<p>Now that the most recent scientific estimates have shown that China has become the world's largest source of greenhouse gas emissions, China's influence on the world's environment and sustainable development highlights the importance of tailoring Chinese climate change law to conform with the requirements of international conventions and agreements on climate change. This thorough analysis, based on an examination of climate status, legal background, and current regulatory systems in China, examines the potential role of different policy instruments in reducing carbon emissions in order to find an appropriate choice for China, and recommends approaches to key issues for relevant authorities.The author conducts a comprehensive and in-depth study on the three mainstream environmental policy instruments used to control carbon emissions - the cap-and-trade system, the carbon tax, and command-and- control regulations - in a Chinese context. She reviews China's current policies, and elucidates how the issues of climate change and global warming call for social, environmental, economic, and legal reforms in China, especially in the areas of administrative law and property rights law. Among the issues and topics covered are the following:- key issues on designing and implementing each of the three policy instruments;- the choice of regulatory instruments for carbon emissions reduction in a socialist market economy based on the discussion of market failure and government failure theories;- legal challenges from China's current administrative legislation and the definition of carbon emissions entitlements;- practical effect of China's climate change policy at the national, provincial, and local levels;- effectiveness of China's implementation of its international obligations;- lessons learned from schemes implemented in the United States and Australia;- comparison of China's seven regional pilot emissions trading scheme (ETS) programmes with the well-established EU ETS;- linkage between China's ETS and other ETSs from a global perspective; and- future direction of an emerging carbon market in China.The analysis assesses the critical costs and benefits of each approach in the context of selected case studies, taking legal literature in the field fully into account.Given that the Chinese government is taking steps to reduce emissions by altering energy production and usage and is signalling a willingness to make similar commitments in a multilateral treaty, it is very timely and important for lawmakers and scholars, within and outside China, to think about new and appropriate regulatory measures to respond to the crisis and plan for a sustainable future. <p>Prior to 1979, China had a bifurcated and geographically-dispersed industrial structure made up of a relatively small number of large-scale, state-owned enterprises in various industries alongside numerous small-scale, energy-intensive and polluting enterprises. Economic reforms beginning in 1979 led to the rapid expansion of these small-scale manufacturing enterprises in numerous energy-intensive industries such as aluminum, cement, iron and steel, and pulp and paper. Subsequently, the government adopted a new industrial development strategy labeled "grasp the large, let go the small." The aims of this new policy were to close many of the unprofitable, small-scale manufacturing plants in these (and other) industries, create a small number of large enterprises that could compete with OECD multinationals, entice these larger enterprises to engage in high-speed technological catch-up, and save energy. <em>China's Technological Catch-Up Strategy</em> traces the impact of this new industrial development strategy on technological catch-up, energy use, and CO2 emissions. In doing so, the authors explore several detailed, enterprise-level case studies of technological catch-up; develop industry-wide estimates of energy and CO2 savings from specific catch-up interventions; and present detailed econometric work on the determinants of energy intensity. The authors conclude that China's strategy has contributred to substantial energy and CO2 savings, but it has not led to either a peaking of or a decline in CO2 emissions in these industries. <p>This study analyses the climate risk exposure of Kenyan banks given the greenhouse gas (GHG) emissions represented by their sectoral loan composition and their relative funding of climate risk through their loan portfolios. This is achieved by constructing two climate-relevant indices: Emissions Exposure (EEi), a measure of a bank’s climate risk exposure through its loan portfolio, and Emissions Funding (EFi), a measure of how much of the climate risk a bank funds through its lending relative to other banks and thus a measure of climate risk importance for each bank. Results from the emissions index show that the banks, with the exception of an outlier, have fairly similar exposure to climate risk through their loan portfolio, given the GHG emissions represented by their sectoral lending. On the funding index, banks have differentiated funding of climate risk through their lending that is fairly proportional to their market shares of gross loans. Thus, larger (smaller) banks have higher (lower) funding of climate-related risk. These two complementary indices provide a first set of quantitative climate-related financial disclosures that are comparable across Kenyan banks. Secondly, the results of this analysis provide decision-useful information for the Central Bank of Kenya (CBK) and other financial regulators to formulate macroeconomic and financial policies that would seek to promote low-carbon transition via the banking industry as a key financial sub-sector. Lastly, the analysis provides a template for industry-wide assessment of climate-related risk for banks in other emerging economies and the approach used for mapping national GHG emissions to bank lending sectors is also a key contribution to the literature on quantifying climate risks for the financial sector. This scheme covers industrial plants that can now trade allowances of carbon dioxide (CO2). This new carbon market is the largest of its sort, growing quickly and behaving very similarly to the stock markets. Because of being so new, there is still a considerable amount of uncertainty about its future development, but some first lessons are discussed in the report. Crucial is the allocation of allowances with all its exceptions that can lead to false incentives to actually increase emissions. Allowances now represent a cost that can either lead to competitive disadvantage or present an opportunity to increase margins if allocated for free. Investment decisions are being affected because environmental concerns are translated into a cost that can be evaluated against the costs of other alternatives. Consequences of the US being the worlds largest emitter not ratifying the Kyoto Protocol is addressed. Pitfalls of the system are identified and recommendations given. Wirtschaftliches Handeln orientiert sich an kurzfristigen Kenngr??en wie Umsatzwachstum oder Renditeerwartungen. Langfristige gesamtgesellschaftliche Effekte werden nicht betrachtet, weil sie f?r den wirtschaftlichen Fortbestand der Luftverkehrsgesellschaften nur von geringer Relevanz sind. Es bedarf marktwirtschaftlicher Internalisierungsverfahren, damit sie im Rahmen einzelwirtschaftlicher Entscheidungsprozesse der Marktteilnehmer ber?cksichtigt werden k?nnen. Dies k?nnten fungible und handelbare Emissionszertifikate sein, oder staatlich verordnete Abgaben. Emissionen im Luftverkehr sind, gemessen an anderen Sektoren, relativ gering. Aufgrund der Zuwachsraten sind technische Ma?nahmen zur Emissionsreduktion notwendig. Das technische Mitigationspotential ist gering. Da sich der Luftverkehr bisher so dynamisch entwickelt hat, kann angenommen werden, dass ohne ordnungsrechtliche und ?konomische Instrumente eine ?berh?hte Nutzung des Luftverkehrs eintreten wird. Die ?berh?hung bezieht sich hierbei auf die Fehlbewertung bzw. die fehlende Internalisierung von externen Kosten des Luftverkehrs. Die EU hat dazu bereits eine Richtlinie verabschiedet, die die Ausgestaltung des Systems endg?ltig regelt. Allerdings haben im Vorfeld diverse Richtlinienvorschl?ge zu kontroversen Diskussionen gef?hrt. Besonders der Entwurf vom 23.10.2001 stand im Kreuzfeuer der Kritik. On 4 August he met with General H. Norman Schwarzkopf, Central Command (CENTCOM) Commander, and Lieutenant General Charles A. Horner, Central Air Command (CENTAF) Commander to discuss the situation. The generals explained to the president the only Air Force assets in the area were two KC-135s operating in the United Arab Emirates since 24 July and fourteen F-111Es and four F-16s in Turkey. No one knew if Turkey would allow air attacks on Iraq from Turkish soil. There were no other American forces in the area and the nearest two aircraft carriers were days away. There was little the United States could do, unless Saudi Arabia or another nation in the area allowed America to base troops there. The president dispatched Secretary of Defense Richard B. Cheney, Schwarzkopf, and Horner to Saudi Arabia to talk with King Fahd. Armed with satellite photos showing the Iraqi deployment along the Saudi border, the three persuaded King Fahd of the imminent danger to his country. On 6 August the king asked the United States to send forces to Saudi Arabia to help defend his nation from possible attack.</p> <p>By 6 August the 9th Strategic Reconnaissance Wing at Beale AFB, California had already been alerted for possible deployment to the Middle East. Colonel Randall A. Juracek, Deputy Commander Maintenance (DCM), and his staff started gathering the necessary assets. Unfortunately, world events had overtaken Air Force reconnaissance plans, which had been directed toward a major war in Europe against the Soviet Union.
