Die Zahlungsanspr?che werden durch einen Be-stand unverbriefter Forderungen ('assets') gedeckt ('backed'), die auf die Zweckgesellschaft ?bertragen werden und im wesentlichen den Inhabern der Asset Backed Securities (Investoren) als Haftungsgrundlage dienen.' 1 ABS sollen in dieser Arbeit im Hinblick auf die Risikoabtretungsm?glichkeiten sowohl im aktuellen Stand als auch unter den Gesichtspunkten der Neuen Baseler Eigenkapitalvereinbarung (Basel II) analysiert werden. Betrachtet wird haupts?chlich die Abtretung mittels eines 'echten Forderungsverkaufs' durch ein Kreditinstitut als verbriefendes Unternehmen. 2 Dies hat vor allem den Grund, dass der Forderungsverkauf die signifikante Risikominderung darstellt. Aufgrund der hohen Komplexit?t der Thematik wird in Kapitel zwei zuerst dem Verst?ndnis von ABS mit seinen vielschichtigen Auspr?gungen, den haupts?chlich involvierten Parteien und seinen Strukturierungsm?glichkeiten eine zentrale Rolle beigemessen. Darauf aufbauend werden in Kapitel drei die sich bislang abzeichnenden aufsichtlichen Bestimmungen und Ver?nderungen f?r ABS durch Basel II n?her betrachtet. Dazu sei angemerkt, dass das Baseler Komitee sich vor allem zu ABS noch in der Diskussionsphase mit der Bankenbranche befindet, und die bisherigen Untersuchungen auf den aktuell ver?ffentlichten Dokumenten des Baseler Ausschusses f?r Bankenaufsicht beruhen. Viele Vorschl?ge der nur mit grundlegendem Verst?ndnis von ABS zur er?rternden Baseler Dokumente sind auf Unverst?ndnis und Kritik gesto?en, da auch die deutsche Kreditwirtschaft, wie sich durch mehrere Interviews herausstellte, Probleme hatte die Argumentationen des Baseler Komitees nachzuvollziehen.
