from a legal and political theory perspective. The second section of the book examines the instruments that the theory of democratic secession invokes in order to justify secession and presents both legal and political science contributions. The third section focuses on social movements and political actors. The fourth section focuses on two case studies due to the awareness of the importance of the difference between secession in a democratic occidental context (which call into play the discussion of the democratic theories) and separations in a non-democratic context (where the nexus between secession and democracy is not really central).

Secessionism Identity, Interest, and Strategy【電子書籍】[ Jason Sorens ]

Using innovative methods to analyze both advanced democracies and developing countries, Jason Sorens shows how central governments can alleviate or increase ethnic minority demands for regional autonomy. He argues that when countries treat secession as negotiable and provide legal paths to pursuing it rather than absolutely prohibiting independence, violence is far less likely. Additionally, independence movements encourage government policies of decentralization that may be beneficial to regional minorities. An informative investigation of the root causes of political violence, Secessionism provides a clear-eyed look at independence movements for both governments and secessionists.

Democracy and Nationalism in Southeast Asia From Secessionist Mobilization to Conflict Resolution【電子書籍】[ Jacques Bertrand ]

Jacques Bertrand offers a comparative-historical analysis of five nationalist conflicts over several decades in Southeast Asia. Using a theoretical framework to explain variance over time and across cases, he challenges and refines existing debates on democracy's impact and shows that, while democratization significantly reduces violent insurgency over time, it often introduces pernicious effects that fail to resolve conflict and contribute to maintaining deep nationalist grievances. Drawing on years of detailed fieldwork, Bertrand analyses the paths that led from secessionist mobilization to a range of outcomes. These include persistent state repression for Malay Muslims in Thailand, low level violence under a top-down 'special autonomy' for Papuans, reframing of mobilizing from nationalist to indigenous peoples in the Cordillera, a long and broken path to an untested broad autonomy for the Moros and relatively successful broad autonomy for Acehnese.

Secession and Security Explaining State Strategy against Separatists【電子書籍】[ Ahsan I. Butt ]

In Secession and Security**, Ahsan I. Butt argues that states rather than separatists determine whether a secessionist struggle will be peaceful, violent, or genocidal.** He investigates the strategies, ranging from negotiated concessions to large-scale repression, adopted by states in response to separatist movements. Variations in the external security environment, Butt argues, influenced the leaders of the Ottoman Empire to use peaceful concessions against Armenians in 1908 but escalated to genocide against the same community in 1915; caused Israel to reject a Palestinian state in the 1990s; and shaped peaceful splits in Czechoslovakia in 1993 and the Norway-Sweden union in 1905.

Butt focuses on two main casesーPakistani reactions to Bengali and Baloch demands for independence in the 1970s and India's responses to secessionist movements in Kashmir, Punjab, and Assam in the 1980s and 1990s. Butt's deep historical approach to his subject will appeal to policymakers and observers interested in the last five decades of geopolitics in South Asia, the contemporary Israeli-Palestinian conflict, and ethno-national conflict, separatism, and nationalism more generally.

Boxing Pandora Rethinking Borders, States, and Secession in a Democratic World【電子書籍】[ Timothy William Waters ]

A timely and provocative challenge to the foundations of our global order: why should national borders be unchangeable?

The inviolability of national borders is an unquestioned pillar of the post?World War II international order. Fixed borders are believed to encourage stability, promote pluralism, and discourage nationalism and intolerance. But do they? What if fixed borders create more problems than they solve, and what if permitting borders to change would create more stability and produce more just societies? Legal scholar Timothy Waters examines this possibility, showing how we arrived at a system of rigidly bordered states and how the real danger to peace is not the desire of people to form new states but the capacity of existing states to resist that desire, even with violence. He proposes a practical, democratically legitimate alternative: a right of secession. With crises ongoing in the United Kingdom, Spain, Ukraine, Iraq, Syria, Sudan, and many other regions, this reassessment of the foundations of our international order is more relevant than ever.

Incomplete Secession after Unresolved Conflicts Political Order and Escalation in the Post-Soviet Space【電子書籍】[ Ana Maria Albulescu ]

This book analyses cases of incomplete secession after separatist wars and what this means for relations between central governments and de facto states.

The work explores the interplay between violence and power by examining the micro-dynamics inherent in the process of escalation between separatists and central governments. These dynamics affect not only the security interactions between these entities, but also the character of political and governance relations that are built in the aftermath of secessionist war. The book provides comprehensive analyses of the evolution of post-conflict relations between the Republic of Moldova and Transnistria and between Georgia and South Ossetia and Abkhazia. Beyond these empirical and conceptual examples, the book contributes to a key debate in International Relations that addresses the relationship between democratisation, nationalism and violence, and its applicability to the study of escalation in the post-Soviet space.

This book will be of much interest to students of secession, statehood, conflict studies, democratisation, post-Soviet politics and International Relations in general.

Chapter 2 of this book is freely available as a downloadable Open Access PDF at www.taylorfrancis.com under a Creative Commons Attribution-Non Commercial-No Derivatives (CC-BY-NC-ND) 4.0 license.

We Are Not One People Secession and Separatism in American Politics Since 1776【電子書籍】[ Michael J. Lee ]

E pluribus unum was suggested for the national seal in 1776, but national oneness has been haunted by its opposite ever since. We Are Not One People demonstrates how the persistence of separatist movements in American history reveals as much about the nation's politics as it does the would-be separatists. Each chapter explores how great swaths of Americans of every ideological stripe, in good times and bad, in and beyond the South, have disputed the nation's oneness and stressed its divisibility. Trumpeted in American myths, mottos, movies, and songs, separatism is omnipresent in American political culture. Separatist rhetoric has shaped Americans' experience of what it means to be an American, and we can learn much about the durable appeal and enduring fragility of the United States from those who tried to leave it. As one Vermont separatist quips, leaving is as American "as apple pie." We Are Not One People is a bold, pathbreaking, and far-reaching account of disunionists from 1776 to the present who wanted, as phrased in the Declaration of Independence, "to dissolve the political bands" connecting them to other Americans.

Rebels in the Making The Secession Crisis and the Birth of the Confederacy【電子書籍】[ William L. Barney ]

Regardless of whether they owned slaves, Southern whites lived in a world defined by slavery. As shown by their blaming British and Northern slave traders for saddling them with slavery, most were uncomfortable with the institution. While many wanted it ended, most were content to leave that up to God. All that changed with the election of Abraham Lincoln. Rebels in the Making is a narrative-driven history of how and why secession occurred. In this work, senior Civil War historian William L. Barney narrates the explosion of the sectional conflict into secession and civil war. Carefully examining the events in all fifteen slave states and distinguishing the political circumstances in each, he argues that this was not a mass democratic movement but one led from above. The work begins with the deepening strains within Southern society as the slave economy matured in the mid-nineteenth century and Southern ideologues struggled to convert whites to the orthodoxy of slavery as a positive good. It then focuses on the years of 1860-1861 when the sectional conflict led to the break-up of the Union. As foreshadowed by the fracturing of the Democratic Party over the issue of federal protection for slavery in the territories, the election of 1860 set the stage for secession. Exploiting fears of slave insurrections, anxieties over crops ravaged by a long drought, and the perceived moral degradation of submitting to the rule of an antislavery Republican, secessionists launched a movement in South Carolina that spread across the South in a frenzied atmosphere described as the great excitement. After examining why Congress was unable to reach a compromise on the core issue of slavery's expansion, the study shows why secession swept over the Lower South in January of 1861 but stalled in the Upper South. The driving impetus for secession is shown to have come from the middling ranks of the slaveholders who saw their aspirations of planter status blocked and denigrated by the Republicans. A separate chapter on the formation of the Confederate government in February of 1861 reveals how moderates and former conservatives pushed aside the original secessionists to assume positions of leadership. The final chapter centers on the crisis over Fort Sumter, the resolution of which by Lincoln precipitated a second wave of secession in the Upper South. Rebels in the Making shows that secession was not a unified movement, but has its own proponents and patterns in each of the slave states. It draws together the voices of planters, non-slaveholders, women, the enslaved, journalists, and politicians. This is the definitive study of the seminal moment in Southern history that culminated in the Civil War.

Identity, Self-Determination and Secession【

Engaging with a range of interconnected and highly topical issues of identity, self-determination and secession, this book examines the import and implications of 'identity claims', and looks into 'identity politics' motivated by such claims, which is becoming ever more salient in democratic and culturally and ethnically heterogeneous states. It discusses nationalism as an important component of identity of individuals and groups, and a position that generates claims of self-determination and secession on the part of ethnic and cultural groups. It also examines patriotism, which until recently seemed to be on the wane, but has undergone a dramatic revival after the terrorist attacks in the US on 11 September 2001 and the start of a global 'war on terror'. The book offers a typology of facets of patriotism, an assessment of its moral standing, and a critique of the beliefs about the patria it characteristically involves. Also discussed are topics such as political liberalism vs. 'identity liberalism', the ways a liberal society should treat nonliberal communities within it, the role of heritage and remembrance in national identity, the status of national minorities as an issue of equality, arrangements concerning indigenous peoples and intrastate autonomy as an alternative to secession, and whether secession can be a legal act. The book includes contributions by prominent philosophers and political and legal theorists from Australia, Canada, Israel, and the United States.

Kentucky's Rebel Press Pro-Confederate Media and the Secession Crisis【電子書籍】[ Berry Craig ]

“A history of Kentucky's pro-Confederate press and its decidedly unsuccessful campaign to take the Bluegrass State out of the Union.” ーCivil War Books and Authors

Throughout the Civil War, the influence of the popular press and its skillful use of propaganda was extremely significant in Kentucky. Union and Confederate sympathizers were scattered throughout the border slave state, and in 1860, at least twenty-eight of the commonwealth’s approximately sixty newspapers were pro-Confederate, making the secessionist cause seem stronger in Kentucky than it was in reality. In addition, the impact of these “rebel presses” reached beyond the region to readers throughout the nation.

In this compelling and timely study, Berry Craig analyzes the media’s role in both reflecting and shaping public opinion during a critical time in US history. Craig begins by investigating the 1860 secession crisis, which occurred at a time when most Kentuckians considered themselves ardent Unionists in support of the state’s political hero, Henry Clay. But as secessionist arguments were amplified throughout the country, so were the voices of pro-Confederate journalists in the state. By January 1861, the *Hickman Courier,*Columbus Crescent, and Henderson Reporter steadfastly called for Kentucky to secede from the Union.

Kentucky's Rebel Press also showcases journalists who supported the Confederate cause, including editor Walter N. Haldeman, who fled the state after Kentucky’s most recognized Confederate paper, the Louisville Daily Courier, was shut down by Union forces. Exploring an intriguing and overlooked part of Civil War history, this book reveals the importance of the partisan press to the Southern cause in Kentucky.

Creating a More Perfect Slaveholders' Union Slavery, the Constitution, and Secession in Antebellum America【電子書籍】[ Peter Radan ]

In Texas v. White (1869), the Supreme Court of the United States ruled that the unilateral secession of a state from the Union was unconstitutional because the Constitution created “an indestructible Union, composed of indestructible States.” The Court ruled “there was no place for reconsideration, or revocation, except through revolution, or through consent of the States.” In his iconoclastic work, Peter Radan demonstrates why the Court’s ruling was wrong and why, on the basis of American constitutional law in 1860?1861, the unilateral secessions of the Confederate states were lawful on the grounds that the United States was forged as a “slaveholders’ Union.”

Creating a More Perfect Slaveholders’ Union addresses two constitutional issues: first, whether the states in 1860 had a right to secede from the Union and second, what significance slavery had in defining the constitutional Union. These two matters came together when the states seceded on the grounds that the system of government they had agreed toーnamely, a system of human enslavementーhad been violated by the incoming Republican administration. The legitimacy of this secession was anchored, as Radan demonstrates, in the compact theory of the Constitution, which held that because the Constitution was a compact between the member states of the Union, breaches of its fundamental provisions gave affected states the right to unilaterally secede from the Union. In so doing the Confederate states sought to preserve and protect their peculiar institution by forming a more perfect slaveholders’ Union.

Creating a More Perfect Slaveholders’ Union stands as the first and only systematic analysis of the legal arguments mounted for and against secession in 1860?1861 and reshapes how we understand the Civil War and, consequently, the history of the United States more generally.

Regionalism and Secession: Historical Analysis of Bavarian and Catalan Regionalism, Struggles for Autonomy, Strong Independence Movements in Spain, Accommodation of Sub-state Regionalism【電子書籍】[ Progressive Management ]

Catalonia and Bavaria today cling tightly to their linguistic distinctiveness, their cultural traditions, their culinary specialties, and their political particularity. Even after the passage of some centuries, these regions have not yet amalgamated into the nation states that contain them. And yet, Bavaria's stubborn regionalism does not translate into any real longings for secession, whereas many Catalonians struggle actively and adamantly for autonomy. Why are there strong independence movements in Spain, but not in Germany? How have state formation and the relationship between the center and the region affected independence movements? This study provides a historical analysis of Bavarian and Catalan regionalism and argues that autonomy mitigates secession if the predominant state has accommodated sub-state regionalism. This study explains that the EU can either strengthen or weaken regional governments, depending upon the nature of the relationship between the regional governments and their associated national government. This study argues that the security of both a newly independent state and its parent government is worse off in the short term; the severity of the security situation depends on the nature of the divorce.

Nationalism as guiding political idea is alive and well in a united Europe, which in the year 2015 shows troubling signs of a return to the bad old ways of the 19th and the 20th centuries. The character and nature of nationalism pose a challenge for students of security studies unfamiliar with how nation states have developed from their origins in the pre modern political order. The 18 September 2014 Scottish referendum on independence, spearheaded by the Scottish Nationalist Party, is but one recent example of its continued relevance. The violent fate of eastern Ukraine and claims of the vitality of "New Russia" in the year 2014 are yet another. Nationalism continues to work in different ways in different parts of Europe, howeverーeven among places with comparable experiences of thwarted or deferred national independence which nonetheless in the present and recent past have not garnered headlines in US defense circles as has been the case recently in Eastern Europe. Yet these other examples are compelling and require analysis.

A Union Indivisible Secession and the Politics of Slavery in the Border South【電子書籍】[ Michael D. Robinson ]

Many accounts of the secession crisis overlook the sharp political conflict that took place in the Border South states of Delaware, Kentucky, Maryland, and Missouri. Michael D. Robinson expands the scope of this crisis to show how the fate of the Border South, and with it the Union, desperately hung in the balance during the fateful months surrounding the clash at Fort Sumter. During this period, Border South politicians revealed the region's deep commitment to slavery, disputed whether or not to leave the Union, and schemed to win enough support to carry the day. Although these border states contained fewer enslaved people than the eleven states that seceded, white border Southerners chose to remain in the Union because they felt the decision best protected their peculiar institution.

Robinson reveals anew how the choice for union was fraught with anguish and uncertainty, dividing families and producing years of bitter internecine violence. Letters, diaries, newspapers, and quantitative evidence illuminate how, in the absence of a compromise settlement, proslavery Unionists managed to defeat secession in the Border South.

Secession and Self-Determination NOMOS XLV【

The many questions that surround movements for secession and self-determination are both practically urgent and theoretically perplexing. The United States settled its secession crisis in the 1860s. But the trauma and unfinished business of those events are still with us. Around the world secession and self-determination are the key issues that cause strife and instability.
This volume provides an unusually comprehensive consideration of the many challenges of law and political philosophy that accompany them, and offers theoretical insights that provide guidance for policy. Among the questions considered are: should the international community recognize a right to secede and, if so, what conditions must be satisfied before the right can be asserted? Should secession and its conditions be recognized within domestic constitutions? Secession is the most extreme form of political separation and there are modes of self-determination short of it, including indigenous peoples' self-government and minority language rights. To what degree can these intrastate autonomy arrangements help ameliorate the injustices faced by indigenous groups?

The Right to Self-determination Under International Law “Selfistans,” Secession, and the Rule of the Great Powers【電子書籍】[ Milena Sterio ]

This book proposes a novel theory of self-determination; the Rule of the Great Powers. This book argues that traditional legal norms on self-determination have failed to explain and account for recent results of secessionist self-determination struggles. While secessionist groups like the East Timorese, the Kosovar Albanians and the South Sudanese have been successful in their quests for independent statehood, other similarly situated groups have been relegated to an at times violent existence within their mother states. Thus, Chechens still live without significant autonomy within Russia, and the South Ossetians and the Abkhaz have seen their conflicts frozen because of the peculiar geo-political equilibrium of power within the Caucuses region.

The Rule of the Great Powers, which asserts that only those self-determination seeking entities which enjoy the support of the majority of the most powerful states (the Great Powers) will ultimately have their rights to self-determination fulfilled. The Great Powers, potent military, economic and political powerhouses such as the United States, China, Russia, Japan, the United Kingdom, France, Germany, and Italy, often dictate self-determination outcomes through their influence in global affairs. Issues of self-determination in the modern world can no longer be effectively resolved through the application of traditional legal rules; rather, resort must be had to novel theories, such as the Rule of the Great Powers.

This book will be of particular interest to academics and students of law, political science and international relations.

Secession and European Union Law The Deferential Attitude【電子書籍】[ N?ria Gonz?lez Campa?? ]

Secession is a live issue in today's Western Europe. In the last decade, we have witnessed the consolidation of pro-independence movements in Scotland and Catalonia and in the near future, we might see their re-emergence or the rise of other pro-secession movements in other European regions. The response of the EU institutions to secession within EU Member States may well be based mainly on political considerations. However, since the EU is a community based on the rule of law, it has also to justify its position with normative arguments of principle. Secession and European Union Law provides such normative support, drawing on a pluralist reading of the relation between EU law and national law, to support the conclusion that EU law should respect domestic constitutional orders. This book studies secession within EU Member States through legal methodology: the theoretical-doctrinal analysis of concepts and institutions, considering the evolving reality and case law. The legal approach has three dimensions, given the three different legal orders that interact at the EU level: international law, EU law and national constitutional law. Based on Article 4 (2) TEU, the central claim of this book is that the EU duty to respect national identity and fundamental constitutional structures generate obligations to respect Member States' constitutional orders, provided that the values enshrined in the Article are not violated by the Member State affected. Topical and original, Secession and European Union Law reviews and rethinks key features of the EU and the EU legal order.

Secession from a Member State and Withdrawal from the European Union Troubled Membership【

This is the first book to jointly scrutinise two existential issues for the EU: withdrawal of a member state (i.e. Brexit) and territorial secession (affecting Scotland, Catalonia and beyond). The book applies normative and empirical analyses, explores new approaches and discusses the deep theoretical problems unleashed by these processes. Featuring a superb constellation of legal and political science scholars, the book combines specific legal analysis and considers the political dynamics behind the processes. It provides extensive coverage and sophisticated analysis of the interpretation of Article 50 and the possible consequences it may have. The implications of withdrawal and secession on EU citizenship are discussed in depth and there is an overview of the evolving nature of the relationship between the regions and the EU. Finally, there is an engaging normative discussion on the deeper meaning of these two processes with respect to the objective of European integration.
