Term Limits in State Legislatures【電子書籍】[ John M. Carey ] 楽天Kobo電子書籍ストア	＜p＞It has been predicted that term limits in state legislatures--soon to be in effect in eighteen states--will first affect the composition of the legislatures, next the behavior of legislators, and finally legislatures as institutions. The studies in ＜em＞Term Limits in State Legislatures＜/em＞ demonstrate that term limits have had considerably less effect on state legislatures than proponents predicted.＜/p＞＜p＞The term-limit movement--designed to limit the maximum time a legislator can serve in office--swept through the states like wildfire in the first half of the 1990s. By November 2000, state legislators will have been "term limited out" in eleven states.＜/p＞＜p＞This book is based on a survey of nearly 3,000 legislators from all fifty states along with intensive interviews with twenty-two legislative leaders in four term-limited states. The data were collected as term limits were just beginning to take effect in order to capture anticipatory effects of the reform, which set in as soon as term limit laws were passed. In order to understand the effects of term limits on the broader electoral arena, the authors also examine data on advancement of legislators between houses of state legislatures and from the state legislatures to Congress.＜/p＞＜p＞The results show that there are no systematic differences between term limit and non-term limit states in the composition of the legislature (e.g., professional backgrounds, demographics, ideology). Yet with respect to legislative behavior, term limits decrease the time legislators devote to securing pork and heighten the priority they place on the needs of the state and on the demands of conscience relative to district interests. At the same time, with respect to the legislature as an institution, term limits appear to be redistributing power away from majority party leaders and toward governors and possibly legislative staffers.＜/p＞＜p＞This book will be of interest both to political scientists, policymakers, and activists involved in state politics.＜/p＞＜p＞John M. More Women Can Run Gender and Pathways to the State Legislatures【電子書籍】[ Susan J. While they enjoy the freedom to stand for office and therefore have an equal legal footing with men, this persistent gender imbalance raises pressing questions about democratic legitimacy, the inclusivity of American politics, and the quality of political representation. The reasons for women's underrepresentation remain the subject of much debate. One explanation--that the United States lacks sufficient openings for political newcomers--has become less compelling in recent years, as states that have adopted term limits have not seen the expected gains in women's office holding. Other accounts about candidate scarcity, gender inequalities in society, and the lingering effects of gendered socialization have some merit; however, these accounts still fail to explain the relatively low numbers. Drawing upon original surveys conducted in 1981 and 2008 by the Center for American Women and Politics (CAWP) of women state legislators across all fifty states, and follow-up interviews after the 2008 survey, the authors find that gender differences in pathways to the legislatures, first evident in 1981, have been surprisingly persistent over time. They find that, while the ambition framework better explains men's decisions to run for office, a relationally embedded model of candidate emergence better captures women's decision-making, with women's decisions more often influenced by the encouragement and support of parties, organizations, and family members. The aim of the book is to give a solid and comparative insight into Europeanization focusing on effective outcomes in a systematic way. This book analyzes the period 1986-2008 and includes an introduction, a global overview of European legislative activities which set the background for Europeanization of national legislatures, 9 country contributions (8 EU member states + Switzerland) including systematic, comparative and standardized data, tables and figures, and a conclusion with a comparative analysis of the European and domestic reasons for Europeanization.＜/p＞＜p＞All national contributions conclude that Europeanization of national legislation is much more limited than assumed in the literature and public debate. In practice, they have usually other roles as well, such as debating meas-ures or the conduct of public affairs. They have existed for centuries. They span the globe. Most countries have one; federal states have several.' This statement applies to both institutions my paper deals with: to the United States Congress as well as to Germany's parliament. The constitutional core of both political systems is actually a powerful bicameral parliament vested with the power to enact legislation. However, the structure of power of the American Congress in comparison to the German system is different in regard to the relationship of both chambers to each other on the one hand and to the executive on the other hand. But both institutions share the same essential functions of representing the people of their country, of counterbalancing the executive power and of developing legislation. Germany's political system is build upon a parliamentary structure, where the power of the executive depends on a prime minister or chancellor and his cabinet getting their mandate from the legislature and thus being responsible to and depending on the support of it. On the contrary, the United States features a presidential system, where the president is both head of the state and head of the government, independent from the legislature, which can be dominated by the oppos-ing party (divided government). But this does not mean that the two branches cannot be com-pared. Because of their position within the federal system (as described above) and the similar composition of the branches, a comparison is more than just possible. It was the high influence of the allied powers and in particular of the United States occupation policy after World War II that made the German parliament bicameral. It is difficult, therefore, to generalize on such effects as partisanship. It is becoming more institutionalized. It is becoming more stable as fewer members retire and more are reelected. The trend is toward longer sessions, increased staff, and more activity. For this reason, the author argues, legal philosophers are better off abandoning it. In its place the book offers an alternative framework for understanding the role of courts and the legislature; a framework which is distinctly anti-positivist and which builds on Ronald Dworkin's interpretive theory of law. But, contrary to Dworkin, it insists that legal duty is sensitive to the position one occupies in the project of governing; legal interpretation is not the solitary task of one super-judge, but a collaborative task structured by principles of institutional morality such as separation of powers which impose a moral duty on participants to respect each other's contributions.
