At this time in intellectual history, Heidegger was still somewhat unfamiliar to French readers, and <em>Being and Time</em> had only been partially translated into French. Here Derrida mostly uses his own translations, giving his own reading of Heidegger that directly challenges the French existential reception initiated earlier by Sartre. If Jacques Derrida begins with the term <em>pr?jug?s</em>, it is in part because of its impossibility to be rendered properly in other languages and also contain all its meanings: to <em>pre</em>-judge, to judge <em>before</em> judging, to hold prejudices, to know “how to judge,” and more still, to be already prejudged oneself.</p> <p>Striving to contain that which comes before the law, that is in front of the law and also prior to it, how to judge Jean-Fran?ois Lyotard then becomes perhaps a beneficial attempt for Derrida to explore humanity’s rapport with judgment, origins, and naming. Er spricht von einem gleichzeitigen Erscheinen und Nichterscheinen der Gabe. Als Voraussetzung sei hierf?r ein 'ungeschriebener Vertrag' zwischen miteinander kommunizierenden Menschen notwendig. Dies zeigt sich schon in den Ausdr?cken, die man einem Referenten gegen?ber ?u?ert: 'ihm Aufmerksamkeit schenken' oder 'Sinn geben'. Das hei?t also, dass zwischen diesen Parteien in gewisser Weise unbewusst ein Vertrag konstituiert sein muss, der dem Redner eine Vorgabe erm?glicht, die durch seine Rezipienten beantwortet wird (eben durch ihre Aufmerksamkeit etc.). Derrida selbst schreibt dem Gabenereignis eine tern?re Struktur zu: '≫irgend?einer?≪ (A) hat die Intention, B an C zu geben'. Durch diese formalistische Ausdrucksweise droht jedoch eine stetige Mutation der gegebenen Sache zu einem Tauschobjekt. Durch diesen formalistischen Ansatz entsteht eine Skepsis an derer M?glichkeit ?berhaupt einer 'Gabe'. Etwas soll also existieren, indem es seine Eigenexistenz selbst annulliert. Dieses offensichtliche Paradox wird dadurch erkl?rbar, dass die Gabe sich als unm?glich erweist, 'indem sie als Tausch konzipiert und praktiziert wird'. An dieser Stelle zeigt sich gleichzeitig der Vorwurf an Mauss, der den Widerspruch des Gabeereignisses zum Tauschakt nicht bedacht habe.
