<p>The scope of vicarious liability has significantly expanded since its original conception. Today employers are being found liable for actions of employees that they did not authorise, and never would have authorised if asked. They are being held liable for an employee's criminal activity. In the related strict liability field of non-delegable duties, they are being held liable for wrongdoing of independent contractors.</p> <p>Notions of strict liability have grown increasingly isolated in the law of tort, given the exponential growth in the tort of negligence. They require intellectual justification. Such a justification has proven to be elusive and largely unsatisfactory in relation to vicarious liability and to concepts of non-delegable duty. The law of three jurisdictions studied has now apparently embraced the 'enterprise risk' theory to rationalise the imposition of vicarious liability. This book subjects this theory to strong critique by arguing that it has many weaknesses, which the courts should acknowledge. <p>Security Sector Reform (SSR) remains a key feature of peacebuilding interventions and is usually undertaken by a state alongside national and international partners. External actors engaged in SSR tend to follow a normative agenda that often has little regard for the context in post-conflict societies. Despite recurrent criticism, SSR practices of international organisations and bilateral donors often remain focused on state institutions, and often do not sufficiently attend to alternative providers of security or existing normative frameworks of security.</p> <p>This edited collection explores three aspects that add an important piece to the puzzle of what constitutes effective Security Sector Reform (SSR). First, the variation of norm adoption, norm contestation and norm imposition in post-conflict countries that might explain the mixed results in terms of peacebuilding. Second, the multitude of different security actors within and beyond the state which often leads to multiple patterns of co-operation and contestation within reform programmes. He was named a cardinal by Pope John Paul II in recognition of his profound contributions to the Second Vatican Council.</em></p> <p><em>Paul Philibert, OP, has taught pastoral theology in the United States and abroad. <p>"Address to the Christian Nobility of the German Nation" is the first of the three tracts written by Martin Luther in 1520. In this work, he defined for the first time the signature doctrines of the priesthood of all believers and the two kingdoms. After the church made a strong attempt at drawing distinct lines on saying who had authority in the spiritual sphere and its matters. This division of Christians into spheres motivated Luther to write on the "three walls" the "Romanists" created to protect themselves from reform. "Prelude on the Babylonian Captivity of the Church" is a theological treatise, the second of the three major tracts from 1520. In this work Luther examines the seven sacraments of the Catholic Church in the light of his interpretation of the Bible. With regard to the Eucharist, he advocates restoring the cup to the laity, dismisses the Catholic doctrine of Transubstantiation but affirms the real presence of the body and blood of Christ in the Eucharist, and rejects the teaching that the Mass is a sacrifice offered to God. "A Treatise on Christian Liberty" is the third of Luther's major reforming treatises of 1520. It developed the concept that as fully forgiven children of God, Christians are no longer compelled to keep God's law; however, they freely and willingly serve God and their neighbors. Luther also further develops the concept of justification by faith. In the treatise, Luther stated, "A Christian is a perfectly free lord of all, subject to none. <p>With the launch of the World Trade Organization (WTO) in 1995, its Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) emerged as a symbol of coercion in international economic relations. In the decade that followed, intellectual property became one of the most contentious topics of global policy debate. This book is the first full-length study of the politics surrounding what developing countries did to implement TRIPS and why. Based on a review of the evidence from 1995 to 2007, this book emphasises that developing countries exhibited considerable variation in their approach to TRIPS implementation. In particular, developing countries took varying degrees of advantage of the legal safeguards and options-commonly known as TRIPS 'flexibilities'-that the Agreement provides. To explain this variation, this book argues that TRIPS implementation must be understood as a complex political game played out among developing country governments and a range of stakeholders-developed countries, non-governmental organisations (NGOs), intergovernmental organisations (IGOs), and industry groups. The contested nature of the TRIPS bargain spurred competing efforts to revise the terms of TRIPS and to influence global IP regulation more broadly. The intensity of the implementation game was amplified by an awareness among the various stakeholders that the IP reforms developing countries pursued would influence these ongoing international negotiations. The book attributes the variation in TRIPS implementation to the interplay between these global IP debates, international power pressures, and political dynamics within developing countries.
