Imperialism, Sovereignty and the Making of International Law【電子書籍】[ Antony Anghie ]
|

This book argues that the colonial confrontation was central to the formation of international law and, in particular, its founding concept, sovereignty. Traditional histories of the discipline present colonialism and non-European peoples as peripheral concerns. By contrast, Anghie argues that international law has always been animated by the 'civilizing mission' - the project of governing non-European peoples, and that the economic exploitation and cultural subordination that resulted were constitutively significant for the discipline. In developing these arguments, the book examines different phases of the colonial encounter, ranging from the sixteenth century to the League of Nations period and the current 'war on terror'. Anghie provides a new approach to the history of international law, illuminating the enduring imperial character of the discipline and its continuing importance for peoples of the Third World. This book will be of interest to students of international law and relations, history, post-colonial studies and development studies.

Sextarianism Sovereignty, Secularism, and the State in Lebanon【電子書籍】[ Maya Mikdashi ]
|

The Lebanese state is structured through religious freedom and secular power sharing across sectarian groups. Every sect has specific laws that govern kinship matters like marriage or inheritance. Together with criminal and civil laws, these laws regulate and produce political difference. But whether women or men, Muslims or Christians, queer or straight, all people in Lebanon have one thing in commonーthey are biopolitical subjects forged through bureaucratic, ideological, and legal techniques of the state.

With this book, Maya Mikdashi offers a new way to understand state power, theorizing how sex, sexuality, and sect shape and are shaped by law, secularism, and sovereignty. Drawing on court archives, public records, and ethnography of the Court of Cassation, the highest civil court in Lebanon, Mikdashi shows how political difference is entangled with religious, secular, and sexual difference. She presents state power as inevitably contingent, like the practices of everyday life it engenders, focusing on the regulation of religious conversion, the curation of legal archives, state and parastatal violence, and secular activism. Sextarianism locates state power in the experiences, transitions, uprisings, and violence that people in the Middle East continue to live.

Rethinking Judicial Jurisdiction in Private International Law Party Autonomy, Categorical Equality and Sovereignty【電子書籍】[ Milana Karayanidi ]
|

This book explores the theory and practice of judicial jurisdiction within the field of private international law. It offers a revised look at values justifying the power of courts to hear and decide cross-border disputes, and demonstrates that a re-conceptualisation of jurisdiction is needed. Rather than deriving from territorial power of states, jurisdiction in civil and commercial cross-border matters ought to be driven by party autonomy. This autonomy can be limited by certain considerations of equality and critical state sovereign interests.

The book applies this normative view to the existing rules of jurisdiction in the European Union and the Russian Federation. These regimes are chosen due to their unique positions towards values in private international law and contrasting societal norms that generate and accommodate these values. Notwithstanding disparate cultural and political ideas, these regimes reveal a surprising level of consistency when it comes to enforcement of party autonomy. There is, nevertheless, room for improvement. The book demonstrates to scholars, policy makers and lawmakers that jurisdiction should be re-centred around the interests of private actors, and proposes ways to improve the current rules.

Chinese Law in Imperial Eyes Sovereignty, Justice, and Transcultural Politics【電子書籍】[ Li Chen ]
|

How did American schoolchildren, French philosophers, Russian Sinologists, Dutch merchants, and British lawyers imagine China and Chinese law? What happened when agents of presumably dominant Western empires had to endure the humiliations and anxieties of maintaining a profitable but precarious relationship with China? In Chinese Law in Imperial Eyes, Li Chen provides a richly textured analysis of these related issues and their intersection with law, culture, and politics in the eighteenth and nineteenth centuries.

Using a wide array of sources, Chen's study focuses on the power dynamics of Sino-Western relations during the formative century before the First Opium War (1839-1842). He highlights the centrality of law to modern imperial ideology and politics and brings new insight to the origins of comparative Chinese law in the West, the First Opium War, and foreign extraterritoriality in China. The shifting balance of economic and political power formed and transformed knowledge of China and Chinese law in different contact zones. Chen argues that recovering the variegated and contradictory roles of Chinese law in Western "modernization" helps provincialize the subsequent Euro-Americentric discourse of global modernity.

Chen draws attention to important yet underanalyzed sites in which imperial sovereignty, national identity, cultural tradition, or international law and order were defined and restructured. His valuable case studies show how constructed differences between societies were hardened into cultural or racial boundaries and then politicized to rationalize international conflicts and hierarchy.

The new politics of Poland A case of post-traumatic sovereignty【電子書籍】[ Jaroslaw Kuisz ]
|

The election of populist far-right party Law and Justice in 2015 marked a shocking break in Polish politics. A period of stability was brutally interrupted as Jaroslaw Kaczynski and his allies took over public media and launched a controversial ‘reform’ of the judiciary.

How was this illiberal turn possible after years of democratic development? Jaroslaw Kuisz, one of Poland’s leading liberal thinkers, digs deep into Polish history to propose an original analysis of the crisis. He reveals how centuries of statelessness have left Poles with a ‘post-traumatic’ attitude to sovereignty, making them wary of powerful foreign blocks, be it the EU, the Soviet Union or present-day Russia. This is a phenomenon populists have proved adept at exploiting.

Providing a brilliant account of Europe’s largest illiberal democracy, The new politics of Poland shines a light on the broader situation in East and Central Europe, offering valuable lessons for other countries experiencing the rise of populist right-wing movements.

Constitutional Change and Popular Sovereignty Populism, Politics and the Law in Ireland【
|

This collection focuses on the particular nexus of popular sovereignty and constitutional change, and the implications of the recent surge in populism for systems where constitutional change is directly decided upon by the people via referendum.

It examines different conceptions of sovereignty as expressed in constitutional theory and case law, including an in-depth exploration of the manner in which the concept of popular sovereignty finds expression both in constitutional provisions on referendums and in court decisions concerning referendum processes. While comparative references are made to a number of jurisdictions, the primary focus of the collection is on the experience in Ireland, which has had a lengthy experience of referendums on constitutional change and of legal, political and cultural practices that have emerged in association with these referendums. At a time when populist pressures on constitutional change are to the fore in many countries, this detailed examination of where the Irish experience sits in a comparative context has an important contribution to make to debates in law and political science.

Who Rules? Sovereignty, Nationalism, and the Fate of Freedom in the Twenty-First Century【
|

The populist phenomenon is often identified with the election of Donald Trump in November 2016. But the political, moral, and social realities for which Trump was a symbol both predated his candidacy and achieved independent fulfillment in countries as disparate as the United Kingdom, Hungary, and Brazil.

At the center of the populist challenge, this volume proposes, are two questions. The first revolves around the question of sovereignty: who governs a country? This question is at the center of all contemporary populist initiatives and has been posed with increasing urgency as the bureaucratic burden of what has come to be called the administrative state has intruded more and more forcefully upon the political and social life of Western democracies.

The second key question, one related to the issue of sovereignty, concerns what Lincoln called “public sentiment”: the widespread, almost taken-for-granted yet nonetheless palpable affirmation by a people of their national identity. The erosion of national sovereignty to which populism is a response has been accompanied by an erosion of that shared national consensus. Increasingly, the traditional pillars of this consensusーthe binding forces of family, religion, civic duty, and patriotic filiationーhave faltered before the blandishments of transnational progressivism.

The debate sparked by these problems has turned on a number of high-profile issues which this volume seeks to address, including immigration, free trade, foreign policy, religious freedom, and the question of citizenship.

Home Rule National Sovereignty and the Separation of Natives and Migrants【電子書籍】[ Nandita Sharma ]
|

In Home Rule Nandita Sharma traces the historical formation and political separation of Natives and Migrants from the nineteenth century to the present to theorize the portrayal of Migrants as “colonial invaders.” The imperial-state category of Native, initially a mark of colonized status, has been revitalized in what Sharma terms the Postcolonial New World Order of nation-states. Under postcolonial rule, claims to autochthonyーbeing the Native “people of a place”ーare mobilized to define true national belonging. Consequently, Migrantsーthe quintessential “people out of place”ーincreasingly face exclusion, expulsion, or even extermination. This turn to autochthony has led to a hardening of nationalism(s). Criteria for political membership have shrunk, immigration controls have intensified, all while practices of expropriation and exploitation have expanded. Such politics exemplify the postcolonial politics of national sovereignty, a politics that Sharma sees as containing our dreams of decolonization. Home Rule rejects nationalisms and calls for the dissolution of the ruling categories of Native and Migrant so we can build a common, worldly place where our fundamental liberty to stay and move is realized.

American Indian Sovereignty and the U.S. Supreme Court The Masking of Justice【電子書籍】[ David E. Wilkins ]

"Like the miner's canary, the Indian marks the shift from fresh air to poison gas in our political atmosphere; and our treatment of Indians, even more than our treatment of other minorities, reflects the rise and fall in our democratic faith," wrote Felix S. Cohen, an early expert in Indian legal affairs.

In this book, David Wilkins charts the "fall in our democratic faith" through fifteen landmark cases in which the Supreme Court significantly curtailed Indian rights. He offers compelling evidence that Supreme Court justices selectively used precedents and facts, both historical and contemporary, to arrive at decisions that have undermined tribal sovereignty, legitimated massive tribal land losses, sanctioned the diminishment of Indian religious rights, and curtailed other rights as well.

These case studiesーand their implications for all minority groupsーmake important and troubling reading at a time when the Supreme Court is at the vortex of political and moral developments that are redefining the nature of American government, transforming the relationship between the legal and political branches, and altering the very meaning of federalism.

HIV/AIDS and the South African State Sovereignty and the Responsibility to Respond【電子書籍】[ Annamarie Bindenagel ?ehovi? ]
|

For three decades post-apartheid, the HIV/AIDS epidemic from first acknowledgement to its management as a chronic disease, demanded unparalleled attention. This was nowhere more evident than in South Africa. This book explores how the state responded to its responsibilities to defend and protect (human) security. Linking this to the role of the state as sovereign protector and provider of security, it applies the findings to the broader re-interpretation of sovereign responsibility in the 21st Century. This book does not seek to absolve the South African state of its responsibility to respond. Moreover, it argues that although the state, the government, before, during, and after the transition to democracy, was aware of and acknowledged the threat - political, economic and social - posed by the epidemic, it nonetheless chose not to make the epidemic a priority policy issue. As a result, it argues that the South African HIV/AIDS case illustrates the tension inherent between a state’s ultimate sovereign responsibility to respond and its tactical dependence on external contributors to meet the demands of all of its constituents.

A Wall Street Journal and USA Today Bestseller

China’s Belt and Road initiative is on the way. Premier Xi’s agenda? For China to have unrestricted access to the rest of the world. At the focus is America’s last fortress, Puerto Rico, which sits primely at the southern entrance of the Caribbean from the Atlantic Ocean. The only way that China can exercise influence in Puerto Ricoーand move freely around the globeーis if Puerto Rico becomes an independent nation.
Puerto Rico’s political process is in shambles and the island is now slipping toward independence. Author Alexander Odishelidze spent 30 years on decolonization with a preference for statehood. This is his firsthand account of the mistakes made during that process, and of the vested interestsーboth on the mainland US and in Puerto Ricoーthat fought to maintain the status quo. In the 1970s, independence drew less than 5 percent of the vote in Puerto Rico’s elections. During the last election, independence-leaning candidates received almost 50 percent of the vote.

The trend is away from statehood. Tax Sovereignty and the Law in the Digital and Global Economy【電子書籍】[ Francesco Farri ]
|

This book discusses which is the most appropriate tax dimension to best manage the new horizons of the global and digital economy.

In this perspective, the efficiency of the main models is examined and two fundamental proposals are put forth: the first one aims at a coordination of the Destination-Based approach with the role of some specific digital assets, such as user data; the second one is a framework for a possible futuristic tax phenomenon all internal to the world of the internet and not linked to traditional territorial States. The compliance of these models with the constitutional principles that western democratic systems have affirmed over time in matters of taxation is then analyzed with particular regard to legal certainty, consent to taxation and to the re-distributive function of taxes. A specific evaluation of the role of the European Union is carried out and the jurisprudence on financial interests of the Union and on State aids is analyzed and tackled in light of the Treaty on the Functioning of the European Union and of the tax sovereignty of member States. The conclusion is that the model of the organization with a general political purpose, from which modern States take their inspiration, appears unfailing for a tax project that would focus on the good and the growth of the person and of the social aggregations in which everyone lives. A model that therefore deserves to be safeguarded, although with new methods and instruments, starting from a Destination-Based Asset-Coordinated approach, in the Third Millennium.

The book will be of interest to researchers and academics in international tax law, constitutional law and in political science.

Foucault, Freedom and Sovereignty【電子書籍】[ Sergei Prozorov ]

|

Against the prevailing interpretations which disqualify a Foucauldian approach from the discourse of freedom, this study offers a novel concept of political freedom and posits freedom as the primary axiological motif of Foucault's writing. Based on a new interpretation of the relation of Foucault's approach to the problematic of sovereignty, Sergei Prozorov both reconstructs ontology of freedom in Foucault's textual corpus and outlines the modalities of its practice in the contemporary terrain of global governance. The book critically engages with the acclaimed post-Foucauldian theories of Giorgio Agamben and Antonio Negri, thereby restoring the controversial notion of the sovereign subject to the critical discourse on global politics. Silent Complicity: State Sovereignty, Global Inaction, and the Rwandan Genocide【電子書籍】[ Kayumba David ]

|

The Rwandan genocide of 1994 remains an indelible scar on the conscience of the global community. As a human rights advocate and scholar deeply invested in the intersections of state power and human dignity, I felt compelled to revisit this pivotal moment in history, not just as an academic inquiry but as a call to action for humanity. This book is an evolution of my Master's dissertation, State Sovereignty Versus Individual Rights in the Case of the Rwanda Genocide, 1994, presented at Nkumba University in 2006 under the guidance of Dr. Michael Mawa. In it, I initially explored the complex dynamic between the sanctity of state sovereignty and the moral imperative to protect human life. Over the years, as I continued my work in social justice, theology, and diplomacy, the lessons from Rwanda became a driving force behind my advocacy for human rights and my belief in the necessity of international intervention when governments fail to protect their citizens. This book is not just a historical account; it is a declaration that the right to life should supersede the principle of state sovereignty when these values clash. I have included a chapter honoring the RPF for its extraordinary efforts in rebuilding Rwanda after the genocide. It is a testament to the power of leadership rooted in reconciliation, justice, and progress. The incredible transformation of Rwanda, from near-total collapse to a beacon of hope and economic progress, showcases not only the resilience of the Rwandan people but also what is possible when a nation is guided by visionary governance. I hope that this work will serve as both a reminder and a rallying cry: that "Never Again" is not just a phrase but a responsibility that must be upheld by all nations, especially when the sanctity of human life is at risk.

Net Zero and Natural Resources Law Sovereignty, Security, and Solidarity in the Clean Energy Transition【電子書籍】[ Damilola S. Olawuyi ]
|

States, corporations, and other actors worldwide have committed to measures aimed at bringing down global emissions to net zero by the year 2060 or earlier. While the need for a clean energy transition is clear, incoherently designed transition programs can pose complex environmental, social, and governance risks, including legal liability and protracted disputes. At the same time, the rush for minerals needed to manufacture clean energy technologies raises fundamental questions?most crucially, how to ensure the exploration and development of energy transition minerals in a manner that does not exacerbate resource conflicts, resource nationalism, human rights violations, protectionism, energy insecurity, social exclusions, and inequity, especially in conflict-affected and high-risk regions. By studying the legal and regulatory systems of Africa, Asia, Europe, Australasia, and North and South America through the themes of sovereignty, security and solidarity, Net Zero and Natural Resources Law provides an in-depth discussion of tools and techniques for addressing the legal and contract risks relating to the clean energy transition. This book offers a comprehensive and authoritative account of the nature, scope, and guiding principles of natural resources law and policy in a net zero era. Consideration is given to the integrated resource governance roadmap that is needed to improve coherence and coordination in the design, financing, and implementation of energy transition programs across the entire natural resource value chain.

Sovereignty and the Denial of International Equality Writing Civilisational Difference in Early Modern International Relations【電子書籍】[ Xavier Mathieu ]
|

This book asks whether sovereignty can guarantee international equality by exploring the discourses of sovereignty and their reliance on the notions of civilisation and savagery in two historical colonial encounters: the French explorations of Canada in the 16th century and the domestic troubles linked to the Wars of Religion.

Presenting the concept of ‘civilised sovereignty’, Mathieu reveals the interplay between the domestic and external claims to sovereignty, and offers a dynamic analysis of the theory and practice of the concept. Based on extensive archival research, this book provides an in-depth intellectual picture of the theory and practice of sovereignty in early modern France by focusing on the discourses deployed by French political theorists. Mathieu applies performativity in order to denaturalise these discourses of statehood and reveals how the domestic and international constructions of sovereignty feed into one another and equally rely on appeals to civilisation and savagery. Overall, the book questions the ‘myth of sovereignty as equality’ and reflects on the persistence of this association despite the overwhelming empirical evidence that it institutes international hierarchies and inequalities.

Representing a major intervention in the existing IR debates about sovereignty, this book will be a valuable resource for researchers working on issues of sovereignty and equality in IR.

American Indian Sovereignty The Struggle for Religious, Cultural and Tribal Independence【電子書籍】[ J. Mark Hazlett, II ]

Since the arrival of European settlers, Native American cultural sovereignty has been under attack. Self-determination is a tribal right of Native people, but colonial oppression banned their traditions and religion, purloined and misused sacred sites, and betrayed treaties when convenient. Over time, the settlers usurped Native American culture and lands, and these destructive behaviors continue today. Within the decimated Native American culture left after forced assimilation, American Indians still struggle to retain their rights. In this historical account of the despotism against Native American culture, the altercations of sovereignty, territory, and pluralistic democracy are analyzed in an effort to provide a path towards justice.

In this new study the authors examine a range of theories about the state of nature in seventeenth- and eighteenth-century England, considering the contribution they made to the period's discourse on sovereignty and their impact on literary activity. Texts examined include Leviathan, Oceana, Paradise Lost, Discourses Concerning Government, Two Treatises on Government, Don Sebastian, Oronooko, The New Atalantis, Robinson Crusoe, Dissertation upon Parties, David Simple, and Tom Jones. The state of nature is identified as an important organizing principle for narratives in the century running from the Civil War through to the second Jacobite Rebellion, and as a way of situating the author within either a reactionary or a radical political tradition. The Discourse of Sovereignty provides an exciting new perspective on the intellectual history of this fascinating period.

Galvanizing Nostalgia? Indigeneity and Sovereignty in Siberia【電子書籍】[ Marjorie Mandelstam Balzer ]

Galvanizing Nostalgia? explores critical questions for the survival of Russia in its nominally federal form. Will Russia fall apart along the lines of its internal republics, as did the Soviet Union? Based on cultural anthropology field and historical research in major republics of Eastern SiberiaーSakha (Yakutia), Buryatia, and Tyva (Tuva)ーthis book highlights Indigenous concerns about self-determination.

Marjorie Mandelstam Balzer suggests that a fragile and disorganized dynamic of nested sovereignties has developed within Russia. Ecology activism has grown, given new threats to the environment and accelerating climate challenges, especially in the Arctic. Focus on strategically chosen republics enables comparing and contrasting interethnic relations, language politics, and the salience of gender, demography, resource competition, environmental degradation, and increased spirituality. Republics vary in their neocolonial relationships to Moscow authorities. Some local leaders, such as a politicized shaman, use nostalgia for cultural achievements to galvanize citizens. Since the Soviet Union collapsed, cultural and political revitalization have been relatively more viable, although still difficult, in areas where Siberians have their own republics.

Pluriversal sovereignty and the state Imperial encounters in Sri Lanka【電子書籍】[ Ajay Parasram ]

This book documents the political and cosmological processes through which the idea of ‘total territorial rule’ came into being in the context of early- to mid-nineteenth-century Ceylon (Sri Lanka). Analysing ideas at the core of the modern international system, Pluriversal sovereignty and the state develops a decolonial theoretical framework informed by a ‘pluriverse’ of multiple ontologies of sovereignty to argue that the territorial state itself is an outcome of imperial globalisation.
Anti-colonialism up to the middle of the nineteenth century was grounded in genealogies and practices of sovereignty that developed in many localities. By the second half of the century, however, the global state system and the states within it were forming through colonising and anti-colonising vectors. By focusing on the ontological conflicts that shaped the state and empire, we can rethink the birth of the British Raj and locate it in Ceylon some 50 years earlier than in India. In this way, the book makes a theoretical contribution to postcolonial and decolonial studies in globalisation and international relations by considering the ontological significance of ‘total territorial rule’ as it emerged historically in Ceylon.

Through emphasising one important manifestation of modernity and coloniality ー the territorial state ー the book contributes to studies in the politics of ontological pluralism in sovereignty, postcolonial and decolonial international studies, and globalisation through colonial encounters.

Sovereignty Unhinged An Illustrated Primer for the Study of Present Intensities, Disavowals, and Temporal Derangements【

|

Sovereignty Unhinged theorizes sovereignty beyond the typical understandings of action, control, and the nation-state. Rather than engaging with the geopolitical realities of the present, the contributors consider sovereignty from the perspective of how it is lived and enacted in everyday practice and how it reflects people’s aspirations for new futures. In a series of ethnographic case studies ranging from the Americas to the Middle East to South Asia, they examine the means of avoiding the political and historical capture that make one complicit with sovereign authority rather than creating the conditions of possibility to confront it. The contributors attend to the affective dimensions of these practices of world-building to illuminate the epistemological, ontological, and transnational entanglements that produce a sense of what is possible. They also trace how sovereignty is activated and deactivated over the course of a lifetime within the struggle of the everyday. In so doing, they outline how individuals create and enact forms of sovereignty that allow them to endure fast and slow forms of violence while embracing endless opportunities for building new worlds.

Contributors. The King and the People Sovereignty and Popular Politics in Mughal Delhi【電子書籍】[ Abhishek Kaicker ]

|

An original exploration of the relationship between the Mughal emperor and his subjects in the space of the Mughal empire's capital, The King and the People overturns an axiomatic assumption in the history of premodern South Asia: that the urban masses were merely passive objects of rule and remained unable to express collective political aspirations until the coming of colonialism. Set in the Mughal capital of Shahjahanabad (Delhi) from its founding to Nadir Shah's devastating invasion of 1739, this book instead shows how the trends and events in the second half of the seventeenth century inadvertently set the stage for the emergence of the people as actors in a regime which saw them only as the ruled. Drawing on a wealth of sources from the seventeenth and eighteenth centuries, this book is the first comprehensive account of the dynamic relationship between ruling authority and its urban subjects in an era that until recently was seen as one of only decline. By placing ordinary people at the centre of its narrative, this wide-ranging work offers fresh perspectives on imperial sovereignty, on the rise of an urban culture of political satire, and on the place of the practices of faith in the work of everyday politics. It unveils a formerly invisible urban panorama of soldiers and poets, merchants and shoemakers, who lived and died in the shadow of the Red Fort during an era of both dizzying turmoil and heady possibilities. As much an account of politics and ideas as a history of the city and its people, this lively and lucid book will be equally of value for specialists, students, and lay readers interested in the lives and ambitions of the mass of ordinary inhabitants of India's historic capital three hundred years ago.
