Fair and Equitable Treatment and the Fabric of General Principles【電子書籍】[ Fulvio Maria Palombino ]

This book moves from the circumstance whereby currently the obligation to provide fair and equitable treatment (FET) to foreign investments is included in the majority of international investment agreements and has proved to be the most invoked standard in investor-State arbitration. Hence, it is no overstatement to describe this standard as the basic norm of international investment law. Yet both its meaning and normative basis continue to be shrouded in ambiguity and, as a consequence, to inspire a considerable number of interpretations by legal writers. The book's precise aim is to unravel such ambiguity, arguing from the idea that FET has become part of the fabric of general international law, but has done so by means of a source somewhat neglected in legal doctrine. This being the category of general principles peculiar to a certain field of international law, i.e. those principles having their own foundations in the international legal order itself, but which, through the mediation of the judge, end up being shaped according to the features typical of a specific normative field. The book, as well as having a solid theoretical backdrop as its basis, offers a careful and critical analysis of pertinent case law, and will prove useful to both scholars and practitioners.

Fulvio Maria Palombino is Professor of International Law at the Law Department of the University of Naples Federico II and a member of the Executive Board of the European Society of International Law.

Specific to this book:

? Explains the ICSID practice clearly and concisely

? Useful in practical terms

Excerpts from a review:

‘Fair and Equitable Treatment and the Fabric of General Principles’ is an original and well researched book, in which the author challenges a number of conventional wisdoms on FET.Among the strengths of the book one can mention the solid discussion of public international law principles relevant to FET and the interesting incursions into domestic law legal systems which play an important role in the understanding of FET components such as due process, legitimate expectations or proportionality.

In particular the section on promises provides a convincing analysis of the issues that arise when the administration makes an assurance or representation to an investor. Against the backdrop of the examination of unilateral acts under public international law, Palombino’s analysis sheds new light on what ought to be the proper scope of protection under the legitimate expectations doctrine in case of governmental promises, clarifying a number of points which have received insufficient attention by arbitral tribunals thus far.

- Michele Potest?, Attorney with L?vy Kaufmann-Kohler, Geneva; Senior Researcher, Geneva Center for International Dispute Settlement (CIDS) book review in International and Comparative Law Quarterly, (2018) 67(4), 1036-1037. Community Participation with Schools in Developing Countries Towards Equitable and Inclusive Basic Education for All【電子書籍】

The Sustainable Development Goals (SDGs) (2016-2030) set by the United Nations in 2015 restated the importance of universal primary education for all, and specifically discuss quality, equity, and inclusion in basic education. To achieve this, the role of community has been emphasized and participation has become a "buzzword" in international development over the past several decades. Despite the growing attention to community participation in school management, previous literature has shown mixed results in terms of its actual practice and its impacts on quality, equity, and inclusion in education.

This book deepens the contextual understanding of community in developing countries and its involvement in schools in general, and its impact on quality, equity, and inclusion of school education in particular. By presenting various case studies in Asia, Africa, Latin America, and a post-conflict state in Europe, the book analyses commonalities and differences in the ways communities are involved and cast their impacts and challenges. The book contributes knowledge on the ways in which community involvement could work in developing countries, the detailed processes and factors that make community participation work in different dimensions, and remaining challenges that scholars and practitioners still need to be concerned and mindful in the field.

This book will appeal to both researchers and practitioners who are concerned about the community participation approach for the SDGs.

Equitable Sharing Distributing the Benefits and Detriments of Democratic Society【電子書籍】[ Thomas Kleven ]

Equitable Sharing: Distributing the Benefits and Detriments of Democratic Society argues that a principle of equitable sharingーone that requires the benefits and detriments of social life to be fairly distributed among all members of societyーis fundamental to the concept of democracy and is implicit in the founding documents of the democratic society the United State purports to be. To illustrate the centrality of equitable sharing to democracy, this book examines the political philosophies of John Locke, John Stuart Mill, and John Rawls. Locke’s libertarianism, Mill’s utilitarianism, and Rawls’ egalitarianism represent major strains of Western democratic theory, and all contain a principle of equitable sharing in some form. To illustrate the centrality of equitable sharing to U.S. society, the book examines the Declaration of Independence and the Constitution. While these documents do not set forth a particular version of equitable sharing, they contain elements of all of Locke’s, Mill’s and Rawls’ philosophies and evidence a commitment to equitable sharing as fundamental to the democratic society they contemplate.

The task of U.S. society throughout its existence has been to engage in an on-going dialogue that gives life to the commitment to equitable sharing set forth in its founding documents. As the elected representatives of the people and the repository of the powers through which to implement much of what equitable sharing requires, the primary responsibility for implementation rests with the legislative branch. This book argues that the Supreme Court, interacting with the public and the legislature, also has a meaningful role to play in the dialogue over the requirements of equitable sharing and can play this role in a manner consistent with democratic principles. This point is illustrated through a discussion of several contemporary issues: same sex marriage, racial integration in public schools, health care, and the regulation of the electoral process.

Antiracist Journalism The Challenge of Creating Equitable Local News【電子書籍】[ Andrea Wenzel ]

Across the United States, newsrooms are grappling with systemic racism in their organizations and the media industry. Many have implemented diversity, equity, and inclusion (DEI) initiatives or made other attempts to confront past and present biases in pursuit of greater equity. Are such efforts merely performative, or are any transforming norms and power structures? What would it take to hold newsrooms truly accountable?

Andrea Wenzel provides a critical look at how local media organizations in the Philadelphia area are attempting to address structural racism. She focuses on two established, majority-white newsrooms, the Philadelphia Inquirer and the public radio station WHYY, and two start-ups where at least half the staff identify as Black, Indigenous, or people of color (BIPOC), Resolve Philly and Kensington Voice. Drawing on more than five years of field research, Wenzel charts how these outlets have pursued a range of interventionsーsuch as tracking the diversity of sources, examining reporting and editing practices, and working with community members to gain inputーto varying degrees of success. Wenzel argues that institutional and systemic transformation will be possible only through the establishment of structures that facilitate holding those with more power responsible for listening to and addressing the needs and concerns of those with less. Offering recommendations for building infrastructure that enables sustainable accountability, Antiracist Journalism is an important book for everyone interested in making local journalism more equitable.

The United Nations Declaration on the Rights of Indigenous Peoples is seen primarily as an international human rights instrument. However, the Declaration also encompasses cultural, social and economic rights. Taken in the context of international trade and investment, the UN Declaration is a valuable tool to support economic self-determination of Indigenous peoples. This volume explores the emergence of Indigenous peoples' participation in international trade and investment, as well as how it is shaping legal instruments in environment and trade, intellectual property and traditional knowledge. One theme that is explored is agency. From amicus interventions at the World Trade Organization to developing a future precedent for a 'Trade and Indigenous Peoples Chapter', Indigenous peoples are asserting their right to patriciate in decision-making. Government-Linked Companies and Sustainable, Equitable Development【電子書籍】

The debate over how far governments should intervene in economies in order to promote economic growth, a debate which from the 1980s seemed settled in favour of the neo-liberal, non-interventionist consensus, has taken on new vigour since the financial crisis of 2008 and after. Some countries, most of them in industrialised Asia, have survived the crisis, and secured equitable economic growth, by adopting a developmental state model, whereby governments have intervened in their economies, often through explicit support for individual companies. This book explores debates about government intervention, assesses interventionist policies, including industrial and innovation policies, and examines in particular the key institutions which play a crucial role in implementing government policies and in building the bridge between the state and the private sector. The countries covered include China, India, South Korea, Malaysia and Taiwan, together with representative countries from Europe and Latin America.

HOPE Teacher Rating Scale Involving Teachers in Equitable Identification of Gifted and Talented Students in K-12: Manual【電子書籍】[ Marcia Gentry ]

The HOPE Teacher Rating Scale is designed to help guide teachers in identifying gifted students for programming. It is unique in several ways. First, it is short, with only 11 items that measure academic and social/affective components of giftedness, making it easy to use. Second, it is invariant when used to identify students from low-income and culturally diverse families. Third, it can be used across grade levels, K-12. Finally, local norms ensure that the data are relevant to the specific school populations. With multiple measures and multiple pathways crucial for reversing the inequities in identifying culturally, economically, and linguistically diverse students, a teacher-nomination instrument like the HOPE Teacher Rating Scale is an important component of identification systems. The HOPE Teacher Rating Scale items have been well-developed and subjected to research using more than 12,000 diverse students in five validity studies to date. This manual is useful in understanding and interpreting the electronic scores generated from teachers' ratings of their students. This instrument is a must-have for any administrator or gifted-program coordinator involved in student identification.

To explore the full collection of HOPE print and online resources, please visit: www.routledge.com/go/hope-teacher-rating-scales.

Our Fair Share How One Small Change Can Create a More Equitable American Economy【電子書籍】[ Brian C. Johnson ]

America's economy does not currently live up to our country's core values.

We are a nation founded on the ideals of coming together across differences to forge a common future. Yet over the past fifty years, our economy has been pulling us apart at unprecedented rates. By allowing top income earners and the wealthiest Americans to hoard wealth like almost never before, we belie what makes our country great. This is a threat to our well-being, our democracy, and our values.

Brian C. Johnson combines accessible scholarship on wealth and income inequality in America with deeply personal accounts of six Americans of diverse backgrounds who are each wrestling with what it means to survive and thrive in this new economic world. In so doing, he offers a solution that is as visionary as it is practical. Dubbed the Citizen Dividend, this revolutionary model assumes that economic growth is built off of the wealth we have created together as a country, and together we all reap its benefits. In Our Fair Share, Johnson lays the groundwork for implementing this solution, detailing what the Citizen Dividend is, offering examples of similar existing models, outlining the benefits of such systems, tackling some of the common concerns that arise, and offering a path toward making it a reality.

Ultimately, Our Fair Share calls on each of us to claim what is uniquely American, building a common future that embraces and celebrates our differences. This is our revolutionary inheritance. May we all benefit from it.

Preparing Students to Engage in Equitable Community Partnerships A Handbook【電子書籍】[ Elizabeth A. Tryon ]

When done properly, community engagement in academia can have value for all stakeholders. Authentic experiences are more useful for students; faculty can add new knowledge to the field and their own toolbelts; and communities feel their investment has generated a useful deliverable or even a long-term partnership.

Preparing Students to Engage in Equitable Community Partnerships provides a wealth of valuable resources and activities to help impart ideas of identity, privilege, oppression, bias, and power dynamics to best support students and community in these relationships. Believing that authenticity only comes about in an atmosphere of mutual respect and self-awareness, the authors argue for cultural and intellectual humility.

Each chapter looks at topics and issues through different lenses, complete with underlying theories, and relates those discussions to concrete classroom activities, facilitation strategies, and scholarly frames. In addition, the authors include contributions from a diverse group of practitioners at community colleges, private colleges, historically Black colleges and universities, and minority-serving institutions.

Preparing Students to Engage in Equitable Community Partnerships is a much-needed, comprehensive resource for community-engaged professionals as they prepare students for building relationships when entering a community for learning or research purposes.
