<p>This book is the first to analyse the practice of governance to resolve conflict in the case of Aceh in Indonesia. Combining theoretical discourse on conflict, democracy, and governance, it draws from original field research on the separatist conflict, utilizing a social constructivist approach in collating observations and interviews with political elites from both the Government of Indonesia and the Aceh Independent Movement (GAM). The conflict was an intractable one in which thousand civilians were killed between 1976 and 2006. <p>Perempuan millenium Indonesia masih berjuang menegakkan kesamaan haknya yang terinspirasi oleh “gerutuan” Raden Ayu Kartini. Namun, 7 abad lalu perempuan Aceh telah menikmati hak-haknya sebagai manusia yang setara tanpa perdebatan. Barangkali selama ini yang kita kenal pahlawan perempuan dari Aceh mugkin hanya Cut Nyak Dien saja. Hal ini dapat dipahami karena perjuangan heroiknya melawan Belanda sudah difilmkan, dimana pemeran sebagai Cut Nyak Dhien adalah artis legendaris Christine Hakim.</p> <p>Akan tetapi sebenarnya Cut Nyak Dhien hanyalah satu dari sekian banyak perempuan Aceh yang memiliki kehebatan yang luar biasa di Aceh. Dan itu sudah ada jauh sebelum isu emansipasi dikembangkan. Sebab peran mereka melebihi peran para laki-laki pada saat itu.<br /> Di Matangkuli, Kecamatan Minye Tujoh, Kabupaten Aceh Utara, terdapat sebuah makam kuno yang pada nisannya bertuliskan Arab dan Jawa Kuno. Dituliskan di nisan itu, orang yang dimakamkan adalah Ratu Ilah Nur yang meninggal tahun 1365. Siapa Ilah Nur? Ratu Ilah Nur adalah seorang Ratu yang memerintah Kerajaan Pasai. Keterangan itu juga dapat diperoleh di kitab Negara Kartagama tulisan Prapanca. Disebutkan, Samudera Pasai merupakan daerah yang ditaklukkan oleh Hayam Wuruk, dengan Patihnya Gajah Mada. Buku Hikayat Raja Raja Pasai juga menyebutkan tentang kekuasaan Majapahit terhadap Pasai. Setelah segala sesuatunya diatur di Pasai, laskar Majapahit kembali ke Jawa. Namun, sebelum kembali, pembesar-pembesar Majapahit mengangkat seorang Raja, yaitu Ratu Nur Ilah. Ratu Nur Ilah merupakan keturunan Sultan Malikuzzahir. Tidak banyak keterangan yang didapatkan oleh peneliti tentang masa pemerintahan Ratu Ilah Nur ini.</p> <p>Perempuan Aceh memang luar biasa. Mereka mampu mensejajarkan diri dengan kaum pria. Bahkan, pekerjaan peperangan pun, yang biasanya seluruhnya dilakukan oleh kaum pria, diterjuninya pula. Mereka menjadi panglima, memimpin ribuan laskar di hutan dan di gunung-gunung. Bahkan ada laskar wanita yang disebut Inong Bale. Mereka ini para janda syuhada yang menuntut kematian suaminya. Para perempuan Aceh berani meminta cerai dari suaminya bila suaminya berpaling muka kepada Belanda. Kaum pria Aceh pun bersikap sportif. Mereka dengan lapang hati memberikan sebuah jabatan tertinggi dan rela pula menjadi anak buahnya. Diantaranya mereka yang amat dikenal bahkan melegenda, seperti Cut Nyak Dhien, Laksamana Kumalahayati, dan sebagainya.</p> <p>Beberapa periode, Kerajaan Aceh Besar yang berdaulat, pernah dipimpin oleh perempuan. Selain Ratu Nur diatas, ada Sultanah Safiatuddin Syah, Ratu Inayat Zakiatuddin Syah, Sultanah Nurul Alam Naqiatuddin Syah dan Ratu Nahrasiyah. Sementara yang terjun ke medan pertempuran, ada Laksamana Malahayati, Cut Nyak Dien, Cut Meutia, Pocut Baren dan Pocut Meurah Intan. Ada pula yang menjadi uleebalang (penguasa lokal). Diantara panglima-panglima tersebut, yang banyak disebut-sebut oleh pendatang Barat adalah Laksamana Malahayati. It does this through a critical examination of the workings of the state shari'a system as it was designed and implemented at the turn of the twenty-first century in Aceh, Indonesia. While the empirical details of these discussions are unique, this particular case presents a remarkable site for investigating the broader issue of the impact of instrumentalist, future-oriented visions of Islamic law on modern Muslim calls for the state implementation of Islamic law. In post-tsunami/post-conflict Aceh, the idea of shari'a as an exercise in social engineering was amplified through resonance with an increasingly pervasive rhetoric of 'total reconstruction'. Based upon extensive fieldwork as well as critical readings of a wide range of archival materials, official documents, and local publications this work focuses on the institutions and actors involved with this contemporary project for the state implementation of Islamic law. The individual chapters are structured to deal with the major components of this system to critically examine how these institutions have taken shape and how they work. It also shows how the overall system was informed not only by aspects of late twentieth-century da'wa discourses of Islamic reform, but also modern trends in sociological jurisprudence and the impact of global models of disaster relief, reconstruction, and development. All of these streams of influence have contributed significantly to shaping the ways in which the architects and agents of the state shari'a system have attempted to use Islamic legislation and legal institutions as tools to steer society in particular desired directions.
