COVID-19, Law & Regulation Rights, Freedoms, and Obligations in a Pandemic【電子書籍】[ Belinda Bennett ]

COVID-19 is the most severe pandemic the world has experienced in a century. This book analyses major legal and regulatory responses internationally to COVID-19, and the impact the pandemic has had on human rights and freedoms, governance, the obligations of states and individuals, as well the role of the World Health Organization and other international bodies during this time. The authors examine notable legal challenges to public health measures enforced during the pandemic, such as lockdown orders, curfews, and vaccine mandates. Importantly, the book contextualizes the legal analysis by examining the broader social and economic dimensions of risks posed by the pandemic. The book considers how COVID-19 impacted the operation of the criminal justice system, civil litigation concerning negligently caused deaths and business losses arising from contractual breaches, consumer protection litigation, disciplinary regulation of health practitioners, coronial inquests and other investigations of unexpected deaths, and occupational health and safety issues. The book reflects on the role of the law in facilitating the remarkable scientific and epidemiological achievements during the pandemic, but also the challenges of ensuring the swift production and equitable distribution of treatments and vaccines. It concludes by considering the possibilities that the legal and regulatory responses to this pandemic have illuminated for effectively tackling future global health crises.

Manufacturing Freedom Sex Work, Anti-Trafficking Rehab, and the Racial Wages of Rescue【電子書籍】[ Elena Shih ]

Sex worker rescue programs have become a core focus of the global movement to combat human trafficking. While these rehabilitation programs promise freedom from enslavement and redemptive wages for former sex workers, such organizations actually propagate a moral economy of low?wage women’s work that obfuscates relations of race, gender, national power, and inequality. Manufacturing Freedom is an ethnographic exploration of two American organizations that offer vocational training in jewelry production to women migrants in China and Thailand as a path out of sex work. In this innovative study, Elena Shih argues that anti?trafficking rescue and rehabilitation projects profit off persistent labor abuse of women workers and imagined but savvily marketed narratives of redemption.

Her client needs help to keep the plantation he inherited, which is steeped in the history of the Lowcountry of South Carolina, home of the Swamp Fox and four signers of the Declaration of Independence.

There are also some unsolved mysteries on the property.
Government regulations are increasingly holding back economic development, inflating the prices of most consumer goods, and reducing our freedoms.

Dale W. Cox, and his wife, LeAnne, know that firsthand as they have operated businesses of various types throughout the years.

What theyve found is rules and regulations that constantly change and get more complicated, which hurts their businesses, their family, and their customers. Freedoms, Faiths and Futures Teenage Australians on Religion, Sexuality and Diversity【電子書籍】[ Andrew Singleton ]

How do contemporary teenagers experience and understand religious, spiritual, gender and sexual diversity? How are their experiences mediated by where they go to school, their faith and their geographic location? Are their outlooks materialist, religious, spiritual, or do they have hybrid identities?

Freedoms, Faiths and Futures: Teenage Australians on Religion, Sexuality and Diversity offers powerful insight into how teenagers make sense of the world around them. Drawing on rich data from a major national study, this book creates new ways of understanding the complexity of young people's lives and how school education covering diversity best addresses their world.

This book argues that school education focused on worldviews is founded on ways of thinking about young people that do not reflect the complexities of Generation Z's everyday experiences of diversity and their interactions with each other. It argues that certain kinds of education in schools can play a significant role in developing religious literacy, tolerance and positive attitudes to diversity.

Gaining Freedoms Claiming Space in Istanbul and Berlin【電子書籍】[ Berna Turam ]

Gaining Freedoms reveals a new locus for global political change: everyday urban contestation. Cities are often assumed hotbeds of socio-economic division, but this assessment overlooks the importance of urban space and the everyday activities of urban life for empowerment, emancipation, and democratization. Through proximity, neighborhoods, streets, and squares can create unconventional power contestations over lifestyle and consumption. And through struggle, negotiation, and cooperation, competing claims across groups can become platforms to defend freedom and rights from government encroachments.

Drawing on more than seven years of fieldwork in three contested urban sitesーa downtown neighborhood and a university campus in Istanbul, and a Turkish neighborhood in BerlinーBerna Turam shows how democratic contestation echoes through urban space. Countering common assumptions that Turkey is strongly polarized between Islamists and secularists, she illustrates how contested urban space encourages creative politics, the kind of politics that advance rights, expression, and representation shared between pious and secular groups. Exceptional moments of protest, like the recent Gezi protests which bookend this study, offer clear external signs of upheaval and disruption, but it is the everyday contestation and interaction that forge alliances and inspire change. Ultimately, Turam argues that the process of democratization is not the reduction of conflict, but rather the capacity to form new alliances out of conflict.

Patchwork Freedoms Law, Slavery, and Race beyond Cuba's Plantations【電子書籍】[ Adriana Chira ]

In nineteenth-century Santiago de Cuba, the island of Cuba's radical cradle, Afro-descendant peasants forged freedom and devised their own formative path to emancipation. Drawing on understudied archives, this pathbreaking work unearths a new history of Black rural geography and popular legalism, and offers a new framework for thinking about nineteenth-century Black freedom. Santiago de Cuba's Afro-descendant peasantries did not rely on liberal-abolitionist ideologies as a primary reference point in their struggle for rights. Instead, they negotiated their freedom and land piecemeal, through colonial legal frameworks that allowed for local custom and manumission. While gradually wearing down the institution of slavery through litigation and self-purchase, they reimagined colonial racial systems before Cuba's intellectuals had their say. Long before residents of Cuba protested for national independence and island-wide emancipation in 1868, it was Santiago's Afro-descendant peasants who, gradually and invisibly, laid the groundwork for emancipation.

Freedoms Gained and Lost Reconstruction and Its Meanings 150 Years Later【電子書籍】[ Bruce E. Baker ]

Reconstruction is one of the most complex, overlooked, and misunderstood periods of American history. The thirteen essays in this volume address the multiple struggles to make good on President Abraham Lincoln’s promise of a “new birth of freedom” in the years following the Civil War, as well as the counter-efforts including historiographical onesーto undermine those struggles. The forms these struggles took varied enormously, extended geographically beyond the former Confederacy, influenced political and racial thought internationally, and remain open to contestation even today. The fight to establish and maintain meaningful freedoms for America’s Black population led to the apparently concrete and permanent legal form of the three key Reconstruction Amendments to the U.S. Constitution, as well as the revised state constitutions, but almost all of the latter were overturned by the end of the century, and even the former are not necessarily out of jeopardy. And it was not just the formerly enslaved who were gaining and losing freedoms. Struggles over freedom, citizenship, and rights can be seen in a variety of venues. At times, gaining one freedom might endanger another. How we remember Reconstruction and what we do with that memory continues to influence politics, especially the politics of race, in the contemporary United States. Offering analysis of educational and professional expansion, legal history, armed resistance, the fate of Black soldiers, international diplomacy post-1865 and much more, the essays collected here draw attention to some of the vital achievements of the Reconstruction period while reminding us that freedoms can be won, but they can also be lost.

I am in awe of the depth of Terrys knowledge of our Constitution and the freedoms it bestows. As a human being? Terry Bettis is hard to beat. He is revered by his friends and associates. We figured the move increased the median IQ of New Mexico and decreased that of Texas. Paul Freeman Marble Falls, Texas Terry is well qualified to write a book because of his fervor and passion for history the way it was written. He has demonstrated to me and others his great attention to detail in his research and fact finding in preparation for those books he has authored and co authored. He possesses the ability to build a story line and back it up with facts. His conclusions are based on historical facts. Mr Bettis is a true Patriot. His zeal and passions to preserve this great Republic through his teachings and lecture are well known in TEA party and conservative circles. Smoking, Drinking, and Drug Use in Young Adulthood The Impacts of New Freedoms and New Responsibilities【電子書籍】[ Jerald G. Bachman ]

Why do some young adults substantially change their patterns of smoking, drinking, or illicit drug use after graduating from high school? In this book, the authors show that leaving high school and leaving home create new freedoms that are linked to increases in the use of cigarettes, alcohol, marijuana, and cocaine. They also show that marriage, pregnancy, and parenthood create new responsibilities that are linked to decreases in drug use.

The research is based on more than 33,000 young people followed from high school through young adulthood by the nationwide Monitoring the Future project. Every two years, participants reported on their drug use, as well as their schooling, employment, military service, living arrangements, marriages, pregnancies, parenthood, and even their divorces.

The unique qualities of this research--large nationally representative samples, follow-ups extending up to 14 years beyond high school, and multiple approaches to analysis and data presentation--allowed the examination of several important influences simultaneously, while retaining much of the rich detail encountered in the real world. On the whole, the results are encouraging, suggesting that the potentials for change and improvement during the transition to adulthood are as important as the detrimental effects of problem behavior in adolescence. This research is a "must" read for anyone concerned with how new freedoms and responsibilities impact adolescents, young adults, and the use of licit and illicit drugs.

In Ugly Freedoms Elisabeth R. Anker reckons with the complex legacy of freedom offered by liberal American democracy, outlining how the emphasis of individual liberty has always been entangled with white supremacy, settler colonialism, climate destruction, economic exploitation, and patriarchy. These “ugly freedoms” legitimate the right to exploit and subjugate others. At the same time, Anker locates an unexpected second type of ugly freedom in practices and situations often dismissed as demeaning, offensive, gross, and ineffectual but that provide sources of emancipatory potential. She analyzes both types of ugly freedom at work in a number of texts and locations, from political theory, art, and film to food, toxic dumps, and multispecies interactions. Whether examining how Kara Walker’s sugar sculpture A Subtlety, Or the Marvelous Sugar Baby reveals the importance of sugar plantations to liberal thought or how the impoverished neighborhoods in The Wire blunt neoliberalism’s violence, Anker shifts our perspective of freedom by contesting its idealized expressions and expanding the visions for what freedom can look like, who can exercise it, and how to build a world free from domination.

The Fight for Free Speech Ten Cases That Define Our First Amendment Freedoms【電子書籍】[ Ian Rosenberg ]

A user’s guide to understanding contemporary free speech issues in the United States

Americans today are confronted by a barrage of questions relating to their free speech freedoms. What are libel laws, and do they need to be changed to stop the press from lying? Does Colin Kaepernick have the right to take a knee? Can Saturday Night Live be punished for parody? While citizens are grappling with these questions, they generally have nowhere to turn to learn about the extent of their First Amendment rights.

The Fight for Free Speech answers this call with an accessible, engaging user’s guide to free speech. Media lawyer Ian Rosenberg distills the spectrum of free speech law down to ten critical issues. Each chapter in this book focuses on a contemporary free speech questionーfrom student walkouts for gun safety to Samantha Bee’s expletives, from Nazis marching in Charlottesville to the muting of adult film star Stormy Danielsー and then identifies, unpacks, and explains the key Supreme Court case that provides the answers. Together these fascinating stories create a practical framework for understanding where our free speech protections originated and how they can develop in the future. As people on all sides of the political spectrum are demanding their right to speak and be heard, The Fight for Free Speech is a handbook for combating authoritarianism, protecting our democracy, and bringing an understanding of free speech law to all.

Beyond Collective Memory Structural Complicity and Future Freedoms in Senegalese and South African Narratives【電子書籍】[ Cullen Goldblatt ]

Beyond Collective Memory analyzes how two African places became icons of collective memory for certain publics, yet remain marginal to national and continental memory discourses. Thiaroye, a Senegalese location of colonial-era massacre, and District Six, a South African neighborhood destroyed under apartheid, have epitomized a shared "memory" of racist violence and resistant community. Analyzing diverse cultural texts surrounding both places, this book argues that the metaphor of collective memory has obscured the structural character of colonial and apartheid violence, and made it difficult to explore the complicit positions that structures of violence produce. In investigating the elisions of memory discourses, Beyond Collective Memory challenges the dominance of collective memory, and calls attention to the African pasts, metaphors, and imaginaries that exist beyond it.

Civil Peace and the Quest for Truth The First Amendment Freedoms in Political Philosophy and American Constitutionalism【電子書籍】[ Murray Dry ]

The freedoms of speech and religion assumed a sacrosanct space in American notions of civil liberty. But it was not until the twentieth century that these freedoms became prominent in American constitutional law; originally, the first ten amendments applied only to the federal government and not to the states. Murray Dry traces the trajectory of freedom of speech and religion to the center of contemporary debates as few scholars have done, by looking back to the American founding and to the classical texts in political philosophy that shaped the founders' understanding of republican government. By comparing the colonial charters with the new state constitutions and studying the development of the federal Constitution, Dry demonstrates the shift from governmental concern for the salvation of souls to the more limited aim of the securing of rights. For a uniquely rich and nuanced appreciation of this shift Dry explores the political philosophy of Locke, Spinoza, Montesquieu, and Mill, among others, whose writings helped shaped the Supreme Court's view of religion as separate from philosophy, as a matter of individual faith and not a community practice. Delving into the polyvalent interpretations of such fundamental concepts as truth, faith, and freedom, Civil Peace and the Quest for Truth immeasurably advances the study of American constitutional law and our First Amendment rights.

The San Francisco Nexus in World War II Freedoms Found, Liberties Lost, and the Atomic Bomb【電子書籍】[ Philip E. Meza ]

In The San Francisco Nexus in World War II: Freedoms Found, Liberties Lost, and the Atomic Bomb, Meza tells the story of important events in the San Francisco Bay Area that have consequences still felt to date. He traces the invention of the atomic bomb, from a speculative design for a nuclear weapon sketched on a chalkboard at Berkeley by theoretical physicist Robert Oppenheimer and helped made real by “Big Science” that was pioneered by his friend and colleague, experimental physicist Ernest Lawrence. During this time, Black Americans migrated to San Francisco to escape the Jim Crow South, finding new freedoms, good jobs, and a leader in a singer-turned-welder named Joseph James. Meza shows how James fought for and won an end to segregation in his union, taking a large step toward the civil rights movement. At the same time, Japanese Americans were forced from their homes by a tragically misguided presidential executive order, upheld by the US Supreme Court, illustrating the fragility of liberty in America. These events continue to shape the world today.

Freedoms of Navigation in the Asia-Pacific Region Strategic, Political and Legal Factors【電子書籍】[ Sam Bateman ]

The need for freedoms of navigation in regional waters is frequently mentioned in statements from regional forums, but a common understanding of what constitutes a particular freedom of navigation or the relevant law is lacking.

This book discusses how law, politics and strategy intersect to provide different perspectives of freedoms on navigation in the Asia-Pacific region. These freedoms are very important in this distinctively maritime region, but problems arise over interpreting the navigational regimes under the law of the sea, especially with regard to the rights of foreign warships to transit another country’s territorial sea without prior notification or authorisation of the coastal state, and with determining the availability of high seas freedoms of navigation and overflight in an exclusive economic zone. The book explores these issues, referring in particular to the position of the main protagonists on these issues in Asian waters ? the United States and China ? with their strongly opposing views. The book concludes with a discussion of the prospects for either resolving these different perspectives or for developing confidence-building measures that would reduce the risks of maritime incidents.

Providing a comprehensive yet concise overview of the various different factors affecting freedom of navigation, this book will be a valuable resource for those working or studying in the fields of international relations, maritime security and the law of the sea.

The Permission Society How the Ruling Class Turns Our Freedoms into Privileges and What We Can Do About It【電子書籍】[ Timothy Sandefur ]

Throughout history, kings and emperors have promised freedoms” to their people. Yet these freedoms were really only permissions handed down from on high. The American Revolution inaugurated a new vision: people have basic rights to life, liberty, and the pursuit of happiness, and government must ask permission from them. Sadly, today’s increasingly bureaucratic society is beginning to turn back the clock and to transform America into a nation where our freedoms-the right to speak freely, to earn a living, to own a gun, to use private property, even the right to take medicine to save one’s own life-are again treated as privileges the government may grant or withhold at will. Timothy Sandefur examines the history of the distinction between rights and privileges that played such an important role in the American experiment, and how we can fight to retain our freedoms against the growing power of government. Illustrated with dozens of real-life examples-including many cases he litigated himself-Sandefur shows how treating freedoms as government-created privileges undermines our Constitution and betrays the basic principles of human dignity.

Peaceful Resistance Advancing Human Rights and Democratic Freedoms【電子書籍】[ Robert M. Press ]

An innovative study that examines how peaceful, domestic tactics by individual human rights activists and organizational activists, with public support, can force an authoritarian regime to make key concessions. Robert Press explores the creation and impact of a culture of resistance. He examines how domestic pressure can be more important than foreign pressure for political reform, especially in underdeveloped, authoritarian states. This study of contemporary Kenya fills a gap in traditional social movement theory to show how a resistance movement actually starts. Contrary to long-dominant theory, the book shows how the initiative for such a movement can come from activists themselves in the face of severe obstacles in society. With its unique findings on the effects of individual activism and peaceful resistance, this book will attract a broad audience in the study and practice of international relations, comparative politics, sociology, interest groups, peace and conflict, and human rights.
