Kings as Judges Power, Justice, and the Origins of Parliaments【電子書籍】[ Deborah Boucoyannis ]

How did representative institutions become the central organs of governance in Western Europe? What enabled this distinctive form of political organization and collective action that has proved so durable and influential? The answer has typically been sought either in the realm of ideas, in the Western tradition of individual rights, or in material change, especially the complex interaction of war, taxes, and economic growth. Common to these strands is the belief that representation resulted from weak ruling powers needing to concede rights to powerful social groups. Boucoyannis argues instead that representative institutions were a product of state strength, specifically the capacity to deliver justice across social groups. Enduring and inclusive representative parliaments formed when rulers could exercise power over the most powerful actors in the land and compel them to serve and, especially, to tax them. The language of rights deemed distinctive to the West emerged in response to more effectively imposed collective obligations, especially on those with most power.

Gender and Judicial Education Raising Gender Awareness of Judges【

Judicial Education has greatly expanded in common law countries in the past 25 years. More recently it has become a core component in judicial reform programs in developing countries with gender attentiveness as an element required by donor agencies. In civil law jurisdictions judges´ schools have long played a role in the formation of the career judiciary with a focus on entry to the judicial profession, in some countries judges get an intensive in-service education at judicial academies. Gender questions, however, tend to be neglected in the curricula.

These judicial education activities have generated a significant body of material and experience which it is timely to review and disseminate. Questions such as the following require answers. What is the current state of affairs? How is judicial education implemented in developed and developing countries all around the world? Who are the educators? Who is being educated? How is judicial education on gender regarded by judges? How effective are these programs?

The chapters in this book deal with these questions. They provide a multiplicity of perspectives. Six countries are represented, of these four are civil law countries (Germany, Argentina, Japan, Bosnia and Herzegovina) and two are common law countries (Canada; Uganda). This book was previously published as a special issue of International Journal of the Legal Profession.

The Life of Israel During the Period of the Judges【電子書籍】[ Francis Webster ]

This study explores the period of the Judges, an era in ancient Israelite history marked by cyclical patterns of apostasy, oppression, deliverance, and relapse, as recorded in the biblical text of Judges. The narratives highlight the moral, social, and spiritual decline of the Israelite tribes following the conquest of Canaan and their failure to uphold the covenant established with Yahweh. Central to this work is an in-depth analysis of the historical context, theological themes, and literary structure of the text, examining the figures of the judgesーcharismatic but often flawed leaders raised up by God to deliver the Israelites from their oppressors.

Key figures such as Deborah, Gideon, Jephthah, and Samson are studied alongside the tragic accounts of Jephthah's daughter, the Levite's concubine, and the civil war against Benjamin, illustrating the complexities of leadership, faith, and justice. This study emphasizes how the narratives of Judges serve as a theological indictment of moral relativism and a critique of Israel's failure to live under divine kingship. The refrain "In those days there was no king in Israel; everyone did what was right in his own eyes" underscores both the need for righteous leadership and the consequences of spiritual rebellion.

Additionally, this analysis situates the Judges period as a prelude to the establishment of the monarchy, highlighting how the absence of centralized leadership led to disunity and calls for a human king. Historical and archaeological insights provide context for understanding Israel's interactions with neighboring cultures and the pervasive influence of Canaanite religion. The study also addresses modern theological and ethical questions, such as the role of justice, the dangers of moral relativism, and the pursuit of covenantal renewal.

Ultimately, the Book of Judges is presented as a narrative that foreshadows the need for a righteous and eternal deliverer. This study concludes by situating the hope for perfect kingship within the Messianic promise fulfilled in Jesus Christ, whose reign brings justice, peace, and spiritual restoration. The lessons of Judges remain relevant, reminding faith communities of the importance of obedience, unity, and trust in God's sovereignty amid chaos and uncertainty.

Courts that Matter Activists, Judges, and the Politics of Rights Enforcement【電子書籍】[ Sandra Botero ]

In Courts that Matter, Sandra Botero tackles a crucial question: Can courts advance socioeconomic rights? Using a rigorous comparative study of the impact of socioeconomic rights rulings in Colombia and Argentina, Botero argues that such decisions can be significantly impactful when courts deploy certain monitoring mechanisms and when legally empowered organizations in civil society are engaged in the outcome. The book includes case studies of landmark rulings on environmental, health, housing, and other socioeconomic rights and charts pathways for broader applicability through comparison with rulings by the Indian Supreme Court. The book demonstrates how Colombian and Argentine highest tribunals have, at times, successfully configured important new political spaces for the effective pursuit of public policy goals, in conjunction and dialogue with other social and political actors. Are Judges Political? An Empirical Analysis of the Federal Judiciary【電子書籍】[ Cass R. Sunstein ]

Over the past two decades, the United States has seen an intense debate about the composition of the federal judiciary. Are judges ""activists""? Should they stop ""legislating from the bench""? Are they abusing their authority? Or are they protecting fundamental rights, in a way that is indispensable in a free society? Are Judges Political? cuts through the noise by looking at what judges actually do. Drawing on a unique data set consisting of thousands of judicial votes, Cass Sunstein and his colleagues analyze the influence of ideology on judicial voting, principally in the courts of appeal. They focus on two questions: Do judges appointed by Republican Presidents vote differently from Democratic appointees in ideologically contested cases? And do judges vote differently depending on the ideological leanings of the other judges hearing the same case? After examining votes on a broad range of issues--including abortion, affirmative action, and capital punishment--the authors do more than just confirm that Democratic and Republican appointees often vote in different ways. They inject precision into an all-too-often impressionistic debate by quantifying this effect and analyzing the conditions under which it holds. This approach sometimes generates surprising results: under certain conditions, for example, Democrat-appointed judges turn out to have more conservative voting patterns than Republican appointees. As a general rule, ideology should not and does not affect legal judgments. Frequently, the law is clear and judges simply implement it, whatever their political commitments. But what happens when the law is unclear? Are Judges Political? addresses this vital question.

All Judges Are PoliticalーExcept When They Are Not Acceptable Hypocrisies and the Rule of Law【電子書籍】[ Keith Bybee ]

We live in an age where one person's judicial "activist" legislating from the bench is another's impartial arbiter fairly interpreting the law. After the Supreme Court ended the 2000 Presidential election with its decision in Bush v. Gore, many critics claimed that the justices had simply voted their political preferences. But Justice Clarence Thomas, among many others, disagreed and insisted that the Court had acted according to legal principle, stating: "I plead with you, that, whatever you do, don't try to apply the rules of the political world to this institution; they do not apply."

The legitimacy of our courts rests on their capacity to give broadly acceptable answers to controversial questions. Yet Americans are divided in their beliefs about whether our courts operate on unbiased legal principle or political interest. Comparing law to the practice of common courtesy, Keith Bybee explains how our courts not only survive under these suspicions of hypocrisy, but actually depend on them.

Law, like courtesy, furnishes a means of getting along. It frames disputes in collectively acceptable ways, and it is a habitual practice, drummed into the minds of citizens by popular culture and formal institutions. The rule of law, thus, is neither particularly fair nor free of paradoxical tensions, but it endures. Although pervasive public skepticism raises fears of judicial crisis and institutional collapse, such skepticism is also an expression of how our legal system ordinarily functions.

Universals of Legal Reasoning by Judges A Plea for Candour in Decision-Making【電子書籍】[ Thomas Lundmark ]

Universals in Legal Reasoning by Judges explores and expounds the usage of rules to justify judicial decisions. Inspired by Savigny's canons of interpretation, and informed by the author's years of study and teaching in Germany, the book constructs a matrix for all legal argumentation in place of the so-called rules of interpretation, classifying justificatory arguments into four categories: textual, historical, purposive, and system-contextual. Along these categories, the book reveals certain universals while dispelling the confusion and mystery surrounding reasoning from judicial case decisions. This it does ー simply and elegantly ー by equating reasoning from case decisions with reasoning from statute. A myriad of examples, primarily from Germany, California, and the United Kingdom, show how these arguments find universal application. From start to finish, this book is itself an argument: an argument for judicial transparency and candour, which requires that judges reveal their thoughts and motivations-their ultimate reasons. This is necessary to enhance the persuasiveness and efficacy of judicial precedents, to foster democratic legitimacy, and to permit political accountability.

The Judges A Penetrating Exploration of American Courts and of the New DecisionsーHard DecisionsーThey Must Make for a New Millennium【電子書籍】[ Martin Mayer ]

Our courts, the third branch of the government, are central in the administration of our democracy. But their operations are shrouded in a mythology with its ritual incantations of "rule of law," "equal justice" and "presumption of innocence"--one that this book pierces.
We have 30,000 judges. Many are hard-working and distinguished jurists; most are simply lawyers who knew a politician. It does not help that the job pays poorly. We have no judicial profession: we do not train judges before or after they mount the bench.
There is no national court system. Fifty sovereign states, a federal government, counties and municipalities and state and federal agencies all have their own courts, their own rules and not infrequently their own laws and are deluged with cases filed by a million lawyers. Today, less than 3% of criminal charges and 4% of civil disputes are resolved by court trials.
The noted author argues that a specialized world demands specialized courts and judges expert in the subjects they must consider. Following the leadership of Chief Judge Judith Kaye of New York's highest court, the Conference of Chief Justices from all fifty states has endorsed her use of "problem-solving courts" to take the judiciary into the twenty-first century.
The Judges is Martin Mayer's most important book from many successful titles dating from the 1950s. It opens up a debate that will occupy scholars, justices, many of the one million lawyers in our country, and law school professors and students for years to come.

An Exposition of Judges【電子書籍】[ Tim James ]

In 1978, Tim James sold his butcher shop in Ogburn Station, NC and moved with his wife, Debbie, to Cherokee, North Carolina. A small group on the reservation had invited him to pastor their church. Over 42 years later, Tim continues to pastor at Sequoyah Sovereign Grace Baptist Church. For all of those years, Tim has preached expositorily through books of the Bible, having preserved his notes in large three-ring binders. Although visitors to his home have seen them, none had read them. In 2018, a pastor friend asked Tim if he could use his notes for reference in his expositions through a book of the Bible at his church. Astounded at the narrative style in which he had written them along with their simplicity, he could not keep them secret. As a result, Tim has graciously given permission for his entire library of notes to be scanned and published. You need not expect his expositions to be a lesson in history from the Old Testament, nor a list of goals for posting to your refrigerator from the New Testament. No matter the book or text reference on which you read Tim’s expositions, Old Testament or New Testament, you will rejoice as you read of the glorious faithfulness and work of the Lord Jesus Christ for God’s elect. In simple but profound everyday language you will be comforted in reading of Christ’s fulfillment of God’s law on behalf of the elect. Whether you read his expositions of the Old Testament or New Testament, you will see the revelation of Christ, the justification of his elect through his imputed righteousness and the glorious liberty and freedom he has obtained for them. In speaking of the true Christian experience of grace from his own experience of gospel freedom in Christ, Tim’s writings may well cause you to pump your fist and declare, “That is me!” God’s revelation of his electing grace in Christ has enabled Tim to write a commentary that captures the spirit and meaning of the Old Testament and New Testament alikeーChrist is all!

Taking Back the Constitution Activist Judges and the Next Age of American Law【電子書籍】[ Mark Tushnet ]

How the Supreme Court's move to the right has distorted both logic and the Constitution
What Supreme Court justices do is far more than just "calling balls and strikes." The Court has never simply evaluated laws and arguments in light of permanent and immutable constitutional meanings. Social, moral, and yes, political ideas have always played into the justices' impressions of how they think a case should be decided. Mark Tushnet traces the ways constitutional thought has evolved, from the liberalism of the New Deal and the Great Society to the Reagan conservatism that has been dominant since the 1980s. Looking at the current crossroads in the constitutional order, Tushnet explores the possibilities of either a Trumpian entrenchment of the most extreme ideas of the Reagan philosophy, or a dramatic and destabilizing move to the left. Wary of either outcome, he offers a passionate and informed argument for replacing judicial supremacy with popular constitutionalismーa move that would restore to the other branches of government a role in deciding constitutional questions.

Tough Cases Judges Tell the Stories of Some of the Hardest Decisions They've Ever Made【電子書籍】

" Tough Cases stands out as a genuine revelation. . . . Our most distinguished judges should follow the lead of this groundbreaking volume."
ーJustin Driver, The Washington Post
A rare and illuminating view of how judges decide dramatic legal casesー Law and Order from behind the benchーincluding the Eli?n Gonz?lez, Terri Schiavo, and Scooter Libby cases

Prosecutors and defense attorneys have it easyーall they have to do is to present the evidence and make arguments. It's the judges who have the heavy lift: they are the ones who have to make the ultimate decisions, many of which have profound consequences on the lives of the people standing in front of them.

In Tough Cases, judges from different kinds of courts in different parts of the country write about the case that proved most difficult for them to decide. Some of these cases received international attention: the Eli?n Gonz?lez case in which Judge Jennifer Bailey had to decide whether to return a seven-year-old boy to his father in Cuba after his mother drowned trying to bring the child to the United States, or the Terri Schiavo case in which Judge George Greer had to decide whether to withdraw life support from a woman in a vegetative state over the wishes of her parents, or the Scooter Libby case about appropriate consequences for revealing the name of a CIA agent. Others are less well-known but equally fascinating: a judge on a Native American court trying to balance U.S. law with tribal law, a young Korean American former defense attorney struggling to adapt to her new responsibilities on the other side of the bench, and the difficult decisions faced by a judge tasked with assessing the mental health of a woman who has killed her own children.

Relatively few judges have publicly shared the thought processes behind their decision making. Tough Cases makes for fascinating reading for everyone from armchair attorneys and fans of Law and Order to those actively involved in the legal profession who want insight into the people judging their work.

Their moving stories will be all too recognizable by women who may currently be experiencing similar challenges and biases in their own career.

Her Honor also demonstrates how the best of our judges share a passion for ensuring an accessible and fair system of justice, without a political agenda. They reveal a deep compassion for humanity along with an abiding respect for the law, respecting precedent but acting with courage if the law offers a way forward.

All the judges in this book have lived lives of deep influence. The stories shared will extend that influence further and inspire future generations to persevere in their careers during even the most difficult times.

PRAISE FOR HER HONOR

“This is one of the most inspirational books I have ever read. The essays, by and about twenty-five inspirational women judges, are beautifully written and compelling accounts of lives filled with amazing accomplishments. They are stories of women who overcame great obstaclesーsexism and racism and antisemitism and homophobia and poverty and so much elseーto rise to the top of the legal profession and make a huge difference. I want all law students and lawyers to read it, and for that matter, all high school and college students who might be thinking of a career in the law.”
-Erwin Chemerinsky, Dean and Jesse H. Choper Distinguished Professor of Law, University of California, Berkeley School of Law

“I wish I had a book like thisーfull of the wisdom and testimony, trials, and triumphs of brilliant and accomplished women juristsーwhen I was a young law student who still didn’t fully understand the barriers I’d face as a young, Black woman in the legal profession and beyond. Their stories of grace and tenacity in the face of obstacles are beyond inspiring. And their focus on mentorship is so important. Their lived stories shake the ground and pave the way for all of us.”
-Kimberly Atkins Stohr, Senior Opinion Writer and Columnist, The Boston Globe; inaugural columnist, The Emancipator

“When women commit, we are all better for it. And the commitment of women in the legal arena, especially on the bench, is essential. This book shares the challenging, compelling and very human stories of some of the country’s most respected female judges and leaves us not just with a sense of the importance of their work but also of the importance of ensuring another generation of women follows in their footsteps. I loved learning more about these women and could have kept on reading more!”
-Joyce White Vance, Distinguished Professor of the Practice of Law, University of Alabama School of Law and legal analyst for NBC and MSNBC

“Her Honor is a breathtaking collection of the stories of pioneering women judges who made the nation’s courts look more like the nation they serve. Their stories are at once humbling for the obstacles they fought and inspiring for their determination and dedication to the rule of law.”
-Prof. Steve Wermiel, American University Washington College of Law, co-author, Justice Brennan: Liberal Champion

“As someone who’s often critical about the progress of women in the legal profession, I found this book to be a much needed antidote to my cynicism. It’s an illuminating, honest look at how female judges overcame substantial obstacles with grit and graceーand triumphed.”
-Vivia Chen, Opinion Columnist, “Unfiltered,” BLOOMBERG Law

“Her Honor is a magnificent anthology of the professional and personal reflections of some of the country’s leading women jurists. The chapters in this volume bring to life the challenges, the pain, the joys, and the resiliency of female judges representing three generations of judicial icons. These stories will surely inspire not only the next cohort of women lawyers and judges, but anyone interested in promoting gender equality in the American legal profession and the United States more broadly.”
-Ajay K. Mehrotra, Research Professor, American Bar Foundation; William G. and Virginia K. Karnes Research Professor, Northwestern University Pritzker School of Law

“This remarkable volume of 25 essays practically oozes with perseverance and prideーwith a dizzying array of our most accomplished women jurists recounting the stories of both familiar and less-well-known lawyers who were each, in their own rights, trailblazers. The stories are remarkable as much for what they have in common as for how they differ, and they provide page after page of inspiration not just to the next generation of aspiring trailblazers, but to those looking for reminders of how injustices in the legal systemーand in the legal practiceーare not necessarily a permanent feature. Indeed, the identities and resumes of the authors of these essays only proves the point.”
-Stephen Vladeck, Charles Alan Wright Chair in Federal Courts at the University of Texas School of Law; author, The Shadow Docket

Valiant Judges, Iniquitous Law Thirteen Stories of Heroes of the Law【電子書籍】[ Hans Petter Graver ]

This book is about heroes of law. It provides examples of when judges have exercised courage, moderation, wisdom, and justice rather than blindly following the law. It also discusses the contentious issue of whether a judge has a moral responsibility to defend the rule of law, regardless of what the law actually states. The work presents a collection of thirteen stories about judges who in different settings have stood up against the authorities and public opinion in the defence of the rule of law. An introductory chapter sets the scene with two examples of situations gone wrong when those applying the law have just followed the demands of those in power. The thirteen stories are followed by two theoretical chapters discussing the moral responsibility of the judge. Finally, the book explores the kind of ethical theory required to guide judges in the assessments they must make, and the choices they have to take in order to fulfil their moral responsibilities. It is argued that the classic virtues of courage, moderation, wisdom, and justice are all qualities that can contribute to both sound judgment and reflection. The book thus seeks to nurture a realistic culture and a tradition of cultivating lawyers who defend the rule of law. Against a background where the history of our legal institutions when put to the test, is largely nothing to be proud of, the work seeks to change this by highlighting and reflecting on the exceptions. The book will be illuminating reading for students and academics working in the areas of Jurisprudence, Legal Ethics, and Legal History.

United States District Courts and Judges of Arkansas, 1836?1960【

The essays in United States District Courts and Judges of Arkansas, 1836?1960ーone each for a judge and his decisionsーcome together to form a chronological history of the Arkansas judicial system as it grew from its beginnings in a frontier state to a modern institution.

The book begins with statehood and continues with Congress’s decision to expand jurisdiction of the original 1836 District Court of Arkansas to include the vast Indian Territory to the west. The territory’s formidable size and rampant lawlessness brought in an overwhelming number of cases. The situation was only somewhat mitigated in 1851, when Congress split the state into eastern and western districts, which were still served by just one judge who travelled between the two courts.

A new judgeship for the Western District was created in 1871, and new seats for that court were established, but it wasn’t until 1896 that Congress finally ended all jurisdiction of Arkansas’s Western District Court over the Indian Territory.

Contributors to this collection include judges, practicing attorneys, academics, and thoughtful and informed family members who reveal how the judges made decisions on issues involving election laws, taxes, civil rights, railroads, liquor and prohibition, quack medicine, gangsters, bankruptcy, personal injury, the draft and Selective Service, school desegregation, prisons, and more. United States District Courts and Judges of Arkansas, 1836?1960 will be of value to anyone interested in Arkansas historyーparticularly Arkansas legal and judicial history as it relates to the local and national issues that came before these judges.

This project was supported in part by the United States District Court for the Eastern District of Arkansas and the United States District Court for the Western District of Arkansas.

The Book of Judges【電子書籍】[ Barry G. Webb ]

Eminently readable, exegetically thorough, and written in an emotionally warm style that flows from his keen sensitivity to the text, Barry Webb’s commentary on Judges is just what is needed to properly engage a dynamic, narrative work like the book of Judges. It discusses not only unique features of the stories themselves but also such issues as the violent nature of Judges, how women are portrayed in it, and how it relates to the Christian gospel of the New Testament.

Webb concentrates throughout on what the biblical text itself throws into prominence, giving space to background issues only when they cast significant light on the foreground. For those who want more, the footnotes and bibliography provide helpful guidance. The end result is a welcome resource for interpreting one of the most challenging books in the Old Testament.

Dissenting Voices in American Society The Role of Judges, Lawyers, and Citizens【

Dissenting Voices in American Society: The Role of Judges, Lawyers, and Citizens explores the status of dissent in the work and lives of judges, lawyers, and citizens, and in our institutions and culture. It brings together under the lens of critical examination dissenting voices that are usually treated separately: the protester, the academic critic, the intellectual, and the dissenting judge. It examines the forms of dissent that institutions make possible and those that are discouraged or domesticated. This book also describes the kinds of stories that dissenting voices try to tell and the narrative tropes on which those stories depend. This book is the product of an integrated series of symposia at the University of Alabama School of Law. These symposia bring leading scholars into colloquy with faculty at the law school on subjects at the cutting edge of interdisciplinary inquiry in law.
