The State Immunity Controversy in International Law Private Suits Against Sovereign States in Domestic Courts【電子書籍】[ Ernest K. In part one, the author shows through a careful analysis of the law that restrictive immunity does not have ＜em＞vox populi＜/em＞ in developing countries and that it lacks ＜em＞usus.＜/em＞ He also argues that forum law, i.e., the ＜em＞lex fori＜/em＞ is a creature of sovereignty and between equals before the law, only what is understood and acknowledged as law among states must be applied in as much as the international legal system is horizontal.＜/p＞ ＜p＞Furthermore, the state never acts as a juridical or natural person and, therefore, in logical terms, its functions cannot be divided into ＜em＞potere politico＜/em＞ and ＜em＞persona civile＜/em＞ as a prelude to determine jurisdiction. The said Italian doctrine, therefore, is ＜em＞ex-facie erroneous＜/em＞,and that a simple dichotomy between absolute immunity and restrictive immunity wholly predicated on the nature test alone would not be helpful in promoting justice. Hence the contextual approach, arbitration and comparative dominant theory are suggested as essential tools to supplement the UN Treaty on state immunity when it comes into force because some states are likely to stay out of the said treaty regime.＜/p＞ ＜p＞In part two, of the book, the author provides a comprehensive analysis of international criminal justice i.e., the prosecution of heads of state before international tribunals and the means or tools available to defend these leaders. To that end, it is apposite that a distinction between immunity ＜em＞ratione personae＜/em＞ and immunity ＜em＞ratione materiae＜/em＞ be made clear, whereby emphasis must be placed on their differences and legal consequences in regard to the verticality of international tribunals and foreign criminal jurisdiction of statese.g., the ICC and SCLC.＜/p＞ ＜p＞The author further argues forcefully that the law has not changed and that despite the reforming zealof some important states to change the law, in reality however, the law remainsalmost intact wholly structured on the presumption of immunity subject to certain limited acknowledged exceptions duly supported by ＜em＞opinio juris,＜/em＞ thus eclipsing the suggestion by some scholars, senior courts and international tribunals that the law be instead based on an acknowledged exception to a presumed jurisdiction. L’?chec momentan? subi par le r?gime issu du coup d’?tat lui inspira le d?sir de prouver ≪ que la R?volution est immanente et permanente dans l’humanit? ≫, et il publia cette premi?re ≪ ?tude analogique sur la transformation et la r?volution ≫, fragment d’une ?tude plus large sur l’analogie de l’homme et de la soci?t?. Une suite, De l’Harmonie dans l’homme et dans la soci?t?, est annonc?e dans les Jours d’Exil, II (d?cembre 1855), comme devant para?tre ; mais je n’en ai trouv? nulle trace. L’?laboration m?thodique de sa th?se ー qui n’est pas originale, comme il le reconna?t lui-m?me en discutant les pr?curseurs, mais qui est pour lui le fruit de ses observations comme m?decin ー est interrompue par un grand chapitre intitul? :La R?volution d?mocratique et sociale (chapitre V), dans lequel ー ainsi que dans la Barri?re du Combat (Juin 1852) et dans l’?pilogue du livre (L’Exil) ー ?clate au grand jour le fond de sa pens?e. Dans ces pages il ?crit franchement : ≪ Je suis anarchiste ≫ ; et il comprend l’id?e de l’anarchie dans toute sa largeur, impliquant la diversit?, le libre cours donn? ? toutes les ?volutions possibles. Il voit que la bourgeoisie ne fera plus de r?volution ; ≪ car elle sait tr?s bien qu’il n’y a plus actuellement de r?volution possible sans une attaque directe et sans r?serve contre tous les privil?ges qui la font vivre ≫. Qui donc fera la R?volution ? Il a vu le prol?tariat de Paris massacr?, ?cras? en juin 1848, et il a perdu l’espoir qu’il puisse se relever de longtemps, si jamais. Il s’est creus? la t?te ? chercher une puissance assez forte pour ?branler la soci?t?, pour cr?er le chaos qu’il ?voque ; et il est arriv? ? la conclusion : ≪ la R?volution frayant sa voie au moyen du despotisme ≫, ≪ la R?volution par le mal ≫. Une id?e l’a frapp? d?s 1849 : ≪ Il n’y aura plus de R?volution tant que les Cosaques ne descendront pas ≫.＜/p＞ ＜p＞Cette id?e a ?t? ?videmment inspir?e ? C?urderoy par l’attitude de la presse r?actionnaire de Paris qui, ? cette ?poque de l’?crasement de la r?volution hongroise par la Russie, ne cessait de faire appel au tsar Nicolas, dans lequel elle voyait le sauveur de l’ordre. ? ces bruits d’invasion qui ?taient dans l’air, C?urderoy appliqua sa m?thode trompeuse de l’analogie, et, comparant la civilisation romaine de la d?cadence et celle de son temps, le christianisme et le socialisme, les barbares germains d’alors et les Slaves d’aujourd’hui, il conclut que, comme alors, de m?me de nos jours le progr?s de l’humanit? se ferait par une m?l?e g?n?rale comme celle qui mit fin ? l’Empire romain.＜/p＞ ＜p＞Voil? donc cette fameuse th?orie des Cosaques de C?urderoy, th?orie qui a tant contribu? ? le faire para?tre comme un simple excentrique qu’on ne saurait prendre au s?rieux : pr?texte sp?cieux pour ignorer sa formidable critique de la soci?t? actuelle, sa dissection des chefs de partis et de sectes, fussent-ils les socialistes les plus c?l?bres, son d?veloppement de l’id?e de l’anarchie bien au-del? de Proudhon, et toutes les beaut?s que rec?lent ses ?crits. Je suis loin de prendre parti pour cette th?orie : je ferai remarquer, seulement, qu’elle n’est pas tr?s diff?rente de la th?orie, assez fr?quemment soutenue, qui fait sortir le triomphe du socialisme du chaos produit par les d?sastres d’une guerre universelle. La Commune de Paris n’en fut-elle pas, dans une certaine mesure, une confirmation ?＜/p＞ ＜p＞C?urderoy fut induit en erreur par son amour des analogies. Il se laissa prendre ? l’exemple apparent de la destruction de l’Empire romain par les barbares, peuples jeunes, du m?lange de races qui s’en suivit, et de la victoire du christianisme, qui, avant la ruine de la soci?t? romaine par les barbares, aurait ?t? aussi impuissant en face du pouvoir romain que l’est le socialisme en face de la soci?t? bourgeoise. Il se trompait, en outre, en se figurant le peuple russe comme un peuple jeune par excellence. Il y a en Russie, c’est vrai, une petite ?lite r?volutionnaire, qui depuis un si?cle se sacrifie pour son peuple ; mais les paysans russes, eux, dans leur immense masse, sont vieux comme les Byzantins, qui se perp?tuent en eux par l’action de l’?tat et de l’?glise. I consider a number of common notions of world citizenship and then, supported by Nussbaum's theory of public rationality from the literary imagination, I illuminate how the cosmopolitan vision of Diogenes, kosmopolit?s (cosmopolitanism), may present the most promising construct of world citizenship to act as a counter hegemonic citizen-based force to neoliberal globalization. Additionally, a review of the world citizenship teaching model Learning for a Cause elucidates the potential for my vision of kosmopolit?s in practice.
