The Politics of Federalization in Myanmar【電子書籍】[ Dulyapak Preecharush ]

This book examines the trajectory of federalization in Myanmar's political development, evaluating the attitudes of different political actors toward, and negotiation strategies for, designing federalism.

It argues that three factors drive federalization in Myanmar, namely constitutionalization, conflict management, and democratization. The confluence of these forces arrived at a critical juncture in 2011, the start of Myanmar's political transition, leading to significant changes in Myanmar's federation process. By analyzing the changes and continuities in federalism building, the book charts the dynamic pathway toward Myanmar's current federalization, revealing how periods of progress and stagnation reflect varying world views and the individual strategies of prominent political actors.

Offering a systematic conceptual framework on federalism in Myanmar, this will be a useful resource for students and scholars of Political Science, Comparative Politics, and Southeast Asian Politics.

Federalism as a Tool of Conflict Resolution【

Looking at the growing use of federalism and decentralization as tools of conflict resolution, this book provides evidence from several case studies on the opportunities and challenges that territorial solutions offer when addressing internal conflicts within a variety of countries.

Federalism has been used as a tool of conflict resolution in a number of conflict situations around the world. The results of this have been mixed at best, with some countries moving slowly to the paths of peace and recovery, while others have returned to violence. This volume looks at a number of case studies in which federalism and decentralization have been promoted in order to bring opposing groups together and protect the territorial integrity of different countries. Yet, it is demonstrated that this has been incredibly difficult, and often overshadowed by wider concerns on secession, de and re-centralization and geopolitics and geoeconomics. While federalism and decentralization might hold the key to keeping war-torn countries together and bringing hostile groups to the negotiation table, we nevertheless need to rethink under which conditions territorial autonomy can help to transform conflict and when it might contribute to an increase in conflict and violence. Federalism alone, so the key message from all contributions, cannot be enough to bring peace ? yet, without territorial solutions to ongoing violence, it is also unlikely that peace will be achieved.

The chapters in this book were originally published as a special issue of Ethnopolitics.

Defensive Federalism Protecting Territorial Minorities from the "Tyranny of the Majority"【

Defensive Federalism presents an original contribution to the field of federalism and multinational democracies, exploring the concept of defensive federalism as a protection of self- government against the "tyranny of the majority".

The empirical evidence on federal and regional polities often shows critical imbalances in the territorial division of powers beyond what has been formally established in the constitutional rules. This volume highlights the rights, institutions, decision- making processes and procedural rules that can protect and develop the practical political, economic and cultural powers of federated and regional entities, especially those linked to territorial national minorities. The authors focus on federalism as a safeguard of self- rule, as well as a set of institutional and procedural rules to avoid the territorial dimension of the "tyranny of the majority". They answer two fundamental questions: how is it possible to design new stable and fairer federal agreements between national minorities and majorities where there is no single ideal solution? Is there a need for a new kind of "defensive federal model" for approaching national pluralism in liberal democracies?

This book will be of great interest to students and scholars of federalism, national diversity and democracy, as well as policymakers and practitioners in both public and private institutions.

Chapter 8 of this book is freely available as a downloadable Open Access PDF under a Creative Commons Attribution 4.0 license available at www.taylorfrancis.com

Coalition Politics and Federalism【

This book analyzes the verticalization of coalition cabinets from the national to the sub-national level. Presenting case studies for countries with federal systems of government, such as Argentina, Australia, Brazil, Canada, Germany, and India, as well as those focusing on states with hybrid systems of government, such as Italy, the contributors analyze multilevel government formation processes to identify vertical congruence between national and sub-national coalitions. The book also examines various factors affecting the degree of congruence of political coalitions, such as the degree of decentralization, federalization and institutionalization of political systems, as well as cleavage structure. Contemporary Russian Federalism Delimitation of Jurisdictional Subjects and Powers【電子書籍】[ Gulnara R. Shaikhutdinova ]

The focus of this book is the legal analysis of the evolution of federal relationships from an asymmetric treaty-constitutional federation to a de facto unitary state. Questioned is whether it is worth returning to the asymmetric federative form, while the aim is to review the origins of federalism in the New Russia, assess the present de jure and de facto situations and analyze whether Russia has a chance of reviving federalism.

Steps forward on the way to developed federal relationships in the 1990s have been replaced by steps backwards owing to unitary tendencies in the 2000s and the 2010s. But is this a sustainable state of affairs? The possible ways of framing relations between the center and the constituent units for the next four years and beyond are also discussed.

This book is aimed at researchers and students in the field of comparative constitutional law, Russian studies and federal and regional studies.

Gulnara R. Federalism and the Courts in Africa Design and Impact in Comparative Perspective【

This volume examines the design and impact of courts in African federal systems from a comparative perspective.

Recent developments indicate that the previously stymied idea of federalism is now being revived in the constitutional arrangements of several African countries. A number of them jumped on the bandwagon of federalism in the early 1990s because it came to be seen as a means to facilitate development, to counter the concentration of power in a single governmental actor and to manage communal tensions. An important part of the move towards federalism is the establishment of courts that are empowered to umpire intergovernmental disputes. This edited volume brings together contributions that first discuss questions of design by focusing, in particular, on the organization of the judiciary and the appointment of judges in African federal systems. They then examine whether courts have had a rather centralizing or decentralizing impact on the operation of African federal systems.

The book will be of interest to researchers and policy-makers in the areas of comparative constitutional law and comparative politics.

The Federalist Papers by Publius Unabridged 1787 Original Version【電子書籍】[ Publius ]

The Federalist Papers are a series of 85 articles advocating the ratification of the United States Constitution. Seventy-seven of the essays were published serially in The Independent Journal and The New York Packet between October 1787 and August 1788. A compilation of these and eight others, called The Federalist, was published in 1788 by J. and A. McLean. The Federalist Papers serve as a primary source for interpretation of the Constitution, as they outline the philosophy and motivation of the proposed system of government. The authors of the Federalist Papers wanted to both influence the vote in favor of ratification and shape future interpretations of the Constitution. According to historian Richard B. Morris, they are an "incomparable exposition of the Constitution, a classic in political science unsurpassed in both breadth and depth by the product of any later American writer."

Federalism: A Very Short Introduction【電子書籍】[ Mark J. Rozell ]

Early Americans were suspicious of centralized authority and executive power. Casting away the yoke of England and its king, the founding fathers shared in this distrust as they set out to pen the Constitution. Weighing a need for consolidated leadership with a demand for states' rights, they established a large federal republic with limited dominion over the states, leaving most of the governing responsibility with the former colonies. With this dual system of federalism, the national government held the powers of war, taxation, and commerce, and the ability to pass the laws necessary to uphold these functions. Although the federal role has grown substantially since then, states and local governments continue to perform most of the duties in civil and criminal law, business and professional licensing, the management of infrastructure and public services: roads, schools, libraries, sanitation, land use and development, and etc. Despite the critical roles of state and local governments, there is little awareness-or understanding-of the nature and operations of the federal system. This Very Short Introduction provides a concise overview of federalism, from its origins and evolution to the key events and constitutional decisions that have defined its framework. Although the primary focus is on the United States, other federal systems, including Brazil, Canada, India, Germany, Russia, South Africa, Switzerland, and the EU, are addressed.

Federalismo na Constitui??o de 1891 Revolta de Princesa, Guerra Tribut?ria, Reforma Administrativa e Rea??o Olig?rquica【電子書籍】[ Bruno Miguel Drude ]

A presente obra analisa a Constitui??o de 1891, sob a perspectiva do modelo federalista adotado, enfocando o subsistema tribut?rio e o eleitoral.

American Federalism Today Perspectives on Political and Economic Governance【

What are federalism's challenges and opportunities today?

The framers of the US Constitution enumerated specific powers for the federal government, leaving all else under the purview of states or the people. Over time, the federal government has expanded its role, yet the American people have more trust in state and local governments that are closer to themーand where co-partisanship is often a matter of necessity. Scholars and practitioners in policymaking gathered at the Hoover Institution in September 2023 to discuss the ramifications of federalism for contemporary issues. American Federalism Today presents those conference proceedings.

Renowned experts from a range of disciplines, including economics, political science, history, and law, lay out the key priorities in evaluating and reinvigorating America's federal system of governance. Among the topics they examine are infrastructure, education and healthcare financing, trust in government, and intergovernmental relations in an era of rising federal debt and unfunded state and local liabilities. Three influential governorsーMitch Daniels, Jeb Bush, and Jerry Brownーdescribe navigating the federalist system as they led their states through many challenges. This unique compilation draws on the remarkable expertise and experience of its contributors to probe federalism's strengths, weaknesses, opportunities, and challenges in the nation's political and economic governance.

Renowned experts from a range of disciplines, including economics, political science, history, and law, lay out the key priorities in evaluating and reinvigorating America's federal system of governance. Progressive States' Rights The Forgotten History of Federalism【電子書籍】[ Sean Beienburg ]

Today, when politicians, pundits, and scholars speak of states’ rights, they are usually referring to Southern efforts to curtail the advance of civil rights policies or to conservative opposition to the federal government under the New Deal, Great Society, and Warren Court. Sean Beienburg shows that this was not always the case, and that there was once a time when federalismーthe form of government that divides powers between the state and federal governmentsーwas associated with progressive, rather than conservative, politics.

In Progressive States’ Rights, Sean Beienburg tells an alternative story of federalism by exploring states’ efforts in the years before the New Deal of shaping constitutional discourse to ensure that a protective welfare and regulatory governmental regime would be built in the states rather than the national government. These state-level actors not only aggressively participated in constitutional politics and interpretation but also specifically sought to create an alternative model of state-building that would pair a robust state power on behalf of the public good with a traditionally limited national government.

Current politics generally collapse policy and constitutional views (where a progressive view on one policy also assumes a progressive view on the other), but Beienburg shows that this was not always true, and indeed many of those most devoted to progressive policy views were deeply committed to a conservative constitutionalism.

Federalism in Myanmar【電子書籍】[ Pau Sian Lian ]

The central purpose of this book is to examine answers to questions regarding the kind of political system that Myanmar urgently needs to develop. Myanmar has suffered the endless civil war for decades since regaining its sovereignty in 1948. Therefore, the lead research question is: What kind of federal democratic model is the most suitable for Myanmar and what kind of political arrangements should be in place?

To examine answers for this question, the author employed a descriptive?qualitative approach and triangulation research method including interviews with politicians and activists in Myanmar, field observation and analysis of historical documents. The author examines the contemporary political issues of Myanmar in term of federalism to ensure that analysis of this book does not omit the actual political process performed by the government. As a result of the study, Myanmar needs a tailored federal model which is the best to accommodate the ethnically divided country that would enhance solutions to ethnic conflicts and end the civil war.
